Please outline the regulations that determine the conditions under which specialized personnel will be authorized.

VISTO the provisions of Article 15 of the General Budget and Resource Calculation Act of the National Administration No. 24,447 for the year 1995, and

CONSIDERING:

It is deemed necessary to establish a regulation that determines the conditions under which the National Civil Service will be authorized for the recruitment of specialized personnel and to promote the development of special work programmes that assist in its most effective development.

That while most of the professional, technical and administrative activities of the National Civil Service are attended by permanent and non-permanent staff, including organizationally and budgetaryly, within existing structures and within the regimes governing the administrative career of the State, the growing complexity of the dynamics of the state activity has generated increasing and varied requirements, demanding correlatively, establishing various forms of procurement in order to the characteristics of the State activity.

That this has in practice determined the need to strengthen and complement the work of the National Civil Service through the transient incorporation of professionals and technicians attached to special work programmes, which are currently being developed in different jurisdictions under various forms and modalities of recruitment.

In the face of such a situation, it is considered essential to issue regulations that set the general conditions for the recruitment of such personnel, determining a uniform expenditure policy and establishing a general control over the exemptions in this regard, in accordance with the objectives of control and containment of public expenditure.

Without prejudice to the establishment of these orderly rules of the staff recruitment regime, the effort is made to provide the necessary flexibility to ensure that it is an efficient tool that allows timely response to the various requirements and activities currently to be addressed by the Administration.

On the other hand, it is appropriate to empower the MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICS to regulate and interpret the rules contained in this decree.

That the NATIONAL EXECUTIVE POWER is entitled to the dictation of this decree under the emerging powers of Article 99 (1) and (2), 100 (1), and the Transitional Provision DUODECIMA of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT

RIGHT:

Article 1Please provide the Ministers of the NATIONAL EXECUTIVE POWER and the Secretaries of the NATIONAL PRESIDENCE and Chief of the Military House to hire the necessary personnel to carry out those activities that complement the competences of each jurisdiction. The Ministers may delegate to the Ministerial Secretaries the authority agreed to in this article.

Art. 2o-The political-level official who exercises the utmost responsibility for the technical-administrative services of each Ministry or of the General SECRETARIAT OF THE NATIONAL PRESIDENCE shall be responsible for the administration and control of the present contracting regime, centralizing its process and supervising the operational and instrumentation aspects. This authority may be assigned by Ministerial Resolution to a staff member at the level not less than the Assistant Secretary.

Art. 3o-Recruitments to be made shall be aimed at the provision of specialized technical or professional services and/or the execution of works, either individually or covered by programmes of work, both institutional strengthening and special projects of studies and research, which have been evaluated and approved by the highest authority of the jurisdiction.

Art. 4o.-Where recruitment of staff is carried out under special programmes of work or projects, a detailed report of the staff member who may delegate such a function to the respective Assistant Secretaries shall be required. The report should include:

(a) The reasons for their realization.

(b) The partial and final objectives sought.

(c) A schedule of the programme of work and estimated time frames for implementation.

(d) The quantity and profile of people required.

(e) A payroll that fully or partly includes the required persons, adding personal data and professional and professional backgrounds, with the conformity and signature of each applicant, which will be an affidavit.

(f) The total gesture demanded by the program.

(g) The financing provided.

Art. 5o- The basis for the proposed recruitment and retribution, in each case, will also be reported, providing for the location of professional or technical recruits at the different levels and positions, in accordance with the profiles set out in Annex I to this Decree.

Art. 6o-The number of persons recruited as technical assistants may not exceed the VEINTE BY CIENTO (20 %) of the total included in special work programmes or projects corresponding to the same Secretariat.

Art. 7o-The programme or project staff member shall be responsible for its implementation and the implementation of the objectives within the prescribed time frames, adopting progress reports and requiring the completion of the final report to the maximum authority of the jurisdiction, noting the results achieved, the degree of implementation of the proposed targets and undertaking an assessment of the work performed by the contracted persons. In the case of decentralized agencies or entities, it will be the responsibility of the incumbent to meet the objectives and deadlines.

Art. 8o-In the case of individual recruitment of specialized professionals or experts, the fees set may not exceed the corresponding maximum level provided for in Annex I.

Art. 9o- In all cases, the contracts shall:

(a) The object of recruitment.

(b) The agreed fees and their form of payment.

(c) The modality and place of service delivery.

(d) The duration of the contract.

(e) A renewal and termination clause for the National Civil Service.

Art. 10.-The relationship of the parties shall be governed exclusively by the contracts to be concluded. Typically, contracts will respond to the Contract Models for Location of Services Annex II and Work Location Contract Annex III to this Decree, in each case, appropriate special clauses are incorporated into the proposed procurement.

Art. 11.-In the process of contracting under this regime, staff referred to in Article 1 of this Decree shall verify the existence of the relevant budgetary provisions.

Art. 12.-The area in charge of the administration of personnel of the jurisdiction will receive and archive the documentation that records and contracts of all the professionals and/or technicians hired.

Art. 13.-Those applicants who do not meet the requirements and conditions set forth in the respective Type Contracts and/or those established pursuant to Article 16 of this Decree may not be recruited.

Art. 14.-MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICOS shall establish a system of reimbursement of expenses and compensations that covers the erogations made by the contracted consultants who, in accordance with their contractual obligations, must be transferred to a distance greater than CIEN (100) KILOMETROS from the place where they are usually performed.

Art. 15.-In cases where consultants are hired to perform in a place other than their habitual residence, and this place is located at a distance greater than CIEN (100) KILOMETROS, they may be compensated by a weekly (round-trip) air or land passage, between the place of their permanent residence and that of their performance.

Art. 16.-MINISTER OF ECONOMY AND ARTWORKS AND SERVICES PUBLICOS is empowered to dictate the instrumental and interpretation rules necessary for the implementation of this decree.

Art. 17.-This Decree shall take effect from 1 January 1995.

7. Coordinate training programmes for team members and related materials, depending on the projects allocated.

8. Make the definition of methodological approach, global and conceptual design of systems and/or projects.

9. Perform the tests for the projects or tasks assigned.

10. Develop work schedules and identify assignments to experts and consultants.

11. Conduct courses and seminars in the areas of their competence.

III-SPECIFIC REQUIREMENTS FOR POST

3. Experience in the coordination of projects or subprojects of high complexity.

4. Areas of technical experience - detail.

5. Accrediting experience in the matter.

6. Research and/or publications.

7. It has a broad authority recognized in its field of expertise to integrate working teams made up of experts and consultants from different professional areas, to coordinate the work assigned and to have extensive experience in the relationship with very senior public and/or private sector officials, if it corresponds to the nature of the project.

2. Desirable:

1. Teaching experience in the field of its competence.

2. Language management.

3. Research and/or publications.

7. Develop training programmes for team members and related materials, depending on the projects allocated.
