CONSIDERING

As part of the process of transforming the Government ' s structures, it is necessary to promote the training of staff of the State Bar Corps, so that they can efficiently develop their tasks.

It is also a matter of priority to regulate mechanisms to complete the effective training of the members of that Body, in line with the actual needs of the service and to ensure that the coverage of vacancies that occur is carried out with professionals who have approved the specific training programmes that are established.

The establishment of the State Bar Corps School as a unit of the PROCURATION OF THE TESORO OF NATION and under the supervision of the NATIONAL INSTITUTE OF PUBLIC ADMINISTRATION is essential in order to fulfil these tasks.

That, in merit of the competencies assigned by Act No. 20,173 to the Institute referred to in the preceding consideration, and to the responsibilities of the SECRETARIAT of the PUBLIC FUNTION of the NATIONAL PRESIDENCE in the administration and implementation of the NATIONAL SYSTEM OF THE ADMINISTRATIVE PROF, it is appropriate to ensure its participation in the school management body to be established.

That by the nature of the school to be created it is necessary to ensure the participation of the SECRETARIAT OF JUSTICE in its driving.

In view of the characteristics of the institute created by this act, it is appropriate to establish that the general and academic administration of the School is in charge of an official with a rank of Director General or National.

It has taken the intervention of the EXECUTIVE COMMITTEE FOR AGAINST ADMINISTRATIVE REFORM.

That the present measure is issued in the General Agreement of Ministers on the basis of article 15 of Decree No. 1669/93 and in the use of the powers conferred by article 86, paragraphs 1 and 2 of the NATIONAL CONSTITUTION.

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

TITLE I - OF THE SAME OF THE HOUSE OF ABOGADOS AND ABOGADAS OF THE STATE. (Title replaced by art. 1 Decree No. 808/2021 B.O. 26/11/2021.)

Article 1 - Consider the ESCUELA of the State ' s Official and Advocate Body, as a dependency on the protection of the third part of the nation and under the supervision of the NATIONAL INSTITUTE OF PUBLIC ADMINISTRATION.

Art. 2o... _ STATE is the specific training and technical improvement agency for professionals who develop their administrative career in the State Bar Corps.

The body concerned shall participate in the selection processes of its members.

The training and training activities that it develops may be for those and professionals who, without the incorporation of the State Bar Corps, carry out tasks inherent to or related to the State Law Enforcement, and for those who perform auxiliary or support functions to that Corps.

The School will have as a fundamental mission the development of professional training and the scientific and ethical principles that must inform the conduct of lawyers and lawyers who work in the National Civil Service.

Art. 3o... The NATIONAL INSTITUTE OF THE PUBLIC ADMINISTRATION, by virtue of the competence prescribed by law, shall assign to the ESCUELA OF THE HOUSE OF ABOGADOS AND ABOGADAS OF THE STATE the training plans of the said Body. The School will submit such plans to the Institute ' s prior approval, which will also exercise the supervision of compliance.

Art. 4o... They will be the functions of the ESCUELA OF THE BODY AND BUSINESS OF THE STATE:

a. Determine the training needs of lawyers and lawyers who integrate or seek to integrate the State Bar Corps, of those and professionals who, without integrating it, carry out tasks inherent to or related to the State Attorney ' s Office, and of the staff who perform auxiliary or supportive functions of that Corps.

b. Design and develop courses and other training activities that it deems relevant in the field of State Law.

c. To evaluate the necessary academic profile, for those and professionals who should be appointed or appointed to perform functions inherent in the State Bar Corps.

d. Design and conduct educational, research and scientific outreach activities linked to the State Law Enforcement.

e. To propose to the Procurator or the Procurator of the Treasury of the Nation the holding of agreements of collaboration with agencies or entities of the national, provincial, of the Autonomous City of Buenos Aires or Municipal for the development of training activities for the professionals who carry out tasks inherent to the public legal profession or are auxiliary to the latter, and to the administrative support staff who, for their specific role, must have basic knowledge of law.

f. To propose to the Procurator or the Procurator of the Treasury of the Nation the conclusion of cooperation agreements with universities based in the country or abroad, aimed at carrying out specific training activities in matters inherent to the Public Law, as well as in the exchange of teachers, students and researchers and researchers in the framework of the programmes agreed upon.

g. To maintain permanent contact with the various Delegations of the State Bar Corps, in order to detect and analyse the training needs and the contents, methods and scope of the specialized activities required, and to schedule their activities in accordance with the current needs and trends of the advice, defence and legal control of the State.

Art. 5o... The academic conduction of the ESCUELA OF ABOGADOS and ABOGADA of the State shall be the responsibility of an Academic Committee chaired by the or the Owner of the PROCURATION OF THE TESOLE OF THE NATIONAL INSTITUTE OF THE PUBLIC ADMINISTRATION, both of the JEFF OF GOVERNMENTAL JUSTICE, of the NATIONAL INSTITUTE OF THE PUBLIC ADMINISTRATION, And human rights, a staff member or a staff member with the rank of Secretary or Secretary appointed or appointed on behalf of the MINISTERY OF ECONOMY, or their respective or respective representatives .quienes shall have rank no less than Director or National Director or General, and by whom he holds the title of the aforementioned School.

Art. 6o... La _ THE STATE will be the competent agency to understand in the selection of the members of the State Bar Corps who request scholarships for further training courses that it administers. Art. 9o... The Academic Committee of the School will approve the definition of the basic personal and professional profiles of the applicants and of the minimum contents of the technical assessment that demand the selection processes of members of the State Bar Corps.

The authorities empowered to make available the relevant calls and the intervening selection bodies should integrate these basic profiles and minimum contents into the selection processes they develop. Otherwise, such processes will be null and void.

Art. 19. ! Training activities carried out by ESCUELA del CUERPO de ABOGADOS y ABOGADA THE STATE shall be computed for the relevant purposes by the personnel who review in the NATIONAL SYSTEM of PUBLIC EMPLE when approved by the NATIONAL INSTITUTE OF PUBLIC ADMINISTRATION.

PART IV. GENERAL PROVISIONS.

Art. 20. ! Agencies or entities whose staff are governed by other statutory provisions shall take appropriate measures to ensure compliance with the relevant determinations of this decree.

Art. 21. ! Please provide to the holders of the SECRETARY OF MANAGEMENT AND PUBLIC EMPLEMENTATION of the JEFATURA DE GABINETE DE MINISTROS and the PROCURATION OF THE TESORO OF THE NATION to dictate, through joint resolution, the clearing, interpretative and complementary rules to which the present decree would give place, after the intervention of the Academic Committee, without understanding of the scope of the public competence.
