SECRETARY OF AGRICULTURA, PESCA and ALIMENTATION OF THE MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES. Act No. 24,629, Decree No. 2284 of 31 October 1991, Decree No. 2488 of 26 November 1991 and

CONSIDERING:

It is an inescapable and priority role of the National State to ensure that there are no distortions or restrictions that may affect free competition in markets.

That the remediation of trade conducts directly results in the transparency of the markets and in the quality and veracity of the signals they emit for the operators in general, whether these producers, traders or industrialists.

Article 3 of Decree No. 2488/91 transferred to the ex-SECRETARIAT of AGRICULTURA, GANADERIA and PESCA, the current SECRETARIAT of AGRICULTURA, PESCA and ALIMENTATION of the MINISTERY of ECONOMY and ARTWS and PUBLIC SERVICES, "...the functions of internal and external trade policy

That Act No. 24,629, in Chapter 11, establishes the rules for the administrative reorganization of NATIONAL PUBLIC ADMINISTRATION in order to improve its functioning and the quality of services provided by different jurisdictions.

It is appropriate to unify all those functions that do to control the activities of the commercial agents of the agricultural sector in an organism deconcentrated in the jurisdiction of the SECRETARIAT OF AGRICULTURA, PESCA and ALIMENTATION of the MINISTERIO DE ECONOMIA and ARTWS AND PUBLIC SERVICES.

It is therefore essential to adopt the organizational structure of the above-mentioned body, for the purpose of the immediate implementation of its activities, given the importance of which it is entrusted.

That the measure that is propitiated does not imply a budget erogation greater than the one in force for that purpose in Jurisdiction 50.00 - MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES.

That UNITY OF REFORM AND MODERNIZATION THE STATE has taken the intervention that belongs to it, expiating favorably.

That the present measure is determined by the emerging powers of Article 99. NATIONAL CONSTITUTION and Law No. 24,629.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1-Believe as a deconcentrated agency of the SECRETARIAT OF AGRICULTURA, PESCA and ALIMENTATION of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, the NATIONAL OF AGRIC TRADE CONTROL.

Art. 2°- The NATIONAL OFFICE OF AGROPECUARY TRADE CONTROL will be the body responsible for monitoring strict compliance with marketing regulations in the agricultural sector, in order to ensure a framework of transparency and free participation for these activities, as provided for in Act No. 21.740 and Decree No. 6698 of 9 August 1963, its amendments and regulations.

Art. 3° - The conduct of the NATIONAL OF TRADE CONTROL AGROPECUARIO will be exercised by an Executive Director with extra-curricular level and rank of Ministerial Assistant Secretary, with a remuneration equivalent to the level established by the Nros Resolutions. 1102 of 17 September 1992 and 1117 of 29 September 1992, both of which were registered with the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, their modifications and complementary. for the position of the highest authority of the INSTITUTO ARGENTINO DE SANIDAD y CALIDAD VEGETAL.

Art. 4°- The Executive Director quoted in the preceding article shall be appointed by the Secretary of Agriculture, Fisheries and Food and shall cease to function at the end of the mandate of that authority or its requirement.

Art. 5°- Approve the organizational structure of the NATIONAL OF TRADE CONTROL AGROPECUARIO, created by article 1 of this measure, in accordance with the organigram, primary responsibility and actions and endowment, which, as Annexes I, II and III form an integral part of this Decree.

Art. 6°- Refer to the SECRETARIAT of AGRICULTURA, PESCA and ALIMENTATION of the MINISTERY OF ECONOMY AND PUBLIC SERVICES, the agents of the NATIONAL SERVICE OF ANIMAL SANITY that are detailed in a table annexed to this article that is an integral part of the present decree, those to be carried out in the NATIONAL EXECUTIVE EXECUTIVE

Art. 7°- The cost of applying this measure until 31 December of the current year will be met with the credits in force in Jurisdiction 50.00 MINISTERY OF ECONOMY AND ARTS AND PUBLIC SERVICES. As of 1 January 1997, the charges and their respective funding should be incorporated in the 50.00 Jurisdiction - MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, Programme 36 - Formulation of Primary Sector Policies.

SECRETARIAT OF AGRICULTURA, PESCA AND ALIMENTATION

NATIONAL OF TRADE CONTROL

PRIMARY RESPONSIBILITY:

Fiscalize strict compliance with the marketing regulations in the agricultural sector, in order to ensure a framework of transparency and free participation for these activities, as provided for by Law No. 21.740 and Decree-Law No. 6698/63, its regulations and regulations: coordinating its action with the various agencies with competence in the field.

ACTIONS:

To carry out all actions aimed at observing and enforcing the rules and procedures of control, emanating from Law No. 21.740 and Decree-Law No. 6698/63, its supplements and modifications, throughout the national territory.

Fiscalize the different operators of the natural or legal persons involved in the marketing of the agricultural sector.

Participate in the signing of cooperation agreements with national or provincial agencies, aimed at achieving compliance with tax and tax obligations in the sectors of their area of competence.

Providing technical and/or administrative inspections, operations and audits to verify and monitor compliance with existing regulations, coordinating their actions with other relevant agencies, where necessary.

Implement the necessary requirements to assess the degree of compliance with marketing standards, interim obligations and prosecutors.

Develop and propose regulations on the marketing of livestock and meats in order to achieve a uniform system at the national level on identification.

Propose the application of sanctions corresponding to actions or omissions that amount to unfair practices or conduct in relation to the trade in livestock, meat, products, by-products and derivatives, as well as grains and their by-products, in accordance with Chapter IX of Law No. 21.740 and Chapter XI of Decree - Law No. 6698/63, as appropriate.

Follow-up to registrations, which are competent in the area.

Propose the necessary measures to achieve an agile and modern supply of the domestic and external market.

Organize and coordinate the administrative and commercial control tasks of international and federal livestock, meat, products, by-products, derivatives and reproductive material of animal origin, as well as for grains and their by-products.
