CONVENTION Decree 721/96 Ratify the Agreement on Transfer of the Social Security System of the Province of Río Negro to the National State. Bs. As., 3/7/96
VISTO Issue No. 001-00072713-047 of the Register of the SECRETARIAT for SOCIAL SECURITY of the MINISTERY OF WORK and SOCIAL SECURITY; and
CONSIDERING:
That the Law of the Province of Negro RIO No. 2988 of 5 June 1996 ratifies the TRANSFER CONVENTION of the Social PREVISION SYSTEM to the NATIONAL STATE.
That by the Federal Covenant on Employment, Production and Growth held in the NATIONAL STATE and the provincial states dated 12 August 1993, at its point 6 of the Second Chapter of the Declaration, the NATIONAL STATE agrees to accept the transfer of the Provincial Retirement Funds to the INTEGRATED SYSTEM of JUBILATIONS and PENSIONS.
That Section 2 (a) of the National Law No. 24,241 provides that the physical persons over DIECIOCHO (18) years of age, officials, employees and civil agents dependent on the provincial governments and municipalities shall be complied with in the INTEGRATED SYSTEM of JUBILATIONS and PENSIONS, provided that the respective authorities have previously entered into the agreement by the respective authorities.
The ratification of the TRANSFER CONVENTION of the SOCIAL PREVISION SYSTEM of the BLACK RIO PROVISION should be made.
to be provided with the corresponding budget line, the HACIENDA SECRETARIAT of the MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICOS will provide for the provision to address the operational deficit of the PREVISION SYSTEM of the NEGRO RIO PROVINCIA that is incorporated into the INTEGRATED SYSTEM of JUBILATIONS and PENSIONS.
That it is necessary to set start dates to ensure the effective transfer of funds for the payment of passivities and provide assurances for the proper provisional coverage of staff in activity to provincial and municipal jurisdictions.
That this Decree is issued in the use of the powers conferred on the NATIONAL EXECUTIVE POWER by article 99 of the NATIONAL CONSTITUTION.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 — Ratifícas el CONVENIO de TRANSFERENCIA del SISTEMA de PREVISION SOCIAL de la PROVINCIA de RIO NEGRO al estaADO NACIONAL celebra entre el goBIERNO DE LA PROVINCIA de RIO NEGRO y el GBIERNO NACIONAL a través de los MINISTERIOS del INTERIOR, DE ECONOMIA YRAS y SERVICES PUBLIC SOCIAL, dated 31 May 1996 as an integral part of this Decree as an Annex.
Art. 2o — See the SECOND DAY of the month of MAY 1966 as the date from which:
(a) The projected assets of the NATIONAL ADMINITRATION OF SOCIAL SECURITY will begin to accrue. To this end, PROVINCIA RIO NEGRO must deliver the Annex that corresponds to the current beneficiary pattern.
(b) shall begin to govern the obligation to retain and transfer to the NATION personal contributions and employers ' contributions by the GOVERNMENT OF THE PROVINCIA OF RIO NEGRO.
Art. 3o — Authorize Mr. MINISTER OF WORK AND SECURITY SOCIAL to subscribe to the supplementary records provided for in CLAUSULA VIGESIMA QUINTA of the TRANSFER CONVENTION, which is now ratified.
Art. 4o — The SECRETARY for Social Security of the MINISTERY OF WORK AND SOCIAL SECURITY and the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES are empowered to dictate, each within its jurisdiction, the clarification and interpretative norms of this decree.
