VISTO the provisions of Acts 19,170 and 20.094, which was reported by Mr. Prefecto Nacional Naval, as proposed by the Minister of Defence, and
CONSIDERING:
In the course of time it is observed that a significant number of ships and/or non-existent naval devices have not been removed from the National Tuition, resulting in a discord between the extra-registrational and logistic reality.
That, as a result, ships and/or naval devices are registered as such, either by absolute and manifest innavigability or by their destruction, the circumstances of which have never been informed of NAVAL ARGENTINA PREFECTTURE, and are presumed to be framed in article 55 (a) and (b) of Law 20.094.
That the actual folios corresponding to these ships and/or naval devices occupy unnecessary space and make it difficult to quickly and efficiently search for data and levies affect the effectiveness and rationalization of registration tasks.
That in the furniture records there is a factual reason to proceed to periodic depurations, since contrary to what happens in the property records, the thing registered, in principle, tends to disappear, for having a limited service life, for the case of ships and naval devices estimated between CUARENTA (40) and CINCUENTA (50) years; which will allow to update the Elenco de la Matrculo Nacional.
That in order to achieve these purposes a periodic re-relevation of the Elenco de la Matrculo Nacional, both of the National Merchant Matrix and of the Special Register of Yachts is imposed through the conduct of censuses by the NAVAL ARGENTINA PREFECTURA, which will allow the re-registration of those who have the possession of the ship or naval artifact, without causing any regularization.
That the present measure is in use of the powers conferred by article 99, paragraph 2 of the National Constitution.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 -- Please refer to the NAVAL ARGENTINA PREFECTURA to arrange for the re-registration of the ships and naval devices of the National Tuition each CINCUENTA (50) years and to determine the modalities to be submitted, on the basis of the freeness and without imposing regularization of any kind. Art. 2o -- The NAVAL ARGENTINA PREFECTURA shall proceed to remove from the National Tuition ships and/or naval devices whose owners or possessors have failed to comply with the obligations set forth in Article 1 of this Decree, when DOS (2) years have elapsed from the beginning of the census obligation, on the basis of the provisions of Article 55 (a) and (b) of Law 20.094, provided that no other precautions have been affected.
