VISTO the bill registered under No. 24.732, sanctioned by the HONORABLE CONGRESS OF NATION dated 13 November 1996 and

CONSIDERING:

That the HONORABLE CONGRESS OF NATION has sanctioned the non-applicability of workers covered by article I °, subparagraph (e), article 2°, subparagraph (b), of Decree 4257/68, of the provisions set out in the second paragraph of article 157 of Act No. 24.241, re-establishing, for the granting of the forecast benefits, the ages provided for in that decree.

That alluded workers are those who usually perform in open-pit mining tasks, performing work of obtaining direct mining products. and those who usually perform tasks in underground mines, each with a specific differential regime.

That until a new differential provisional regime is established for those activities which, by involving risks to the worker or premature exhaustion of his or her ability to work, or by setting up special situations, deserve to be the subject of a particular legislative treatment, the existing regimes prior to Act No. 24,241 remain in force, in accordance with the last paragraph of article 157 of the same, while the provisions of the second paragraph will be applicable to the new age.

That, therefore, the provisions of the draft law in analysis become inoperable as long as the differentiation regimes referred to therein remain in force, and it should be observed in a total way.

That this measure is given in the use of the powers conferred by article 83 of the NATIONAL CONSTITUTION.
