PRESTAM CONTRATES Decree 603/95 Approved a loan contract model to subscribe between the Argentine Republic and the Fund for the Development of the Silver Basin.

VISTO Issue No. 00037/95 of the Register of the SECRETARY for Social Development of the PRESIDENCE OF THE NATION for which the technical cooperation and investment project "Programme for Social Development in Border Areas of the Northwest and Northeast Argentinian with Unsatisfied Basic Needs", proposed to be subscribed between the ARGENTINA REPUBLIC and the FINANCIAL FUND FOR THE DEVELOPMENT OF THE PLATE

CONSIDERING:

That the project funded by the loan resources will aim to establish a reimbursable technical cooperation and investment operation for the execution of studies and works in the above geographical areas.

That the project is part of the work carried out by the SUB-ECRETY FOR SOCIAL PROJECTS of the SECRETARY for SOCIAL DEVELOPMENT of the NATIONAL PRESIDENCE on the management of the national territory.

That the Subsecretariat, through an executing unit, will have the responsibility to execute the project and organize the use of its results and the dissemination of the results with the support of the provincial institutions and governments concerned.

That the general conditions, the amortization deadlines, interest rates and the other clauses contained in the proposed loan contract to be subscribed are the usual ones that are agreed upon in this type of contract and are appropriate to the purposes and objectives to which the loan is intended.

That the formalization of this operation requires the ARGENTINA REPUBLIC through the MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICOS subscribes to the loan contract and supplementary documentation.

That this agreement is covered in the terms of Article 60 in fine of Law No. 24.156.

That in accordance with Article 16 of Law No. 11.672 "Permanent Complementary of Budget (t. 1994)" and Articles 99 inc. 1 and 100 inc. 1 and the Twelfth Transit Provision of the NATIONAL CONSTITUTION, the NATIONAL EXECUTIVE POWER is empowered to adopt such operations and to submit disputes to the decision of arbitral tribunals.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 SECOND THE EXCELLED COMPLEMENTATION OF THE SECOND COUNTRIES From the total amount indicated above, to the equivalent of DOLARES STATEUNIDENSES SETENTA and OCHO MIL DOSCIENTS SEIS (U$S 978.206) corresponds to the financing of the Pre-investment Stage, and to the equivalent of DOLARES STADOUNIDENSES VEINTE MILLONES NOVECIENTS AND NUEVE MIL

Art. 2o . Please provide to the Minister of Economics and Public Works and Services or to the official or officials designated by him to sign, on behalf of and representation of the REPUBLIC ARGENTINA, the loan contract and its additional documentation in accordance with the model approved by Article 1 of this Decree.

Art. 3o . Please provide to the Minister of Economics and Public Works and Services or to the official or officials who the same designates to agree and to subscribe modifications to the loan contract whose model is approved by Article 1 of this Decree, provided that they do not involve substantial changes to the object, to the destination of the funds, do not result in an increase in its amount or make changes to the agreed arbitration procedure.

Art. 4o El The project will be executed by the SUBSECRETARIA OF SOCIAL PROJECTS OF THE SECRETARIAT OF SOCIAL DEVELOPMENT OF THE PRESIDENCE OF NATION through an executing unit that will have the functions provided for in the approved contract; for this purpose it is empowered to create such an executing unit.
