VISTO Issue No. 001-002100/95 of the Register of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, which manages the acquisition of goods and services of Spanish origin for the equipment of various Assistance Centers in the PROVINCIPLE OF CORDOBA, the GENERAL WORK OF COOPERATION AND AMISTANCE BETWEEN THE REPUBLIC
CONSIDERING:
Such a project is included within the framework of the above-mentioned Treaty, which was signed in the City of MADRID, SPAIN KING, on 3 June 1988 and ratified by Law No. 23.670.
That the project contemplates providing the CORDOBA PROVINCIA with high complexity medical equipment and apparatus.
That the government of that province promptly called for international public tendering for the provision of the necessary elements, limited to companies that could obtain the concessional financing provided for in the "Economic Agreement between the ARGENTINA REPUBLIC and the SPAIN KINGDOM", which is an integral part of the aforementioned Treaty.
On 17 May 1994, the opening of the tenders was made, with the award to the firm EXTERIOR TRADE FOMENT S.A. (FOCOEX).
That for the cost of the project is offered its financing by a CINCUENTA FOR SCIENTY (50 %) through a credit with Development Assistance Funds (Crédito FAD) through the INSTITUTO OF CREDITO OFICIAL OF THE SPAIN KING (I.C.O.) and the other CINCUENTA FOR SCIENTIFICATION (50 %) as a credit in conditions of consensus of the ORG
That the general conditions, the periods of amortization, interest rates and other clauses contained in the credit agreements to be subscribed are the usual and are appropriate to the purposes and objectives for which they will be intended.
That the Legislature of the CORDOBA PROVINCIA sanctioned Provincial Law No. 8388, which authorizes the PROVINCIAL EXECUTIVE PODER to affect the resources from the Federal Tax Association as a guarantee of the operation.
That the NATIONAL EXECUTIVE POWER is entitled to the dictation of this act pursuant to article 16 of Act No. 11.672, Supplementary Permanent Budget (T.O. 1995), Article 99 (1) of the NATIONAL CONSTITUTION and Article 60 of Act No. 24.156.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 Artículo SECOND PROVISIONS ON 14 July 1994 by the Government of CORDOBA with the signature of Spanish origin EXTERIOR TRADE S.A. (FOCOEX), framed by the General TRADE OF COOPERATION AND LOVE THE ARGENTIN REPUBLIC AND THE KINGDOM OF SPAIN Art. 2° ). Approved the model of the Credit Convention that as Annex II is an integral part of this Decree, to be subscribed between the SECRETARIAT OF HACIENDA of the MINISTERY of ECONOMY and ARTWORKS AND PUBLIC SERVICES and the OFICIAL CREDICT INSTITUTE OF THE SPAIN MILITARY (ICO) for an amount of DOLARES STATE 9. Art. 3rd ). Approved the model of Credit Convention that as Annex III forms part of this Decree, to be signed between the SECRETARIAT OF HACIENDA of the MINISTERIO OF ECONOMY AND ARTWS AND PUBLIC SERVICES and the S.A. CENTRAL BANCO (BCH) for an amount of DOONERES STATEUMBER 9,200. Art. 4° . Please refer to Mr. SECRETARY OF HACIENDA of the MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES, or to the official or officials designated by him, to subscribe on behalf of and representation of the REPUBLIC ARGENTINA the Credit Agreements approved by articles 2 and 3 of this Decree and any other document and instrument relating thereto. Art. 5° . Please refer to Mr. SECRETARY OF HACIENDA of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, or to the official who the same designates, agrees and subscribes, on behalf and representation of the REPUBLIC ARGENTINA modifications to the Credit Conventions approved by Articles 2nd and 3rd Conventions, provided that the same amount does not constitute a substantial increase of destination.
