VISTO is proposed by the MINISTERY OF ECONOMY AND PUBLIC ARTWS AND SERVICES, and

CONSIDERING:

That given the relevance of public investment policies and the plans of public works currently under development by the National Government and the need to establish adequate coordination at the national, regional and provincial levels of the various existing projects and programmes, it is appropriate to unfold the current SECRETARIAT OF PUBLIC AND TRANSPORTS MINISTERY OF ECONOMY AND OURS AND SERVICES PUBLICS, in such a way as to respond as circumstances require, to the needs that generate the design of policies and the implementation of public works plans, as well as transport in their different modalities.

It is necessary to unify the conduct of programmes, projects and activities linked to internal and international transport, cargo and passengers, in their different modes, as well as with regard to port activities and the waterways, in order to achieve greater efficiency and effectiveness in the use of the resources allocated to them.

That, on the other hand, and given the new profile required by the SECRETARIAT OF PUBLIC MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, it is considered advisable to transfer to this the REGIONAL PROGRAMME SUBSECRETARIA, currently in the orbit of the SECRETARIAT OF ECONOMIC PROGRAMME of the MINISTERIO DE ECONOMY

In the same order of ideas, it is appropriate to explain the objectives of the political levels of the SECRETARIAT OF ECONOMIC POLICY, DE ARTWORKS. TRANSPORT AND ENERGY, MINISTERY OF ECONOMY AND PUBLIC SERVICES.

That also, and for reasons of administrative order, it is necessary to determine the first operating units that depend directly on the political levels that are affected by this measure.

Because of the adequacies introduced by this rule, it is advisable to clearly define the dependence of non-members of the Central Administration dependent on the areas affected by this act.

That the General Directorate of Juridical Questions of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES has taken the intervention that belongs to it.

That the UNITY OF REFORM AND MODERNIZATION OF THE STATE OF MINISTERS' GABINETE JEFATURA has taken the intervention that belongs to it, making a favourable expiation.

That the NATIONAL EXECUTIVE POWER is empowered to issue this measure, under the emerging powers of Article 99 (1), of the NATIONAL CONSTITUTION and Article 15 of Law No. 24,764.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION IN GENERAL AGREEMENT OF MINISTERS

RIGHT:

Article 1Modify Annex I to Decree No. 660 of 24 June 1996, its amendments and supplements, part corresponding to the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, which will be integrated in accordance with the detail set out in the annexed tables to this article.

Art. 2o-Modify Annex II -Objectives - of Decree No. 660 of 24 June 1996, its amendments and supplements, part corresponding to the SECRETARIAT OF ECONOMIC POLICY, DE ARTWORKS PUBLICAS, DE TRANSPORTE and DE ENERGIA, all of them dependent on the MINISTERY OF ECONOMY AND ARTWORKS and SERVICES PUBLICOS,

Art. 3o-Approved the functional organization of the SECRETARIAT OF ECONOMIC POLICY, DE ARTWORKS, TRANSPORT and ENERGY, of the MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES, which will be conformed according to the detail in the annexed tables to this article.

Art. 4o-Approve the primary responsibility and actions of the National Directorate of Fluvial and Maritime Transport of the SUBSECRETARIA OF AEROCOMERCIAL, FLUVIAL AND MARITIMO TRANSPORTS, under the SECRETARIAT of the MINISTERY OF ECONOMY AND PUBLIC SERVICES, in accordance with the annexed table to the present article.

Art. 5o-The dependence of non-members of the Centralized Administration of ECONOMIC POLICY SECRETARIAT, DE ARTWORKS, TRANSPORT and ENERGY, of the MINISTERY OF ECONOMY AND PUBLIC SERVICES, in accordance with the annexed tables to this article.

Art. 6o-Staff in the areas affected by this measure will maintain their current levels and degrees of journals to date. The measure includes the occupied positions of the Charges Regime with Executive Functions.

Art. 7o-Until it is completed with the organization of the areas affected by this measure, the existing lower structural openings will remain in force, with the assignment of the respective posts with executive functions of the Cargo Regime with Executive Functions.

Art. 8o-To the sole effect of implementing the provisions of this act, please enable the Minister of Economics and Public Works and Services to assign temporarily, until the relevant organizational process is completed, to the holders of the positions corresponding to the areas affected by this decree.

Art. 9o-Modify the Administrative Distribution of the General Budget of the National Administration-Human Resources of the Jurisdiction 50.00 - MINISTERY OF ECONOMY AND ARTS AND PUBLIC SERVICES - in accordance with the annexed tables to this article.

Art. 10.-The MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES shall, within a period not greater than the TREINTA (30) days for approval, the projects of organizational structure of the areas affected by this measure.

Art. 11.-The expenditure that demands the application of this decree will be met with the existing provisions assigned to the jurisdiction 50.00 - MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES.

SECRETARIAT OF ECONOMIC POLICY

OBJECTIVES

1.-To develop and propose instruments for the programming, consistency and analysis of economic policy.

2.-To systematically monitor the situation of the global and sectoral economy.

3. To coordinate in its capacity as the implementing authority of the National Public Investment System, the evaluation and proposal of priorities in public investment projects and programmes with external financing, as well as the updating of annual and multi-year investment plans.

4.-Conduct, through the NATIONAL INSTITUTE OF STATISTIC And CENSOS, the National Statistical System and the National Censuses, develop national socio-economic statistics, and analyses and studies from them.

5.-Conduct, through the respective areas, the National and International Account Systems and the analyses and studies derived from them.

6.-Programme and coordinate the assessment of consolidated social spending policies, their financing and their impact on the population and carry out diagnostics and monitoring of the living standards of the population.

7.-Coordinate everything related to relations and negotiations with international credit, bilateral and non-bilateral financial agencies.

8.- To direct the coordination of policies and actions that make the exercise of the corporate rights of shareholders or of capital in companies where the National State is a minority partner, and to instruct representatives of the National State in the aforementioned companies, including those in the process of total privatization.

9.- Supervising the development of insurance and securities market services according to external opening and deregulation policies.

10. To coordinate the administrative aspects of relations with the BANCO OF ARGENTINA NATIONAL NATIONAL BANCO and the BANCO OF INVERSION AND EXTERIOR SOCIEDAD ANONIMA (BICE:).

11.-Coordinate the relations between the NATIONAL VALORES COMMISSION, the SUPERINTENDANCE OF NATIONAL ASSESSMENT, the CASE OF MONEDA SOCIEDAD OF THE STATE and the SUPERIOR INSTITUTE OF GOVERNMENT ECONOMISTS, with the NATIONAL EXECUTIVE PODER.

MACROECONOMIC PROGRAMME

OBJECTIVES

1. Coordinate prospective analyses that link the objectives and instruments of macroeconomic policies.

2.-Conciliate the various plans, programmes and projects with the guidelines of economic policy at the fiscal, monetary and income levels.

3. To systematically monitor the economic situation and publish periodic indicators and reports to assess the performance of the economy.

4.-Organize and develop National and International Account Systems and related analyses and studies.

5.- Supervising everything linked to the SUPERIOR INSTITUTE OF GOVERNMENT ECONOMISTS.

PUBLIC INVERSION AND SOCIAL GASTE

OBJECTIVES

1. To evaluate and propose the priorities of national public investment projects and programmes with external financing.

2.- Understand the National Public Investment System and intervene in projects subject to its provisions.

3.-To develop the National Public Investment Plan and ensure its permanent update.

4. Interact with private activity for the purposes of compliance with Act No. 24,354 establishing the National Public Investment System.

5. Intervene in negotiations with the International Credit Agencies and in the control and monitoring of programmes and projects with external financing.

6.- Cooperate with the SECRETARIAT OF HACIENDA in the preparation of the General Budget for Expenditure and Resource Calculation of the National Administration, specifically regarding national public investment projects, with the scope set out in Act No. 24,354 and projects funded by international credit agencies.

7. Ensure the development, updating and maintenance of information systems for efficient programme delivery with international credit agencies.

8.-Resolve on remedial measures that assist in the good management of loans with international credit agencies and the increased efficiency in the implementation of public investment projects and programmes.

9.-Evaluate consolidated social spending programmes, making a permanent diagnosis and monitoring of their impact on the living conditions of the population.

AND FOLLOW-UP SUBSECRETARIA

1.- Implement policies on the development of services and stock market.

2. To assist the Secretary of Economic Policy in relation to relations with the NATIONAL COMMISSION OF VALORES and SUPERINTENDANCE OF NATIONAL FOLLOWERS.

3. To assist in the coordination of the administrative aspects of relations with the BANCO OF ARGENTINA NATIONAL NATIONAL HELLPOTECARY BANCO and the BANCO OF INVERSION AND EXTERIOR SOCIEDAD ANONIMA (BICE).

4.-Coordinate analysis and make proposals for alternatives for the design of the financial sector policy.

5.- Run the actions to coordinate the sale of the shareholders in the possession of the National State.

6.-Coordinate the policies and actions that make the exercise of the corporate rights of the shareholders or of the capital of companies where the National State is a minority partner and are in the process of total privatization, and instruct the representatives of the National State in the aforementioned companies.

SECRETARY-GENERAL

OBJECTIVES

1.- Understand in the development, proposal and implementation of the national public works policy, monitoring its implementation and coordinating plans, programmes and projects linked to them at the national, regional and provincial levels. It also proposes the regulatory framework to facilitate its implementation, exercising the powers conferred directly by the existing regulations on the matter or those delegated to it in the future.

2.-Conduct the management and acquisition of international technical and financial cooperation that other countries or international agencies offer, for the implementation of the objectives and policies of the SECRETARIAT OF PUBLIC ARTWS.

3. To understand in the formulation, monitoring and monitoring of the implementation of policies relating to physical property owned by the National State and to implement and update an information system that facilitates the operation of such assets.

8.- Assist in the resolution of administrative remedies against the specific activities of the actions of the entities mentioned in the preceding paragraph.

9.-Conduct actions to apply sectoral policy by guiding the process of adapting new operators to the general interest.

10. To systematically monitor the situation of the regional economy.

11.-Coordinate the economic, fiscal and financial aspects as well as all related to public works projects, between the NATIONAL GOVERNMENT and the PROVINCIAL GOVERNMENTS and the GOVERNMENT OF THE CITY OF GOOD AIRES.

REGIONAL AGENDA SUBSTANCE

OBJECTIVES

1.-Conduct what is linked to the programming and articulation of public works projects at the national, regional and provincial levels.

2.- Form public works programmes at the regional and provincial levels.

3. To coordinate with units of the MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES and other ministries, all aspects related to regional economic programming.

4. To provide technical assistance to the provinces in the formulation of regional and public development programmes.

5.-Propose self-financing instruments for the support of regional development.

6.-Coordinate the implementation of a single bank of economic and social data on provinces and regional economies.

7.-Realize studies on regional economies.

8.- Act as an executing unit for projects aimed at regional development.

9.- Assist in the planning of public works concession policies, in particular the national road system.

10.-Coordinate the fiscal, economic and financial aspects and their social impacts on the relationship between the NATIONAL GOVERNMENT and the Provincial and Municipal Public Sectors and design and operate a system of information on the financial management of the Provinces and Municipalities that allows their integration into the national accounts.

11. To evaluate and monitor the financial systems of the Provincial States, their productive infrastructure, the processes of privatization and deregulation, and in general, all relevant to the review and resolution of the issues of dispute in the economic, financial and/or fiscal field between the Nation and the Provinces.

15. To assist the Secretary of Public Works in the planning of the national policy on the provision of public services for drinking water supply, evacuation and treatment of excreta and other complementary ones.

16. To assist the Secretary of Public Works in the management and delivery of technical and financial cooperation, from international agencies or other sources, aimed at the realization of the objectives of the Secretariat.

17.-Celebrate agreements with the provinces, municipalities and/or other entities for the development and implementation of the programs and actions of their competence.

SUBSECRETARIA

OBJECTIVES

1.-Elaborate the operational plan of works of the SECRETARIAT OF PUBLIC ARTWS and conduct its execution.

2.-Coordinate the analysis and development of the proposals on the regulatory framework that facilitates the realization of them.

3.-Elaborate the folds and intervene in the process of hiring the public work of responsibility of the SECRETARIAT OF PUBLIC ART.

4.-To assist the Secretary of Public Works in the exercise of the powers that have been delegated or delegated to him in the future regarding the governing rules on public works and/or on concessions of public works.

5.- Assist the respective counter-lord agencies in the control of road concessions.

6.- Understand in the formulation, monitoring and implementation of policies relating to the construction, conservation and recycling of tax buildings and the restoration and conservation of national historical monuments.

10.- Assist the Secretary of Public Works in the implementation of programmes and actions related to the management of shared international water resources, their basins, successive and contiguous river courses and water bodies in general.

11. To assist the Secretary of Public Works in the implementation of programmes and actions aimed at the comprehensive management of inter-provincial watersheds and regions, representing the National State where it corresponds to the existing legislation, in accordance with the guidelines to be determined by the SECRETARIAT OF NATURAL RESOURCES AND SUSTAINABLE DEVELOPMENT of PRESIDENCE OF NATION and in coordination with the agencies and jurisdictions involved.

12.-To assist the Secretary of Public Works in the design and implementation of programmes and actions for the management and development of infrastructure and services linked to water resources, promoting mechanisms of construction, operation and maintenance and of control and regulation that, as far as possible, include the participation of private entrepreneurs and the community involved.

13. To assist the Secretary of Public Works in the implementation of the national policy on the provision of public services for drinking water supply, the evacuation and treatment of excreta and other complementary ones.

14.- Supervising the actions of the decentralized agencies of their jurisdiction.

SECRETARIAT OF TRANSPORT

OBJECTIVES

1.- Understand in the development, proposal and implementation of the national policy on land, aerocommercial, river and maritime transport, and port and waterways activities, monitoring their compliance and coordinating their plans, programmes and projects. It also proposes the regulatory framework to facilitate its implementation, exercising the powers conferred directly by the existing regulations on the matter or those delegated to it in the future.

2.-Conduct the management and acquisition of international technical and financial cooperation that other countries or international agencies offer, for the implementation of the objectives and policies of the SECRETARIAT.

3. To understand the operation of an integrated system of internal and international transports, coordinating their actions and developing measures to allow the development of the air, land, river and maritime modes, in conditions of maximum efficiency, in accordance with the powers granted by the legislation and the current regulations.

4.-Define and control the short, medium and long-term policies and plans for internal and international transport that facilitate appropriate coordination, especially aimed at promoting Latin American integration and promoting studies and actions that enable different forms of deregulation, privatization and/or partial or total concession of services to the extent that it aims to improve the system.

5.- Supervising the control and control of the transport services provided through the different modes, ensuring the highest quality of service and protection to the user in rational conditions of economicity, and coordinating actions related to prevention, accidents and road safety.

6.- Participate in the meetings of consultation, technical meetings or negotiations with the authorities of the aerocommercial transport of the other countries, necessary for the development of the instruments of regulation of international aerocommercial relations.

7.-Exercise the powers of the Comptroller with respect to those entities or control agencies of the privatized or concessioned areas of competence of the Secretariat when they have a functional link with it, and enforce the corresponding regulatory frameworks.

8.- Understand in the formulation, monitoring and control of the implementation of the policies and powers entrusted to the NATIONAL ENTER OF ADMINISTRATION OF BIENES FERROVIARIOS, created by Decree No. 1383 of 29 November 1996.

9. To assist in the resolution of administrative remedies that are filed against the specific activities of the actions of the entities mentioned in Goals 7) and 8 above.

10.-Conduct actions to implement sectoral policy by guiding the process of adapting new operators to the general interest.

SUBSECRETARIA DE TRANSPORTE TERRESTRE

OBJECTIVES

I.-Effect the proposal and control of the implementation of policies, plans and programmes related to the transport of land, cargo and passengers, both metropolitan and long distance.

2.-Coordinate studies to update the regulations in force regarding operating modalities, technical aptitude of equipment, insurance, tariff regime and any other regulations related to the actions of its competence.

3. - Develop and propose policies for deregulation, privatization and/or concession of transport services.

4.-Contribute to the structure and planning of transport in the Metropolitan Area of Buenos Aires.

5.- Supervising the actions of the decentralized agencies of their jurisdiction.

AEROCOMERCIAL, FLUVIAL AND MARITIMO

OBJECTIVES

1. To implement the proposal and control of the implementation of policies, plans and programmes related to aerocommercial, river and maritime transport.

2.-Coordinate studies to update the regulations in force regarding operating modalities, tariff regime and any other regulations related to the actions of its competence.

3. - Develop and propose policies for deregulation, privatization and/or concession of transport services.

4.-Coordinate everything related to road plans as well as the modification or updating of legislation and the operation of the aerocommercial transport system.

5.- Participate in the restructuring of the National Airport System.

6.- Apply the requirements of the Air Code, the International Agreements and the regulatory regulations in all matters concerning aerocommercial transport.

7. Supervising the actions of the decentralized agencies of their jurisdiction.

8.-Provide the promotion system through economic complementarity.

OPERATING AND NAVEGABLE VIAS

OBJECTIVES

1.-To implement the proposal and control of the implementation of the policies and plans related to port activity and the waterways. Exercise all responsibilities and functions of the national port authority.

2. - Develop and propose policies of deregulation, privatization and/or concession of ports, harbour and waterways services.

3.-Coordinate studies to update the regulations in force regarding operating modalities, technical aptitude of equipment, insurance, tariff regime and any other regulations related to the actions of its competence.

SECRETARIAT OF ENERGIA

OBJECTIVES

1.- Understand the development, proposal and implementation of the national energy policy by monitoring its compliance and proposing the regulatory framework to facilitate its implementation.

2.-Exercise the powers of the Comptroller with respect to those entities or agencies of control of the privatized or concessioned public services in the area of the Secretariat, when they have a functional link with it and enforce the corresponding regulatory frameworks.

3.-Assist in the resolution of the administrative resources that intervene against the actions of the Regulatory entities of the specific activities.

4.-Conduct actions to implement sectoral policy by guiding the process of adapting new operators to the general interest.

ENERGY SUBSECRETARIA

OBJECTIVES

1. To implement the proposal and control of the implementation of sectoral policies.

2.-Monitor the relations with and between the different operators of the electrical system, ensuring the proper information about the conditions of demand and supply in the short, medium and long term.

3.-Evaluate the natural resources available for energy use, assist in the development of the proposals regarding the specific regulations for the different stages of the electric industry, evaluate their environmental impact in coordination with the relevant areas and promote programmes leading to the rational use of energy and the development of new and renewable sources.

COMBUSTIBLE SUBSECRETARIA

OBJECTIVES

1. To implement the proposal and control of the implementation of the national policy of hydrocarbons, mineral coal and other fuels, in what it does to promote and regulate its stages of exploration, exploitation, transport and distribution.

2.-To study and analyze the behaviour of the deregulated market of hydrocarbons and mineral coal, promoting competition and efficiency policies in the allocation of resources.

NATIONAL DIRECTION OF FLUVIAL TRANSPORT AND MARITIMO

PRIMARY RESPONSIBILITY

Develop, propose and implement policies, plans and programmes related to river, maritime and lake transport.

ACTION

1.- Participate in the development of the policy concerning the National Merchant Navy.

2. - Participate in the negotiations and implement the conventions and agreements of river, maritime and lake transport cooperation in the field, at the national and international levels. Intervene in meetings of international agencies linked to the sector.

3.-Coordinate studies on the area and propose actions for the National Merchant Navy to reach levels of competitiveness in the international market and carry out studies for the determination of freight rates and conditions of transport.

4.-Intervente in the application of the rules on the Practice and Piloting Service for rivers, ports and channels. Coordinate the administrative management of the National Directorate.

5.-Promote efficient and competitive development in the international order of the naval industry and advise the official and private agencies, in relation to the requirements of shipping and related activities in the country.

6. Intervene in the technical, economic and institutional studies linked to the project of the Paraguay and Paraná Hydroway, at the corresponding meetings.
