CREDITO CONVENTIONS Decree 234/95 Apply Credit Agreement Models for the "Construction and Equipment of Two Area Hospitals and a Neonatal Maternity Hospital in the Province of Córdoba".

VISTO Expediente No 001-002429/95 of the Register of the MINISTERIO DE ECONOMIA and ARTWORKS and PUBLIC SERVICES, by which the Project of "Construction and Equipment of DOS (2) Zonal Hospitals and a Neonatal Maternity Hospital in the Province of Cordoba is managed, and the GENERAL TRATADO OF COOPERATION AND AMISTANCE ENTRE THE REPUBLINE

CONSIDERING

Such a project is included within the framework of the above-mentioned Treaty, which was signed in the City of MADRID, SPAIN KING, on 3 June 1988 and ratified by Law No. 23,670.

That Law No. 8374 of 21 April 1994 sanctioned by the Senate and the Chamber of Deputies of the Province of Córdoba authorizes the EJECUTIVE PODER of the Province of Córdoba to call for international public tendering, to carry out all the financial and banking operations necessary to realize the project, and to offer in guarantee of the operation the funds corresponding to the Province for Federal Coparticipation, other guarantees of the official banks and other guarantees.

That, by Decree No. 1533 of 30 June 1994, the EXECUTIVE PODER of the Province of Córdoba authorizes the call for international public tender for the realization of the Project.

That by Decree No. 2133 of 1 September 1994 the EXECUTIVE PODER of the Province of Córdoba awards the tender to the Spanish company DRAGADOS and CONSTRUCTIONS S.A., the realization of the works for a total amount of DOLARES STADOUNIDENSES TREINTA AND TRES MIISTLLONES QUINIENTA AND OCHO MIL (USD 33,548,000)

That the partial financing of the project has been obtained by: a) a credit with Development Assistance Funds (Crédito F.A.D.) through the OFICIAL CREDICT INSTITUTE OF THE SPAIN KING (I.C.O.) for a total of DOLARES STADOUNIDENSES QUINCE TRESCIENTS

That the general conditions, the periods of amortization, interest rates and other clauses contained in the credit agreements to be subscribed are the usual ones that are agreed upon in this type of loan and are suitable for the purposes and objectives for which the same will be intended.

That the NATIONAL EXECUTIVE POWER is entitled to the dictation of this act pursuant to article 16 of Act No. 11.672, Supplementary Permanent Budget (T.O. 1995), Article 99 (1) of the NATIONAL CONSTITUTION and Article 60 of Act No. 24.156.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1Appropriate the Commercial Contract signed on 14-11-94 by the Government of the Province of Córdoba and the Spanish company DRAGADOS y CONSTRUCTIONS S.A. for a total amount of DOLARES STADOUNIDENSES TREINTA AND THREE MILLONES QUINIENTS CUARENTA AND OCHO MIL (u$ 33.548.000) that in an integral copy IEX Art. 2o-Approved the Model Credit Convention, which in an authenticated copy and as an Annex II, forms an integral part of this Decree, to be signed between the SECRETARIAT OF THE MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES and the INSTITUTE OF THE OFICIAL CREDICT OF THE ESPAIGN KING FOR AGAINST Art. 3o-Approved the Model Credit Convention, which in an authenticated copy and as an Annex III form an integral part of this Decree, to be signed between the SECRETARIAT of the MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES and the BANCO CENTRAL HISPANOMERICAN S.A. for an amount of DOES Art. 4o-Please refer to Mr. Secretary of Finance of the MINISTERIO DE ECONOMIA AND ARTWS AND PUBLIC SERVICES, or to the official or officials that he himself designates to subscribe, on behalf of and representation of the ARGENTINA REPUBLIC, the Credit Conventions approved by Articles 2 and 3 of this Decree and any other document and instrument relating thereto. Art. 5o-Please refer to Mr. Secretary of Finance of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, or to the official or officials who himself designate to subscribe, on behalf of and representation of the ARGENTINA REPUBLIC, modifications to the Credit Conventions approved by articles 2 and 3 of the present Decree, provided that they do not constitute substantial changes to the object and destination of the conventions or do not result in increments.
