SECRETARIAT OF AGRICULTURA, GANADERIA, PESCA and ALIMEMATION OF THE MINISTERY OF ECONOMY AND ARTS AND PUBLIC SERVICES, and the proposed model of the Loan Convention to be signed between the ARGENTINA REPUBLIC and the INTERNATIONAL BANCOTION

CONSIDERING:

That, through the aforementioned Convention on the Prohibition of the International BANCO of Reconstruction and Promotion (BIRF) it meets the REPUBLIC ARGENTINA with the financing of the PROVINCIAL AGRICULTURAL SERVICES PROGRAMME (PROSAP), which is carried out with the coordination of the SECRETARIAT OF AGREEMENT, GENEFITS, PESCA AND ATERLIATION

That through the loan agreement, the International BANCO of Reconstruction and Promotion (BIRF) commits itself to financially assist the ARGENTINA REPUBLIC in order to enable the implementation of the said Program, through the SECRETARIAT of AGRICULTURA. GANADERIA, PESCA and ALIMENTATION and the Provincial States.

That the overall objective of this Programme is to increase the value of exports of agricultural products by optimizing quality and increasing production volume.

That the resources of the loan will be applied for the improvement of water resources, basic infrastructure, technological development, animal health as a vegetable of the integrated agricultural information systems and the strengthening of the provincial capacity of programming, with the collaboration of the decentralized agencies of the SECRETARIA DE AGRICULTURA, GANADERIA, PESCA and ALIMENTATION of the MINISTERIO DE ECONOMIA AND ARTH LINKS.

That the general conditions, the periods of amortization, interest rates, commitment commissions and other clauses contained in the Loan Convention to be signed, are the usual ones agreed upon in this type of Convention and are appropriate to the purposes and objectives to which the loan is intended.

That the implementation of the PROVINCIAL AGRICULTURAL SERVICE PROGRAMME (PROSAP) and the use of the loan resources will be carried out by the SECRETARIAT OF AGRICULTURA, GANADERIA, PESCA and ALIMENTATION of the MINISTERY OF ECONOMY AND PUBLIC SERVICES, through the 1st CENTRAL EXECUTIVE MINISTERIAL UNITY

That the proposed agreement to be signed is covered by article 60 of the Financial Administration and National Public Sector Control Systems Act No. 24.156.

That the DELEGATION I of the General DIRECTION OF JURIDIC MATTERS of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES has taken the intervention that is within its competence

That in accordance with article 16 of Act No. 11.672, Supplementary Permanent Budget (T.O. 1.996) and article 99 (1) of the NATIONAL CONSTITUTION, the NATIONAL EXECUTIVE POWER is empowered to approve operations of this nature and subject any disputes to the decision of the Arbitral Tribunals.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1- Apply the model of the Loan Convention, for the PROVINCIAL AGRIC SERVICE PROGRAMME (PROSAP) which consists of SIETE (7) articles, VEINTICINCO (25) sections and SEIS (6) annexes, to subscribe between the ARGENTINA REPUBLIC and the INTERNATIONAL RECONSTRUCTION AND FOLLOWER (BIRF) The Text of the model of the Loan Convention in its English language versions and its translation into the Spanish language: as ANEXOS I and II, are an integral part of this decree, listed as Annex III, in its Spanish version. The General Conditions Applicable to Loan Agreements and Guarantee Agreements for Loans of a Sole Currency of the INTERNATIONAL RECONSTRUCTION AND FOMENT BANK (BIRF), dated 30 May 1,995, composed of DOCE (12) articles and CINCUENTA and SIETE (57) sections.

Art. 2°- Please refer to the Minister of Economics and Public Works and Services, and/or to the official or officials designated by him, to subscribe on behalf of and representation of the REPUBLIC ARGENTINA the loan agreement and all the documentation relating thereto, in accordance with the model approved by article 1 of the present decree.

Art. 3°- Please provide to the Minister of Economics and Public Works and Services, and/or to the staff member or officials designated by him, agree to and subscribe on behalf of the REPUBLIC ARGENTINA the amendments to the Loan Convention, provided that they do not constitute substantial changes to the object and destination of the funds or to the enforcement mechanisms, nor do they result in an increase in the amount of the Loan or modify the arbitral proceedings.

Art. 4°- The PROVINCIAL AGRIC SERVICES PROGRAMME (PROSAP) will be executed by the SECRETARIAT OF AGRICULTURA, GANADERIA, PESCA and ALIMENTATION OF THE MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES by means of the CENTRAL EXECUTORAL UNITY (EU) created by Resolution No. 356 of 7 December

Art. 5°- Authorize the SECRETARIAT OF AGRICULTURA, GANADERIA, PESCA and ALIMENTATION OF THE MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICS to celebrate in case and/or to delegate to the implementing agencies involved in the Programme, contracts for the location of work and/or services with third parties, without relation of dependence, consulting or technical, legal or administrative advice, with experts and/or research and extension entities, national or foreign, as well as to acquire the respective movable goods and/or equipment that are necessary for their implementation.
