VISTO the Unique Convention of 1,961 on Narcotic Drugs, adopted by Decree-Law No. 7672/63 ratified by Act No. 16,478, its Protocol of Amendment adopted by Act No. 20,449, the Convention on Psychotropic Substances, adopted by Act No. 21,704, the United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances, adopted by Decree No. 227,198, 623/96, 1426/96, 1119/96, 1339/96 and 342/97, and

CONSIDERING:

That for the first of the Conventions referred to above, and as amended by the Protocol of 1,972, and the Convention on Psychotropic Substances of 1,971, the States parties assumed the commitment to inform the governing body of the United Nations and, in particular, the International Bureau for Drug Trafficking.

They also pledged to do their best to implement control measures in order to prevent substances not subject to the provisions of those treaties from being used in the illicit manufacture of narcotic drugs and psychotropic substances.

That the United Nations Convention against Illicit Traffic in Narcotic Drugs and Psychotropic Substances of 1,988, also incorporated into our domestic positive legal order by Law No. 24,072, reaffirmed the commitment made by the international instruments cited, establishing modern mechanisms for international cooperation, in order to avoid the illicit diversion of substances subject to the Convention.

That by Decree No. 623/96, the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICTION AND LIGHT AGAINST THE NARCOTRAFIC OF PRESIDENCE The preparation and approval of the "Federal Plan of INTEGRAL PREVENTION OF DROGADEPENDENCE AND CONTROL OF ILICIT OF DROGAS".

It was also attributed to the Agency to the conclusion and coordination of the implementation of national and provincial policies on the comprehensive prevention of drug addiction and the fight against drug trafficking.

That in particular and for the fulfillment of such objectives, by Decree No. 623/96 already referred, in particular by article 3°.

The Ministries and Secretariats involved in the drug problem are obliged to cooperate in order to their respective powers, missions and functions.

Article 4 of the same Decree obliges the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROCADICTION AND LIGHT AGAINST THE NARCOTRAFIC OF PRESIDENCE DE LA NATION, to establish a system of permanent information that will enable the implementation of the international agreements and conventions that have been signed and to evaluate the results achieved.

That Decree No. 1426/96, which approved the new organizational structure of the above-mentioned Secretariat, reiterated the obligation to centralize specific information and technical documentation, maintaining a permanent relationship with the relevant specialized agencies, including the governing body of the United Nations and relevant regional agencies.

That Decree No. 623/96, previously referred to, made it possible, in particular in accordance with article 3 of the Decree No. 1119/96 and 342/97, forming inter-ministerial working groups, in order to support the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICTION AND LIGHT AGAINST THE NARCOTRAFIC OF PRESIDENCE OF NATION, for the fulfilment of the provisions of the NATIONAL EXECUTIVE PODER in accordance with their respective competencies, missions and functions.

That Decree No. 1339/96 approved the action taken by the SECRETARY for the PREVENTION OF DROGADICCION AND LUCHA AGAINST THE NARCOTRAFIC OF THE NATIONAL PRESIDENCE, before the Inter-American Commission on Drug Abuse Control (CICAD), of the Organization of American States (OAS), at its twentieth regular session, held from 15 to 18 October 1

In addition, Decree No. 1339/96 provided for the adoption of the programmatic principles and postulates contained in the Document "STRATEGY ANTIDROGAS IN HEMISFER", an instrument in which it is emphasized that, in order to facilitate and give coherence to the anti-drug activities, the countries of the hemisphere agree on the importance of the action of the respective National Drug Control Commissions - in our country, the SECRCION DE LA NATION- located at a high political level, whose purpose is to coordinate the planning and implementation of the respective national programmes that cover the various aspects of Drug Use.

In another of its recommendations, the mentioned Regional Strategic Plan promotes the development of science-based systems that enable countries to know the dimensions and trends of the demand phenomenon, and to assess the results of the programmes implemented.

That the present measure is in use of the powers conferred by article 99 (1) of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1- Refer to the scope of the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICCION AND LUCHA AGAINST THE NARCOTRAFIC OF THE NATIONAL PRESIDENCE, the FEDERAL INFORMATION SYSTEM ON INDEBIDO AND CONTROL OF STUFACIENTS AND PSICOTROPIC SUBSTANCES.

Art. 2°- Integrate the System the following sources, indicators, measurement of basic variables and tools for information collection and conceptualization:

(a) The data-collection models for drug demand under the United Nations International Drug Control Programme (P.N.U.F.I.D.).

(b) The System for the Receipt and Centralization of Data and Reports relating to Crimes covered by Act No. 23,737, provided by the JUDICIAL PODER of NATION and Security Agencies, in accordance with Act No. 22,136.

(c) The model and specific instruments of the Inter-American System of Standard Data on Drug Use (SIDUC) of the Inter-American Data Bank of the Organization of American States (OAS), referring to Treatment Centers, Medical Emergency Services, Forensic Medicine, Youth Population and Students.

(d) The National Psychoactive Substances Consumption Research.

(e) Investigation into the judicial application of the provisions of the Law on Traffic and Trend in Narcotic Drugs. This research will be carried out in collaboration with the NATIONAL DIRECTION OF CRIMINAL POLICY OF THE MINISTERY OF NATIONAL JUSTICE.

(f) The Inter-American Drug Information System (IADIS) of the Organization of American States (OAS).

(g) Studies concerning the care of drug-dependent patients in the field of the Prison Service, both at the national and provincial levels.

(h) Analysis of the registration of cases handled by the Public Assistance Guidance Service at the PROGRAMME SECRETARIAT FOR THE PREVENTION OF DROGADICCION AND THE LIGHT AGAINST NARCOTRAFICE.

(i) Statistical analysis and information by the National Centre for Social Reeducation (CE.NA.RE.SO).

(j) Reports of the Programme Assessment System, provided for in article 11 of Decree No. 623/96, by the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICTION AND LIGHT AGAINST NARCOTRAFICE OF NATIONAL PRESIDENCE.

Art.3°- The agencies mentioned in Decrees No.1119/96 and 342/97, and all those whose competences, missions and functions are related to the matter in question, shall supply the System created by this Decree, at the request of the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICTION AND LUCTION AGAINST THE NARCOTRAFIC OF PRESIDENCE DE LA NATION, and with the periodicity that it determines all those useful data for performing situational diagnostics, statistical development, programme evaluation and information to the specialized international agencies.

Art. 4°- The Inter-Ministerial Committee established by the Nros Decrees. 1119/96 and 342/97, will formulate the situational diagnoses and the evaluation of programs referred to in the previous article, adopting to that effect the programmatic postulates contained in the document "STRATEGIA ANTIDROGAS IN HEMISFERIO", approved and ratified by acclamation and unanimity on October 17, 1,996, on the occasion of the Twenty-first Regular Period of Sessions of the Inter-American Drug Abuse Control Commission

Art. 5°- THE SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICTION AND LIGHT AGAINST THE NARCOTRAFIC OF PRESIDENCE DE LA NATION, in accordance with article 4° "in fine" of Law No. 22.136, is entitled to request directly the supplementary information provided for in article 3, to any national, provincial or municipal agency.

Art. 6°- The Information System created by Article 1 of the present integrates the Planning System of the "Federal Plan of INTEGRAL PREVENTION OF DROGADEPENDENCE AND CONTROL OF THE ILICIT TRAFFIC OF DROGAS", provided for in the Nros Decrees. 623/96 and 1426/96. For the purposes of the formulation of the Federal Plan, the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICCION AND LUCHA AGAINST THE NARCOTRAFICE OF THE NATIONAL PRESIDENCE is empowered to expand the list of statistical instruments provided for in article 2 of this Decree.

Art. 7°- Reference is made to the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF A DROGADICCION AND LUCHA AGAINST THE NARCOTRAFIC OF THE PRESIDENCE OF THE NATION to dictate the corresponding administrative acts in order to put into full and immediate operation the action of government established by this Decree. Its application may not result in an increase in the current level of funding for each of the agencies involved.
