VISTO Issue No. 760.001/95 of the Register of the Former ENERGY SECRETARIAT of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, and

CONSIDERING:

As part of the State Reform policy adopted and under way by the NATIONAL GOVERNMENT, a significant aspect is the process of transferring to provincial jurisdiction the activities of Irrigation, Disappearance and Drainage, making it essential for its implementation to accelerate the implementation of the measures to adapt its structure and functioning both for the conjuncture and for the long term.

That in order to achieve this objective it is necessary to ratify the transfer to the PROVINCIA OF THE CHUBUT of the service of irrigation, drainage and drainage that provided WATER and ELECTRIIC ENERGY SOCIEDAD OF THE STATE, today in liquidation, in the territory of the said Province, in the terms of the Transfer Act subscribes on 19 October 1994, by which the building works are transferred

That this will add an element for the implementation of the objectives set for the National Electrical Sector Restructuring process, which will streamline and optimize the delivery of the services involved.

That according to the terms of the aforementioned Transfer Act and the Reception Act of 1 November 1994, the CHUBUT PROVINCIA has fully assumed the distribution and marketing of the Irrigation, Disappearance and Drainage Services in its territory, ceasing WATER and ENERGY SOCIEDAD OF THE STATE, today in liquidation, in the provision of such service.

That the transfer of assets detailed in the Transfer Act shall be enhanced by means of records, pursuant to article 2 of Law No. 18.586 and its Rule Decree No. 258 of 31 January 1980.

That the holding of this Transfer and Reception Act is the result of compliance with Article 5 (c) of the Convention between the NATIONAL STATE and the CHUBUT PROVINCIA on the Reorganization and Privatization of the Patagonian Electrical Sector of 15 April 1993, which was approved by Provincial Law No. 3843.

That having made such a "ad referendum" transfer of the NATIONAL EXECUTIVE PODER, it is necessary to dictate the respective act of approval.

The Permanent Legal Service of the area has taken action.

That the present act is given in the exercise of the powers conferred by Laws No. 18.586 and No. 23.696 and Article 99(1) of the NATIONAL CONSTITUTION.

Therefore,

Art. 2o . The transfer that is supported by this Decree shall be effected through Acts, in accordance with article 2 of Law No. 18.586 and its Rule Decree No. 258 of 31 January 1980.
