VISTO the Issue No. 060-000660/96 of the Register of the MINISTERY of ECONOMY AND PUBLIC SERVICES and the model of the Convention on the Granting of the Funds of the Montreal Protocol, proposed to be subscribed between the ARGENTINA REPUBLIC and the INTERNATIONAL RECONSTRUCTION BANCOLINE

CONSIDERING:

That the funds of this donation, administered by the INTERNATIONAL BANCO OF RECONSTRUCTION AND FOMENT, come from the Multilateral Fund of the Montreal Protocol, established under the Montreal Protocol, which was ratified by the ARGENTINA REPUBLIC, through Law No. 23.778.

That the Convention should be signed between the ARGENTINA REPUBLIC and the INTERNATIONAL RECONSTRUCTION BANCO And FOMENT, acting as the depositary of the resources donated by the parties to the Montreal Protocol for ozone layer defence projects.

That the donated funds will be allocated to meet the commitments made by the Government of the ARGENTINA REPUBLIC upon signing the Montreal Protocol and achieving the objectives of the Country Programme adopted on 27 July 1994 by its Executive Committee.

That donation funds will allow industrial reconversion for the replacement and/or progressive elimination of consumption of ozone-depleting substances.

That the fate of the funds mentioned above, makes the conversion cited, represents a highly beneficial impact on the national State in its action related to the environment and in accordance with public interests.

That for the above it is necessary to subscribe to the International BANCO of RECONSTRUCTION AND FOMENT, an agreement for the acceptance of resources from the Multilateral Fund of the Montreal Protocol.

That the general conditions and the remaining conditions established by the INTERNATIONAL BANCO OF RECONSTRUCTION AND FOMENT, as the depositary of the Multilateral Fund of the Montreal Protocol, are the usual for such agreements and are appropriate to achieve the purposes and objectives to which the donation funds are allocated.

That the formalization of the operation requires that the ARGENTINA REPUBLIC, represented by the MINISTERY OF ECONOMY AND ARTWS AND SERVICES PUBLICS, it subscribes to the proposed and attentive agreement that the donation funds will be destined to the reversion of an industrial sector, the SECRETARIAT OF INDUSTRIA, TRADE and MINERIA dependent on the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, will be responsible for the administration and application of them.

That the NATIONAL EXECUTIVE POWER is empowered to approve such operations, in accordance with article 16 of Act No. 11.672, Supplementary Permanent Budget (T.O. 1996) and Article 99, paragraph 1, of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 el Approve the model of the Montreal Protocol Grants Convention for the Substances Reduction Project that Exhaust the Ozone Layer, to subscribe between the ARGENTINA REPUBLIC and the INTERNATIONAL RECONSTRUCTION BANCO And FOMENT, whose authenticated copy forms an integral part of this decree as Annex I, for a amount in different currencies, equivalent to DOLARES STADOUNIDENS VEINTICINCO MILLONES (U$ 25,000.000). The translation into the Spanish language of the text of the model of the Donation Convention, as Annex II and the General Conditions Applicable to the Conventions of Loan and Guarantee of the International Bank for Reconstruction and Promotion, as Annex III, form an integral part of this decree.

Art. 2° . Please refer to the Minister of Economics and Works and Public Servants or to the official or officials designated by him, to subscribe on behalf of and representation of the ARGENTINA REPUBLIC, the Donation Convent and all the documentation relating thereto, in accordance with the model approved by Article 1 of this Decree.

Art. 3rd . Please enable the Minister of Economics and Public Works and Services to agree and subscribe to the Donation Convention, provided that they do not constitute substantial changes to the destination of the Donation or modify the agreed Arbitration Procedure.

Art. 4° . Commend the SECRETARIAN OF INDUSTRIA, TRADE AND MINERIA of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES the execution of all actions leading to achieving the objectives and purposes, in accordance with the model of the Convention adopted by Article 1 of the present decree.
