INTRODUCTION OF THE GOVERNMENT OF THE JAPON proposed to be subscribed between the ARGENTINA REPUBLIC and the INTERNATIONAL BANCO OF RECONSTRUCTION and FOMENT, in its capacity as Administrator of the donations funds provided by the GOVERNMENT OF THE JAPON, for an amount of VEINTISEISATION QUINIENTS

CONSIDERING:

Through the above-mentioned Donation Convention, the JAPON GOVERNMENT engages with the ARGENTINA REPUBLIC on the financing of the costs of implementation of technical assistance, including the project studies and the preparation of the document of the DESCENTRALIZATION AND MEJORAMIENTO Project of SECUNDARY EDUCATION.

The Programme for the allocation of donation funds by the JAPON GOVERNMENT aims to support the decentralization of secondary education, through technical assistance to jurisdictions for the formulation of investment projects in education for institutional strengthening, the improvement of the quality of education and the optimization of the infrastructure edilicia.

That the implementation of the Programme will require the recruitment of consultancy services and the realization of administrative expenses, a situation that is specifically determined by the Donation Convention to be signed with the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO.

Given the framework of restrictions on public expenditure, it is necessary to expressly authorize the MINISTERY of CULTURE and EDUCATION, to carry out by itself or through the COORDINATION UNITY of the DRAFT DECENTRALIZATION AND IMPROVING SECUNDARY EDUCATION all acts leading to the fulfilment of the aforementioned purposes.

That the NATIONAL EXECUTIVE POWER is empowered to approve such operations, in accordance with article 99, paragraph 1 of the NATIONAL CONSTITUTION and article 16 of Act No. 11.672 (T. 1994).

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 ). Approve the model of the JAPON GOVERNMENT Grants Convention, in English, to subscribe between the ARGENTINA REPUBLIC and the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO, whose authenticated copy forms an integral part of this decree as ANEX I, for a total of twenty-six million five hundred thousand yen (26.5 billion). The translation into the Spanish language of the text of the model of the Donation Convention and the General Conditions Applicable to the Conventions of Loan and Guarantee of the INTERNATIONAL RECONSTRUCTION BANCO And FOMENT are an integral part of this act as Annex II.

Art. 2o . Contracts and acquisitions to be carried out in the implementation of the DRAFT DECENTRALIZATION AND IMPROVING OF SECUNDARY EDUCATION shall be subject only to the rules, conditions and procedures provided for in the Donation Convention whose model is approved by article 1 of this decree, to mention this situation in reference operations.

Art. 3o . Please refer to Mr. MINISTER OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES, or to the official or officials designated by him, to subscribe on behalf of the ARGENTINA REPUBLIC, the Donation Convention and all the documentation relating thereto, in accordance with the model approved by Article 1 of this Decree.

Art. 4o . Please provide Mr. MINISTER OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES, or to the official or officials designated by him, to agree to and subscribe to the Donation Convention approved by article 1 of this decree, provided that they do not constitute substantial changes to the destination of the donation or modify the agreed Arbitration Procedure.

Art. 5o . Authorize the MINISTERIO OF CULTURE AND EDUCATION, to carry out by itself or through the COORDINATION UNITY of the DRAFT DECENTRALIZATION AND IMPROVING THE SECUNDARY EDUCATION, all the operations necessary for the realization of the objectives set out in the Donation Convention in accordance with the conditions set forth in it.
