Decree 530/94

Ratify a signed agreement between the Supreme Court of Justice of the Nation and the Programming Secretariat for the Prevention of Drug Addiction and the Fight against Drug Trafficking.

VISTO The signing of the agreement between the SUPREMA COURT OF JUSTICE OF NATION and the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICTION AND THE LIGHT AGAINST the NARCOTRAFICE of the PRESIDENCE OF NATION within the framework of article 39 of Law 23,737 and its regulation adopted by Decree 1148/91,06 and 24.

CONSIDERING:

That the aforementioned agreement provides for the distribution of 50% of the proceeds of the sale of confiscated goods, economic benefits and fines delivered to the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICCION and LUCHA AGAINST THE NARCOTRAFICE of PRESIDENCE DE LA NATION, pursuant to articles 39 of Law 23,737 and 1 of the regulations adopted by Decree 1148/91, shall be handed over to the JUDICIAL POWER of NATION, represented by the SUPREME COURT OF JUSTICE OF NATION, in order to bring it to the attention of the needs of the competent courts in the field.

That the NATIONAL GOVERNMENT has established a policy of permanent struggle against drug trafficking, undertaking concrete actions to punish this scourge in all its manifestations.

As a result of this approach, the signed agreement is within the framework of those objectives that were already outlined with the timely sanction of Decree 649/91, among which the Secretariat was mandated to coordinate the implementation of that policy with other areas of the Government at the national level.

That the global increase in drug dependence entails the risk of the spread of common crimes related to illicit trafficking, as well as administrative corruption and the threat of narco-terrorism.

That our country has made commitments through the United Nations-UN-OAS Organization and other international agencies and bilateral and multilateral conventions to combat this scourge.

That the above-mentioned agreement therefore tends to strengthen the functioning of the Federal Courts on those who bear the weight of compliance with Law 23.737.

That the present measure is in use of the powers conferred by article 86, paragraph 1, of the National Constitution.

Article 1 -Ratify the agreement signed on 14 December 1993 between the SUPREME COURT OF JUSTICE OF NATION and the SECRETARIAT OF PROGRAMME FOR THE PREVENTION OF DROGADICCION and the LUCHA AGAINST THE NARCOTRAFICE of the PRESIDENCE OF NATION, within the framework of the provisions of article 39 of Law 23,737 and its regulation adopted by Decree No.
