VISTO the provisions of article 75, paragraph 22 of the National Constitution, article 4 of the American Convention on Human Rights and article 10 and concordants of the Convention on the Rights of the Child, adopted by Act No. 23,849, and
CONSIDERING:
The National Civil Service has agencies, of different ranks, responsible for the protection of human rights in general and the child in particular.
However, the problem of the unborn child has a special singularity, marked by the possible consequences of progress in the fields of medical and biological sciences and their legal implications.
In spite of the fact that the National Legislation gives strong protection to the rights of the unborn person, particularly with regard to the right to life, the new realities mentioned above show the need to have in the area of the Presidency of the Nation permanent advice, which is in turn a vehicle for dialogue with the relevant scientific and social institutions, in order to give better compliance with the aforementioned mandate to ensure the rights of the person to be born.
That, above all, this commitment to the defence of the right to life and the essential rights derived from the human personality of the unborn person are part of the obligations of the Government of the Argentine Nation.
That the present decree is issued in exercise of the powers granted by article 99, paragraphs 1 and 7, of the National Constitution.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1-Please advise "Ad-Honorem" of the Presidency of the Nation, with the rank of Secretary, to Dr. D. Rodolfo BARRA (L.E. No. 7.608.913).
Art. 2°-It will be the role of the Adviser designated in the preceding article to provide advice to the NATIONAL EXECUTIVE PODER on all issues related to the protection of the rights of the unborn.
