Appropriate Loan Agreements to subscribe to the Nazionale Bank of the Lavoro SpA. for the implementation of the Project to Strengthen the Sanitary Network of the Province of Missions.

VISTO Issue No. 090-000416/97 of the Register of MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, which manages the approval of the Loan Conventions attached to the above-mentioned proceedings, and

CONSIDERING:

That the Health Network of Mission PROVINCIA requires urgent technological re-equipment both at the first level of Primary Health Care and at the second level formed by the Hospital Network, which needs adequate technology for such purposes.

On 30 June 1997, the Commercial Contract was signed between the Government of the Mission PROVINCIA and the ESAOTE SpA supplier for the implementation of the Sanitary Network Strengthening Project in that province for a total amount of DOLARES STADOUNIDENSES SEIS MILLONES QUINIENTOS MIL ($ 6,500.000).

That for the purpose of the partial financing of the said Contract has been managed and obtained from the NAZIONAL BANCA DEL LAVORO SpA in its capacity as an agent, a loan of up to DOLARES STADOUNIDENSES CINCO MILLONES QUINIENTS VEINTICINCO MIL (US$ 5,525,000), equivalent to the OCHENTA and CINCO FOR SCIENTO (85%)

That to finance the remaining QUINCE by SCIENTY (15%) has been managed and obtained from the NAZIONAL BANK OF THE LAVORO SpA in its capacity as a Prestamista, a supplementary credit for an amount of up to DOLARES STADOUNIDENSES NOVECIENTS SETENTA and CINCO MIL ($ 975.000).

That the LEGISLATURA OF PROVINCIA DE MISSIONS, it has sanctioned Provincial Law No. 3367 authorizing the PROVINCIAL EXECUTIVE POWER to take a credit, as well as empowering it to affect the Funds of the Federal Tax Shareholder (Act No. 23.548) or the Legal Regime to replace it in guarantee of the loans to be subscribed and until the cancellation of them.

That the general conditions, the amortization deadlines and other clauses contained in the Loan Conventions are considered to be appropriate to the purposes and objectives for which the financing to be obtained is intended.

That the General Directorate of Juridical Questions of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES has taken the intervention that belongs to it.

That the NATIONAL EXECUTIVE POWER is entitled to the dictation of this act by virtue of Article 16 of Law No. 11.672, Permanent Supplementary to the Budget (T.O. 1996), by Articles 60 and 61 of Law No. 24.156 and by Article 99, paragraph 1 of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1Approved in all its parts the Loan Convention to subscribe between the ARGENTINA REPUBLIC and the NAZIONAL BANCA of the Lavoro SpA, for an amount of up to DOLARES STADOUNIDENSES CINCO MILLONES QUINIENTS VEINTICINCO MIL ($ 5.525,000). The texts of this Loan Agreement in a copy authenticated in its English language version and its legalized translation in Spanish form part of this Decree as Annexes I and II.

Art. 2o - Approved in all its parts the text of the Loan Convention to be signed between the ARGENTINA REPUBLIC and the NAZIONAL BANK OF THE LAVORO SpA, in the amount of DOLARES STADOLJNIDENSES NOVECIENTS SETENTA and CINCO MIL ($ 975,000). The texts of this Loan Agreement in a copy authenticated in the English language version and its legal translation in Spanish form part of this Decree as Annexes III and IV.

Art. 3o- Please refer to the Minister of Economics and Public Works and Services, or to the official or officials designated by the latter to subscribe on behalf of and representation of the REPUBLIC ARGENTINA the Loan Conventions that are approved by Articles 1 and 2 of this Decree, as well as any other documentation required, contemplated in or related to them.

Art. 4o-Please refer to the Minister of Economics and Public Works and Services, or to the official or officials designated by him to sign in the name and representation of the ARGENTINA REPUBLIC, modifications to the Loan Conventions approved by Articles 1 and 2 of this Decree, provided that they do not constitute substantial changes to the object and destination of the same, or do not result in an increase in their amount.

Art. 5o-The Government of the PROVINCIA OF MISSIONS shall adopt the relevant precautions in order to incorporate into the respective budgets the necessary provisions to address the emerging erogations of the Loan Conventions in this Decree.
