VISTO Issue No. 020-000170/96 of the Register of the MINISTERY of ECONOMY AND PUBLIC SERVICES, and
CONSIDERING:
That the Law of MENDOZA PROVINCIA No. 6372, and Provincial Decrees No. 109/96 and No. 267/96 approve the TRANSFER CONVENTION of the Social PREVISION SYSTEM to the NATIONAL STATE and authorize the PRAOVINCIAL EXECUTIVE POWER to enter into supplementary agreements.
That by the Federal Covenant on Employment, Production and Growth held between the NATIONAL STATE and the provincial States dated 12 August 1993, at its point 6 of the Second Chapter of the Declaration. The NATIONAL STATE agrees to accept the transfer of the Provincial Retirement Funds to the INTEGRATED SYSTEM of JUBILATIONS and PENSIONS.
That Section 4(a) of Article 2 of the National Law No. 24,241 provides that the physical persons who are older than DIECIOCHO (18) years of age, officials, employees and civil agents dependent on the provincial governments and municipalities shall be complied with in the INTEGRAD SYSTEM, provided that the respective authorities shall accede to it, by means of an agreement with the respective authorities.
The ratification of the TRANSFER CONVENTION of the SOCIAL PREVISION SYSTEM of the MENDOZA PROVINCIA, with the exception of clause 20a.
It is appropriate to adopt as Annex II the new text of clause 20a, which will require its ratification by the MENDOZA PROVINCIA.
to be provided with the corresponding budget line, the HACIENDA SECRETARIAT of the MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICOS will provide for the provision to address the operational deficit of the PREVISION SYSTEM of the MENDOZA PROVINCIA that is incorporated into the INTEGRAD SYSTEM of JUBILATIONS and PENSIONS.
That it is necessary to set start dates to ensure the effective transfer of funds for the payment of passivities and to provide security for the adequate provisional coverage of staff in activity to provincial and municipal jurisdictions.
That this Decree is issued in the use of the powers conferred on the NATIONAL EXECUTIVE POWER by Article 99 of the NATIONAL CONSTITUTION.

THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 de Streamline the CONVENTION ON TRANSFERENCE OF THE SYSTEM OF SOCIAL PREVISION OF THE PROVISION OF MENDOZA to the NATIONAL STATE held between the GOVERNMENT OF THE PROVINCIA OF MENDOZA and the NATIONAL GOVERNMENT through the MINISTERIAS OF THE INTERIOR OF ECONOMY AND PUBLIC WORKS AND SECURITY SOCIAL, dated 26 January 1996, which in an authenticated copy and as an Annex I form an integral part of this Decree, with the exception of clause 20a.
Art. 2o . Approve the text of clause 20a in Annex II to this Decree.
Art. 3o . Invite the MENDOZA PROVINCIA to ratify clause 20a in its new text.
Art. 4o el Note the FIRST DAY of JANUARY 1996 as the date from which:
(a) The projected assets of the NATIONAL ADMINISTRATION OF SOCIAL SECURITY shall begin to accrue;
(b) shall begin to govern the obligation to retain and transfer to the NATION personal contributions and employers ' contributions by the GOVERNMENT OF MENDOZA PROVINCIA.
Art. 5o al Authorize Lord MINISTER WORK AND SECURITY SOCIAL to subscribe to the supplementary records provided for in CLAUSULA VIGESIMA QUINTA of the TRANSFER CONVENTION, which is now ratified.
Art. 6th . The SECRETARY for Social Security of the MINISTERY OF WORK AND SOCIAL SECURITY and the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES are empowered to dictate, each within its jurisdiction, the clarification and Interpretative norms of this Decree.
