Apply a model of the Loan Convention to subscribe to the International Bank for Reconstruction and Development, for the execution of the "Second Loan for Provincial Reform -Río Negro-".

VISTO the model of the Loan Convention, for the realization of the "SEGUNDO PRESTAMO FOR THE PROVINCIAL REFORM -RIO NEGRO-" proposed to be subscribed between the ARGENTINA REPUBLIC and the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO, for an amount equal to DOLARES ESTADOUNIDENSES SETENTA and CINCO, MILLS

CONSIDERING:

That through the so-called Loan Convention the INTERNATIONAL BANCO OF RECONSTRUCTION And FOMENT is committed to financially assisting the ARGENTINA REPUBLIC in order to enable the execution of the "SEGUNDO PRESTAMO FOR THE PROVINCIAL-RIO NEGRO-."

That the resources of the loan will be allocated to assist the Province in the framework of a programme of dissected actions, objectives and policies to support fiscal reform and restructuring, with emphasis on the provision of social services, especially in the health and education sectors.

That the resources from the loan will be transferred in United States dollars by the INTERNATIONAL BANCO OF RECONSTRUCTION AND FOMENT to the ARGENTINA REPUBLIC, and that the latter will transfer those funds to the NEGRO RIO PROVINCIA in its local currency equivalent, remaining the other terms and conditions, equal to those established in the Préstamus Convention to be subscribed between the INTERNATIONAL BANCO

That the general conditions, the time frames of amortization, interest rates, commitment commissions and other clauses contained in the Loan Convention, proposed to be subscribed, are the usual ones adopted in this type of operation and are appropriate to the purposes and objectives to which this loan is intended.

That it is necessary to designate the REGIONAL PROGRAMME SUBSECRETARIA OF THE SECRETARIAT OF PUBLIC MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, as national responsibility for the implementation of the loan, for the purpose of coordination with the INTERNATIONAL BANCO OF RECONSTRUCTION AND FOMENT.

It is necessary to channel the funds of the loan through a Special Account to be operated by the national responsible for the execution of the loan, which will be opened in the BANCO CENTRAL OF THE ARGENTINA REPUBLIC, in the terms established in the model of the Loan Convention.

That under Decree No. 434, dated 15 May 1,997, and Administrative Decision No. 210, dated 15 May 1,997, the JEFATURA DE GABINETE DE MINISTROS de la PRESIDENCIA From the NATION, it has taken the proper intervention.

That the proposed Convention for membership is covered by Article 60 in fine of the Financial Administration and National Public Sector Control Systems Act No. 24.156.

That the General Directorate of Humanitarian Affairs of the MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICOS has taken the intervention that belongs to him.

That the present measure is determined in the use of the powers conferred by Article 99, paragraph 1, of the National Constitution and Article 16 of Law No. 11.672 Permanent Supplementary to Budget (T.O. 1.996).

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1- Apply the model of the Loan Convention - which in authenticated copy is accompanied -, which consists of SEIS (6) articles, DIECIOCHO (18) sections and CUATRO (4) annexes, to subscribe between the ARGENTINA REPUBLIC and the INTERNATIONAL BANCO of RECONSTRUCCION YONEMENT for an amount equal to DOLARES STADOUNIDENSES SETENTA and CIN000. The text of the English-language Loan Convention and its translation into the Spanish language are part of the present Decree as Annex I, the General Conditions applicable to the Loan and Guarantee Agreements for Unique Currency Loans of the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO, dated May 30, 1,995, which consists of DOCE (12) articles and CINCUENTA and Spanish-language annexes.

Art. 2°- Please refer to the Minister of Economics and Public Works and Services or to the official or officials designated by him to sign, on behalf of and representation of the ARGENTINA REPUBLIC, the Loan Agreement with the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO and all its additional documentation regarding the model approved by Article 1 of this Decree.

Art. 3°- Please refer to the Minister of Economics and Public Works and Services or to the official or officials designated by him, to agree and subscribe on behalf of and representation of the ARGENTINA REPUBLIC, amendments to the Loan Convention, whose model is approved by Article 1 of this Decree, provided that they do not constitute substantial changes to the object and destination of the Loan, nor do they result in an increase in the amount or modification.

Art. 4°- Please refer to the Minister of Economics and Public Works and Services or to the official or officials designated by him, to agree and subscribe on behalf of the REPUBLIC ARGENTINA, the Convention on Subsidiary Loan with the PROVINCIA OF RIO NEGRO.

Art. 5°- Authorize the SECRETARIAT OF PUBLIC ARTWS of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, to designate as a coordinating unit for the execution of the loan, to the Coordinating Unit of the "PROGRAMME PROGRAMME IN THE PROVINCIAL PREVISIONAL REFORM", operating within the scope of the REGIONAL SUBSECRETARIAN.

Art. 6°- Authorize the SECRETARIAT OF PUBLIC ARTWS of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, to proceed to the opening of a Special Account in the CENTRAL BANCO of the ARGENTINA REPUBLIC under the conditions provided for in section 2.02 of the model of the Loan Convention, approved by Article 1 of this Decree. This Special Account may be used to transfer funds from other loans to other provinces that are implemented within the framework of the "Provisional Information System".
