Decree No. 813/95

Ratify Joint Resolution No. 3625/95-ANSSAL and No. 139/95- INOS, concerning the new social work resulting from the transformation of the Institute of Social Services for Insurance, Insurance, Capitalization and Savings and Housing Loans.

CONSIDERING:

That Decree No. 492, dated 22 September 1995, provides for the transformation into social works governed by article 1 (a) or (h), of Act No. 23,660 of various social service institutes, including the INSTITUTE OF SOCIAL SERVICES PAR THE PERSONAL OF FOLLOWERS, REASEGURIES, CAPITALY AND AHORIZATION AND PRESTAY FOR VIEW.

That Act No. 19.518 on the establishment of the said Institute expressly provided for the incorporation of the producers of insurance, capitalization and savings and loan for housing as members entitled to receive the medical-assistance and social benefits provided for therein.

That for this purpose, in the form of a particular category of workers who are not in relation to dependence, since the provisional legislation expressly qualifies them as autonomous (article 2, subparagraph (b), item 3 of Law 24,241, which maintains the similar criterion of Law 18.038), a special system of contributions and contributions on the commissions of acquisition, charges, viats, awards and similar works (article 17, subparagraphs (f) and (h)) should be established

That in the light of the provisions contained in Decree No. 492/95, which do not expressly mention the producers of insurance, capitalization and savings and loan for the housing, the holder of the INSTITUTE of Social SERVICES FOR THE PERSONAL OF SEGUROS, REASEGUROS, CAPITALIZATION AND AHORIZATION AND PRESTAY FOR THE VIVIENDA in consultation with the ADMINISTATION

That, as a result of this presentation, the NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW-UP and the NATIONAL INSTITUTE OF SOCIAL ARTWS have issued Joint Resolution No. 3625/95 and 139/95 respectively, establishing that the producers of insurance, capitalization and savings and loan for the housing will find themselves obligatoryly incorporated into the new social work resulting from the transformation of the INSTITUTO SOCIAL SERVICES

That the aforementioned Joint Resolution allows the continuity of ownership of the producers and the maintenance of the relevant financing, thus avoiding a significant number of workers being unprotected as a result of a situation that does not respond to the purposes pursued by Decree No. 492/95.

That the NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW-UP elevated the proceedings to the MINISTERY OF HEALTH and SOCIAL ACTION taking into account the competence established in Laws 23,660 and 23.661.

That said Ministry, fully sharing the foundations and the decision taken in the aforementioned Joint Resolution N. 3625/95 ANSSAL - 139/95 INOS, promotes its ratification by the NATIONAL EXECUTIVE POWER.

That the General Directorate of Humanitarian Affairs of the Ministry of Health and SOCIAL has taken the intervention of its competence.

That this measure is taken in accordance with the powers conferred by article 99, paragraph (1) of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - Seize Joint Resolution No. 3625/95 of the NATIONAL ADMINISTRATION OF THE HEALTH FOLLOW-UP and No. 139/95 of the NATIONAL INSTITUTE FOR SOCIAL ARTWS, it is established that the producers of insurance, capitalization and savings and loan for the housing will be obligatoryly incorporated into the new social work resulting from the transformation of the INSTITUTE SOCIAL SERVICES FOR THE PERSON
