VISTO the Draft Law sanctioned by N° 24547 by the HONORABLE CONGRESS OF NATION, which provides that the Official Broadcasting Service issues a micro weekly dedicated to the dissemination of environmental issues, content and problems, and

CONSIDERING:

That Act No. 22,285 stipulates in its article 3 that the administration of frequencies and the orientation, programming and control of broadcasting services are the exclusive competence of the NATIONAL EXECUTIVE PODER.

That article 34 of the above-mentioned rule established the jurisdictional unit of the Official Broadcasting Service of the Secretariat of State for Communications to which it competed and the administration and operation of the broadcasting stations that integrate it, powers that currently fall within the Ministry of Media of the PRESIDENCE OF NATION,65 pursuant to the provisions of Decree No. 2622 of 28 December 1992, as amended by its date of 12 July 1994.

That, on the other hand, the article gave the former Ministry of Public Information of the NATIONAL PRESIDENCE the powers to guide and monitor the programming to be disseminated through the stations under the Official Broadcasting Service, competencies also currently exercised by the Ministry of Media of the NATIONAL PRESIDENCE.

With regard to the matter covered by draft Law No. 24547, the NATIONAL EXECUTIVE PODER, through the Secretariat of Natural Resources and Human Environment of the Presidency of the Nation, is empowered to address outreach and clarification campaigns on environmental issues, content and problems, which can be implemented through the provisions of article 20 of Act No. 22,285, with the appropriate participation of the Ministry of Culture and Education.

That the draft law in analysis not only violates the powers assigned by Act No. 22,285 to the NATIONAL EXECUTIVE PODER, but, by its vagueness and imprecision, render its provisions inapplicable and its practical result uncertain.

Finally, the NATIONAL EXECUTIVE PODER understands that the dissemination of the topics referred to in the above-mentioned draft law should be carried out with the participation of relevant government agencies and public and private entities dedicated to the environmental problem.

That, for such reasons, it is appropriate to observe in its entirety the bill registered under No. 24.547.

That the present measure is determined in the use of the powers conferred by article 83 of the National Constitution.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - Observe in its entirety the Bill registered under No. 24.547.

Art. 2° - Return the draft law referred to in the previous article to the HONORABLE CONGRESS OF NATION.
