Licensing companies of the Telephonic Basic Service and S.P.S.I. Please provide the Secretary of Communications with a view to resolving the extension or renegotiation of timely contracts.

VISTO Law No. 23.696 and Decree No. 62 of 5 January 1990 and 80 of 29 January 1997 and

CONSIDERING:

That through Decree No. 62/90 the Bases and Conditions for the Provision of Public Telecommunications Service was approved.

That point 13.5 of the above-mentioned fold authorizes the granting of a extension of the period of exclusivity enjoyed by the licensee companies and the S.P.S.I. for an additional term of THRE (3) years.

That the SECRETARIAT OF PRESIDENCE COMMUNICATIONS DE LA NATION bases the need to take measures that constitute a solution to the problems arising in relation to the execution of the current contract for the licence of the public telecommunications service by adjusting its terms to the current demands of the market.

That the present measure is in exercise of the powers conferred by article 99, paragraph 1 of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1Please refer to the Secretary of Communications of the NATIONAL PRESIDENCE for, with the prior assistance of the NATIONAL COMMUNICATIONS COMMISSION, to resolve, in accordance with the current regulations, the granting to the licensing companies of the TELEFONIC SERVICE and the S.P.S.I. of the extension of the period of exclusivity provided for in point 13.5 of the Bases and Conditions Approved by Decree No. 62/90 or, where appropriate, relinquish contracts in a timely manner, by signing and approving the respective instruments.

Art. 2o-Please refer to the SECRETARIAT OF NATIONAL COMMUNICATIONS, with the assistance of the NATIONAL COMMISSION ON COMMUNICATIONS, while the provisions of article 1 are resolved, to take the provisional measures relating to contracts with the licensing companies and the S.P.S.I., which are expressly agreed with them.

Art. 3o-The powers agreed upon in the preceding articles shall be exercised prior to the intervention of the BICAMERAL COMMISSION ON STATE REFORM AND FOLLOW-UP TO THE PRIVATIZATIONS OF THE HONORABLE CONGRESS OF NATION, in accordance with article 14 of Act No. 23,696 and the General SINDICATURA OF NATION.
