Convalidate, the Convention and the Provisory and Complementary Transfer Acts, signed between Water and Electrical Energy State Society (in liquidation) and the Province of Catamarca, by which the La Carrera Hydroelectric Power Center is transferred without charge.

CONSIDERING:

The process of transforming the National Electrical Sector into harmonic management is in full development with the transformation objectives of the NATIONAL STATE driven by the sanctions of Laws No. 23.696 and No. 24.065.

That this also coincides with the objective set out in Act No. 18.586 as it is the will of the NATIONAL GOVERNMENT, through its various administrations, to transfer the existing national agencies and functions in the provincial territories without charge to the NATIONAL States.

That WATER AND ELECTRIC ENERGY SOCIEDAD STATE has been declared "in liquidation" by Resolution of the MINISTERY OF ECONOMY AND PUBLIC SERVICES No. 394 of 13 March 1,996, various business units have been privatized and functional units transferred to the different provinces, according to the legal provisions.

That in that framework ELECTRIC WATER AND ENERGY STATE SOCIEDAD, today in liquidation, and CATAMARCA PROVINCIA with date 7 October 1,992 signed a Convention by which the first assumed the commitment to transfer without charge to the second the Central Hydroelectric LA CARRERA, including equipment, properties, installations, the personnel affected and one (1) Grupo Electrógeno Transportable.

The transfer of the goods and personnel affected by the Provisory Transfer Act of 30 October 1,992 was completed, and the possession of the goods and personnel from that date was granted to the CATAMARCA PROVINCIA, who fully assumed responsibility for the delivery of the Service with the costs involved.

That on 26 October 1,994 the parties signed a supplementary act of the aforementioned Convention, which definitively yielded the materials used in the construction of the Line in TREINTA SCIENTY and DOS KLOVOLTIOS (132 kV) SAN MARTIN - CATAMARCA and transferred the rights and actions on the properties that formed the Camp of the Inspection of Works of the Integral Exploitation POTRERO del CLAVILLO located in the Aconquija district, Department Andalgalá, Padrón 1477, National Route No. 65 and road left of the river CHACRAS, Sector called "LAS ESTANCIAS", to CINCO KILOMETROLA

That also and by the aforementioned Supplementary Act WATER AND ELECTRIC ENERGY SOCIEDAD OF THE STATE, today in liquidation, yields to the PROVINCIA OF CATAMARCA, the estates belonging to the Camp LAS PIRQUITAS that were not included in the Transfer made by Scripture No. 4 of April 14, 1,975 and the Law No. 17,708, properties that were not able to identify with precision.

BETWEEN THE SECRETARY-GENERAL OF THE SECRETARY-GENERAL

That the PROVINCIA OF CATAMARCA in total and absolute knowledge of the dominial situation of the properties, assumes at its exclusive charge and cost the processes that are necessary for the regulation of the property of the lands in which the same are located.

Having made such a "ad referendum" transfer of the NATIONAL EXECUTIVE PODER, it is necessary to dictate the respective validating act.

That the transfer of assets and personnel detailed in the above-mentioned Convention and Supplementary Act shall be enhanced by Acts pursuant to article 2 of Act No. 18.586 and its Rule Decree No. 258 of 31 January 1,980.

That therefore the object of this act is to endorse the will of transfer in the terms of the regulations invoked.

That the General Directorate of Humanitarian Affairs of the MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICOS has taken the intervention that belongs to him.

That the present act is given in the exercise of the powers conferred by Laws No. 18.586 and No. 23.696 and Article 99(1) of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1- SECOND PROCEDURES, IN THE SYSTEM, SAN MARTIN - CATAMARCA; the rights and actions on the properties that formed the Camp of the Inspection of Works of the INTEGRAL POTRERO OF THE CLAVILLO, located in the Aconquija district, Department Andalgalá, Padrón 1477, National Route No. 65 and road left margin of the river CHACRAS, Sector called "LAS ESTANCIAS", to CINCO KMEILO All the goods are located in the territory of the CATAMARCA PROVINCIA, with the exclusive charge and cost of the procedures necessary for the regularization of the property of the land in which they are located, whose dominial situation is of its total and absolute knowledge. The Convention, the Provisory Transfer Act and the Supplementary Act are accompanied in authenticated copies and are part of this decree as Annex IA.

Art. 2°- The transfer of assets and personnel endorsed by this decree shall be effected by Acts, in accordance with article 2 of Act No. 18.586 and its Rule Decree No. 258 of 31 January 1,980.

Art. 3°- This decree shall apply from the date of its dictation.
