VISTO, which is vacant as PENITENCIARY PROCEDURES for the expiration of the term of office of its former holder, and

CONSIDERING:

That the nature of the functions of the above-mentioned post determines the need to cover it within the shortest time.

To this end, the background of the candidate proposed by the Minister of Justice has been evaluated, which demonstrate the requirements of suitability and capacity required for his performance.

That Mr. Oscar Luján FAPPIANO currently holds the status of Member of the Inter-American Commission on Human Rights of the Organization of American States with a mandate in force until 31 December 1997.

That the mentioned circumstance does not hinder - due to the special characteristics of the activity of the international body referred to - the effective fulfillment of the duties assigned to the Penitentiary Procurator, therefore, in this case, make exception to the norm contained in Article 5 of! Decree No. 1598/93.

That the present is given in the exercise of the powers agreed upon by article 99, paragraphs 1 and 7 of the National Constitution.

Therefore,

Article 1Designa PENITENCIARY PROCURER to Dr. Oscar Luján FAPPIANO (L.E. No. 4.144.959).

Art. 2o-Except for the designated official of the incompatibility provided for in Article 5 of Decree No. 1598/93, as long as he is in force as a member of the Inter-American Commission on Human Rights of the Organization of American States.
