Decree 847/96

Please outline the scope of application of the system of family allowances instituted by Decree 770/96 and the time of implementation of the new provisions.

VISTO Decrees No. 770, which institutes the system of family assignments, and No. 771, the regulations of the former, both of 15 July 1996, and

CONSIDERING:

The issue of rules aimed at specifying the scope of application of the family allocation regime, as well as at establishing the time from which the new provisions should be implemented.

Moreover, and until such time as it enters into force, the direct payment system provided for in Decree No. 770/96 must regulate aspects relating to the determination of the form of payment of the allocations and the transitory continuity of the compensation mechanism, in order to introduce the necessary modifications to the operating systems.

That the employer ' s contribution that Article 9 of Decree No. 770/96 provides for the family allowance regime is subject to the reduction scales provided for in Decree No. 2609 dated 22 December 1993, 372 dated 20 March 1995, 292 dated 14 August 1995 and 492 dated 22 September 1995, all of which remain in full force in the percentages and details specified for each case.

That under article 99, paragraph 2, of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT

OF ARGENTINA NATION

RIGHT:

Article 1-The system of family allowances, established by Decree No. 770/96, shall be applied. Also, the beneficiaries of unemployment insurance regulated by Act No. 24.013 and the beneficiaries of Act No. 24.557.

Domestic workers, home workers, teachers under article 2 (a) and (b) of Act No. 13,047 (Statute of the Teaching Staff of Private Education Establishments) and teaching staff of private universities are excluded from the scope of the Decree.

Art. 2°-Pursuant to Decree No. 771/96, family allowances are paid:

(a) Monthly payments shall be received from September of this year on the accrued in the previous month.

(b) Single payment. when setting up the assumption that generates the obligation to pay from 1 August this year.

Art. 3°-The monthly or one-time payment allowances to which workers are entitled prior to the date mentioned in the preceding article shall be governed by the previous legal regime in the area of application, concepts, requirements, amounts and mode of perception.

Art. 4° - Until the procedure referred to in Article 9 of Decree No. 770/96 is implemented, the payment of family allowances shall be subject to the following:

(a) In the case of workers within the Compensatory Fund System, the allocations shall be paid by the employer and compensated by the employer for the contribution to be made.

(b) In the case of workers dependent on companies covered by the current direct payment system, assignments will continue to be paid through the NATIONAL ADMINISTRATION OF SOCIAL SECURITY (ANSeS).

Art. 5° - The employer ' s contribution that article 5 of Decree No. 770/96 provides for the family allowance regime is subject to the scales of reductions provided for in Decree No. 2609/93 and its amendments Decrees No. 372/95, 292/95 and 492/95, which maintain their full validity in the percentages and liquors specified for each case.
