STATUS AND SCALAFON FOR THE PERSONAL OF THE NATION CONGRESS Decree 929/95 Bs. As., 14/12/95

VISTO the Draft Law registered under No. 24,600 sanctioned by the HONORABLE CONGRESS OF NATION on 22 November 1995 and Decree No. 895 of 11 December 1995 and

CONSIDERING:

That the above-mentioned Decree noted in its entirety the Draft Law, which deals with it returning to the HONORABLE CONGRESS OF NATION.

That a new analysis and evaluation made in the area of the NATIONAL EXECUTIVE PODER with respect to the Draft Law leads to the conviction that only articles 6, 8o inc. m, 9o seq., 15, 27 and 54 sec. of the Act deserve observation.

Article 6 of the Bill provides for the obligation to fill any vacancies in the employment of the deceased ' s spouse or children, which is contradictory to the labour and free recruitment policies currently governing the markets.

That article 8o inc. m), includes the right to a foreseeable "regime" which is not specified or detailed, which would presuppose the inefficiency of it because they would be subject to the general previsional legislation, as otherwise they would be in contravention of Law No. 24,241.

Article 9 of paragraph 2 implies an overabundance of the scope of the right of stability already guaranteed in article 8 (a) of the Bill.

Article 15 establishes a broad concept of anti-employment, by recognizing all non- simultaneous services performed in public bodies of any kind. This is discriminatory on other workers who lack seniority in the area of the National Civil Service and, in addition, in impacting on the other rights of the worker, it has a negative impact on the functioning of the said legislative body.

That article 27, in contemplating automatic promotion only over the course of time, without a general assessment that merits such promotion, limits the employee ' s interest in improving or intensifying its management, and places it in a situation of remarkable inequality with respect to those who do.

Article 54, paragraph 2, provides for a monthly compensatory remuneration for temporary staff who places a privileged position against other workers.

In addition, these articles do not concur with the policy that the National Government has in this kind of legal bodies.

That the power to modify observations made to Bills is adjusted to law and has a background in the process of formation and sanctioning laws.

That the time to proceed is not exhausted.

That the measure does not alter the spirit or unity of the Draft Law sanctioned by the HONORABLE CONGRESS OF NATION.

That the NATIONAL EXECUTIVE PODER has jurisdiction for the dictation of the present pursuant to article 80 of the National Constitution.

Therefore,

THE VICEPRESIDENT OF THE ARGENTINA NATION IN THE EXECUTIVE POWER IN GENERAL AGREEMENT OF MINISTERS

RIGHT:

Article 1 . Modify the scope of the observation provided by Decree No. 895 of 11 December 1995, keeping the veto in respect of articles 6th, 8th subparagraph (m), 9th sub-second, 15, 27 and 54 second subparagraph of the Bill registered under No. 24.600.

Art. 2o . With the salvity pointed out in the previous article, and once the above-mentioned Bill is forwarded to the NATIONAL EXECUTIVE PODER, fill in, promute and tengase by National Law the Bill registered under No. 24.600.

Art. 3o . Note the HONORABLE CONGRESS OF NATION.
