Transfer to the Social Work Institute (I.O.S) in a Social Work Office to be conducted and administered by the National Civil Personal Union (U.P.C.N).

VISTO: Record No. 1101369/95 of the registration of the SOCIAL OBRA INSTITUTE (I.O.S.) Laws 19.330, 23.660, 23.661 and 23.696 and Decree No. 2359 of 15 November 1993 and

CONSIDERING:

That, by Act No. 19,330, the Social OBRA INSTITUTE FOR THE PERSONAL OF SOCIAL AND WORKING MINISTERIES was established, currently MINISTERIES OF HEALTH AND SOCIAL ACTION AND WORK AND SECURITY SOCIAL, respectively, as an autarchical agency of joint administration by representatives of the ministries of study and of the workers, through the association with the most representative groupings, resulting in the same the UNION OF THE CIVIL PERSON OF NATION.

That, through the decree No. 1325/91, the NATIONAL INSTITUTE OF SOCIAL ARTWS FOR THE PERSONAL OF NATIONAL PUBLIC ADMINISTRATION AND ITS AUTARKS AND DISCENTRALIZED INSTITUTIES -I.N.O.S.E. - to which the vast majority of the workers of the above-mentioned sectors were affiliated; some of whom were transferred

That Decree No. 2359/93 merged the INSTITUTES OF SOCIAL OBRA FOR THE PERSONAL OF HEALTH MINISTERIES AND SOCIAL AND WORKING AND SOCIAL AND NATIONAL SAFETY FOR THE PERSONAL OF NATIONAL PUBLIC ADMINISTRATION AND ITS AUTARQUICOS AND DISCENTRALIZED DISCENTRALS, creating the INSTITUT.

That, as a result of the process of reordering the Social Works of the National Public Sector, the transfer of activities to the private sectors and the adjustment of the normative framework to the policies of reform of the State, the transformation of the Social Work is appropriate.

That Law 23.696 establishes in Chapter IV the integral protection of the worker belonging to the entities subject to privatization and transformation, determining the preservation of their rights and obligations in the field of Social Security.

That, in order to ensure the continuity of the medical assistance provided for in Laws 23.660 and 23.661, it is incumbent upon the Social Work to review the type of trade union provided for in Article 1 (a) of Law 23.660. That, contributions and contributions to the Social Work will maintain the percentages currently perceived by the SOCIAL OBRA INSTITUTE.

That the present measure is in the use of the powers conferred by article 99 (1) and article 61 of Law 23 696.

RIGHT:

Article 1: Transfer the INSTITUTE OF SOCIAL OBRA (I.O.S.) into a Trade Union Social Work to be established pursuant to article 1 (a) of Law 23,660.

Art. 2: The INSTITUTE OF SOCIAL OBRA (I.O.S.), constituted in accordance with article 1, shall be led and administered by the UNION OF THE CIVIL PERSON OF NATION (UPCN), in accordance with article 12 (a) of Law 23 660.

Art. 3: Workers currently contributing to the SOCIAL OBRA INSTITUTE (I.O.S.) will join together with their family groups, the Trade Union Social Work which is constituted according to the present.

Art. 4: Staff dependent on the SOCIAL OBRA INSTITUTE (I O.S.) will continue to perform in the Social Work that is constituted, maintaining their rights under the category, remuneration and antiquity.

Art. 5: UNION DEL PERSONAL CIVIL DE LA NATION, will present at the end of TREINTA (30) days the Statute of the aforementioned Social Work and will meet the other requirements for registration by the Administrative Authority.

Art. 6: The constituted Trade Union Social Work shall be responsible for the assets and liabilities of the predecessor, INSTITUTE DE OBRA SOCIAL (I.O.S.), except for the liabilities consolidated by the application of the provisions of Laws No. 23.982 and 24.070.

Art. 7: With regard to the assets of the INSTITUTE FOR SOCIAL OVERVIEW, including those relating to the property of the NATIONAL EX-INSTITUTE FOR SOCIAL ARTWS FOR THE PERSONAL OF THE NATIONAL PUBLIC ADMINISTRATION AND THEIR AUTARQUICES AND DISCENTRALIZED ENTES, of the former SOCIAL WORKS PERSONS, SOCIAL, a Commission shall be composed of representatives of the social and social object that is constituted, UNION OF THE CIVIL STAFF OF NATIONAL, of the MINISTERY OF HEALTH and SOCIAL ACTION and of the NATIONAL DIRECTION OF WEEKS OF THE STATE under the MINISTERY OF ECONOMY AND ARTWS AND PUBLICAL SERVICES, which will be responsible for analysing and proposing the use of The constituted Social Work shall maintain the occupation, use, exploitation and administration of the assets of the Institute of Social Work until the commission to be established is issued.
