VISTO Law 23.277 establishing rules for the exercise of Psychology, and Law 23.775 on the Provincialization of the NATIONAL TERRITORY OF THE EARTH OF FUEGO, ANTARTIDA and ISLAS OF ATLANTICO SUR, and
CONSIDERING:
In the face of the validity of Act No. 23,775 of the provincialization of the former National Land of Fire, Antarctica and South Atlantic Islands, the regulations issued are limited to the Federal Capital.
That the General Directorate of Humanitarian Affairs of the Ministry of Health and SOCIAL has taken the intervention of its competence.
That the present is in exercise of the powers conferred by article 99, paragraph (2) of the NATIONAL CONSTITUTION.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 . Approve the Regulation of Law 23,277 which is an integral part of this Decree as Annex I. Art. 2o . Please refer to the MINISTERY OF HEALTH and SOCIAL ACTION, through the SECRETARIAT OF HEALTH POLITICES AND SANITARIAN REGULATION, to dictate the complementary, clarification or interpretative norms that require the application of the Regulations adopted by the present, applicable to the scope of the National Civil Service. LAW REGLAMENT 23,277
ARTICLE 1 . In order to exercise the profession of the Psychologist, within the territory of the FEDERAL CAPITAL, persons covered by the law that is regulated must first register their qualifications in the SECRETARIA DE POLITICES DE SALUD AND SANITARIA REGULATION of the MINISTERIO DE SALUD y ACCION SOCIAL, which will authorize the professional exercise, granting the registration and extending the crecial. This should be returned to the Secretariat mentioned when it is temporarily or definitively disabled.
The persons concerned shall, in their first submission, constitute and declare their real and professional residence.
To register their qualifications and obtain registration, interested parties shall:
(a) Present the title or coated properly legalized.
(b) Present proof of identity.
(c) Register your signature at the SECRETARIAT OF HEALTH POLICIES AND SANITARIAN REGULATION OF THE MINISTERY OF HEALTH AND SOCIAL ACTION.
In cases where the competent bodies of the Ministry of Health and Health Policy AND ACTION SOCIAL believes it is appropriate to request authenticated photocopy of the original title and to obtain the necessary background to the granting agency of the title.
La SECRETARIAT OF HEALTH POLITICES AND SANITARIAN REGULATION OF THE MINISTERY OF HEALTH AND ACTION SOCIAL shall organize and carry the registrations, adapting them to the needs that it determines, and may make such checks as it deems necessary to meet the requirements required for the exercise of the profession.
ARTICLE 2o psicología The exercise of psychology includes all professional activity, specifically psychological, developed in individual, group or institutional form, applied on people.
The specific theories, methods, resources, procedures and/or techniques that are applied in the professional exercise of Psychology should be those recognized in the academic areas of the country where psychology is taught.
ARTICLE 3 . WITHOUT REGLAMENT.
ARTICLE 4o . In the cases covered by Article 4(4) of Law No. 23.277, the authorization may be extended by a maximum of one (1) year by the SECRETARIAT OF HEALTH POLITICES AND SANITARY REGULATION of the MINISTERY OF HEALTH and SOCIAL ACTION.
This authorization may be granted to the same person once a period of not less than DOS (2) years has elapsed since its previous qualification. This precarious authorization in no case may mean a private professional activity and should be limited to the consultation required by the recognized health, scientific or professional institutions.
In all cases the contracting institutions shall apply to the SECRETARIAT OF HEALTH POLICY AND SANITARIAN REGULATION OF THE MINISTERY OF HEALTH AND ACTION SOCIAL the relevant authorization, presenting the evidentiary documentation of the act and accrediting the identity of the contract.
ARTICLE 5o . WITHOUT REGLAMENT.
ARTICLE 6 . When inability is decreed for the application of the Criminal Law, the competent authority shall notify the SECRETARIAT OF HEALTH POLITICES AND SANITARY REGULATION of the MINISTERY OF HEALTH and SOCIAL ACTION, which shall proceed to take note of it for the purpose of suspending the agent in the registration.
ARTICLE 7o . The acts of the professional exercise may be recorded in writing with prescriptive value and extended at the request of the official and/or private institutions that credit a legitimate interest, legal responsibility or the interested themselves.
Psychologists are required to certify their benefits, reports or conclusions in forms that must be printed in Spanish, their name and surname, profession, titles, registration number, domicile, telephone as appropriate.
They may only be included in the forms, technical posts or titles recorded in the SECRETARIAT OF HEALTH POLICY AND SANITARIAN REGULATION of the MINISTERY OF HEALTH and SOCIAL ACTION under the conditions that are regulated.
ARTICLE 8 . Professionals who exercise Psychology are, without prejudice to what they establish the other legal provisions in force, obliged to assist the sick when the gravity of their state imposes it and until, in case of deciding the non-prosecution of assistance, it is possible to delegate it to another professional or to the corresponding public service.
ARTICLE 9o Todo Any radio, graphic or television advertisement will conform to the scope contained in Article 10 of Law No. 17.132.
The establishments shall be announced exclusively with the designation with which they are authorized by the SECRETARIAT OF HEALTH POLITICES AND SANITARIAN REGULATION of the MINISTERY OF HEALTH and SOCIAL ACTION.
