Apply a Model Loan Convention to be signed with the International Bank for Reconstruction and Development (BIRF) for the implementation of the Second Child Health and Nutrition Project (PROMIN II).

VISTO Issue No. 2002-5336-97-1 of the registration of the Ministry of Health and Social Action, and

CONSIDERING:

That by Decree No. 443 of 16 March 1993 the MATERNO INF'ANTIL and NUTRICION (PROMIN) programme was approved in the area of the MINISTERY of HEALTH and SOCIAL ACTION and created the Coordinating Unit of the Programme (UCP).

That by Decree No. 1805 of 27 August 1993, the Model of Loan was approved with the INTERNATIONAL BANCO of RECONSTRUCTION and FOMENT (BIRF) for the implementation of the PROJECT of HEALTH and INFANTIL MATERNO INFANTIL (PROMIN)

Negotiations were concluded with the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO (BIRF) for the granting of a Loan that will apply the extension of the PROJECT OF HEALTH and INFANTIL MATERNO INFANTIL (PROMIN) currently in operation, and that it will be carried out through the SECOND PROJECT of HEALTH and MATERIAL INFANTMINATION II.

That the formalization of this operation requires that the REPUBLICARGENTINA, through the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, subscribe to the proposed Loan Convention and all its supplementary documentation.

That the general conditions, the periods of amortization, grace periods, interest rate, commitment commissions and other clauses, contained in the proposed Convention to be signed, are the usual ones adopted in this type of Convention and are appropriate to the purposes and objectives to which the provision is intended.

That the implementation of the Programme requires the signature of Accession and Enforcement Conventions with each of the provinces to which it is intended.

It is appropriate to extend the legal capacity of the Programme Coordinating Unit (UCP) for the implementation of the SECOND PROJECT OF HEALTH and MATERNO INFANTIL NUTRITION (PROMIN II).

That this Convention is covered in the terms of Article 60 in fine of Law 24.156, on Financial Administration and National Public Sector Control Systems.

That, in accordance with Article 16 of Law 11.672 of the Permanent Supplementary Budget (T.O. 1996) and Article 99 (1) of the NATIONAL CONSTITUTION, the NATIONAL EXECUTIVE POWER is empowered to approve operations of this nature and subject any disputes to the decision of the Arbitral Tribunals.

Therefore,

THE PRESIDENT OF THE ARGENTINA DECRETA NATION:

Article 1o-Apply the Model of Loan Convention, which consists of SIETE (7) Articles, VEINTITRES (23) Sections and SEIS (6) Annexes, for the execution of the SECOND PROJECT OF HEALTH and NUTRICION MATERNO INFANTIL (PROMIN II) to subscribe between the ARGENTINA NATION and the INTERNATIONAL BANCELLATION The objectives and lines of action of the Project form an integral part of this Decree as Annex I: the Model Convention of the Loan in its English language version, as Annex II: its translation into the Spanish language, as Annex III; the authenticated copy of the original English language version of the General Conditions Applicable to the Conventions of Loan and Guarantee for Loans in Currency

Art. 2o-Please refer to the Minister of Economics and Public Works and Services or to the official or officials designated by him, to subscribe on behalf of and representation of the ARGENTINA NATION the Loan Convention and its additional documentation concerning the model approved in Article 1 of this Decree.

Art. 3o-Please refer to the Minister of Economics and Public Works and Services or to the official or officials designated by him, agreeing to and signing amendments to the Loan Convention adopted in Article 1 of this Decree, provided that they do not constitute substantial changes to the fate of the Loan, resulting in an increase in their amount or modify the agreed arbitral proceedings.

Art. 4o- The SECOND PROJECT OF HEALTH AND INFANTIL MATERNO NUTRITION (PROMIN II) will be funded, partly with resources from the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO (BIRF) and its implementation will be carried out by the SECRETARIAT OF HEALTH PROGRAMMES through the Programme Coordinating Unit (UCP), created by Decree No. 443/93.

Art. 5o-Please refer to the Minister of Health and Social Action or to the official or officials designated by the Minister, to subscribe to the Conventions on Accession and Enforcement.

Art. 6o-Consider the legal capacity of the Programme Coordinating Unit (UCP) for the implementation of the SECOND PROJECT OF HEALTH and MATERNO INFANTIL (PROMIN II).

Art. 7o-Please refer to the Secretary of Health Programmes of the MINISTERY OF HEALTH and SOCIAL ACTION to address the emerging responsibilities of the implementation of the SECOND PROJECT OF HEALTH and INFANTIL MATERNO INFANTIL (PROMIN II), whose model of the Loan Convention is approved by Article 1 of this Decree.

Art. 8o-Please refer to the Programme Coordinating Unit (UCP) to undertake all acquisitions and contracting of goods and services that are necessary for the implementation of the Programme Parties, in accordance with the Procurement Standards with Loans of the IFRB and Credits of the IDA of January 1995, revised in January and August 1996, to the Standards for the Use of Consultants by the World Bank and by the World Bank as the Implementing Agency of 11.67.

Art. 9o-The counterpart funds that the National State must make to meet its commitments under the Model Loan Convention adopted by Article 1 of this Decree shall be charged to the specific budgetary provisions of Jurisdiction 80, MINISTERY OF HEALTH and SOCIAL ACTION.
