VISTO Decrees 2453/93 and 507/94; and
CONSIDERING:
That by the above-mentioned standards the organizational conformation of the MINISTERIO DE ECONOMIA AND ARTWS AND PUBLIC SERVICES was adapted, among them the corresponding part of the SECRETARIAT OF FINANZAS, BANCOS AND SEGUROS, adopting, among other provisions, the functional organization of the aforementioned Secretariat
It is necessary to adopt the organizational structure of the Secretariat, given the need to provide the Secretariat with the necessary minimum elements in order to achieve an efficient operation.
It is essential to envisage the mechanisms for the immediate temporary coverage of the posts of the Secretariat in question, pending the implementation of the means of selection provided for in Decree No. 993/91, its amendments and supplements.
That it is also necessary to contemplate the situation of the holders of the functions concured in accordance with Decree No. 994/91, in keeping with the organizational structure that is approved.
That the measure that is promoted by the present, does not imply a greater erogation than that envisaged in due course for Jurisdiction 50.00 - MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES.
Irrespective of this, and as established by the existing legal rules, it is appropriate to make appropriate budgetary adjustments.
That the NATIONAL BUDGET OF THE SECRETARIAT DE HACIENDA has provided its conformity to the modification of the programmatic structure promoted by the present.
That the EXECUTIVE COMMITTEE ON ADMINISTRATIVE REFORM He has taken the intervention that belongs to him, expiating favorably.
That the present measure is determined by virtue of the powers granted to the NATIONAL EXECUTIVE PODER by Article 86 (1) of the National Constitution and Article 8 of the Law of Ministries (T. or 1992).
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 Approve the organizational structure of the SECRETARIAT OF FINANCIALS, BANCOS AND FOLLOW-UPS of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES in accordance with the Organigram, Objectives, Primary Responsibility and Actions, Permanent Plant and Permanent and Cabinet Plant, which, as Annexes I, II, III, IVa and IVb, are an integral part of this Decree.
Art. 2o.- Except the SECRETARIAT OF FINANCIALS, BANCOS and FOLLOW-UP to the limitations established by Article 27 of Decree No. 435/90 replaced by Article 5 of Decree No. 1887/91 and Article 18 of Annex I to Decree No. 2043/80, for the sole purpose of covering the positions of the structure approved by this act.
Art. 3. The competent authorities of the SECRETARIAT OF FINANCES, BANCOS and FOLLOW-UPS of the MINISTERY OF ECONOMY AND ARTS AND PUBLIC SERVICES will be able to designate staff to fill the vacancies generated by the present. These designations will expire in an indefectible and automatic manner on 30 November 1994, or prior to that date when the incumbent of the elected position is assumed through the existing selection mechanisms. Articles 4th, 5th, 6th, 7th, 8th and 9th of Decree No. 847/93 are applicable for this purpose.
Art. 4o.- Modify the Administrative Distribution of the General Budget of the National Administration for the period 1994 - Human Resources - of the Jurisdiction 50.00 - MINISTERY OF ECONOMY AND ARTS AND PUBLIC SERVICES, in accordance with the detail that as Annex Va is accompanied.
Art. 5o.- The staff transferred from other organizational units of the MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES, to the positions of the organizational structure approved by this Decree, will maintain their respective levels and degrees of journal in force. The provisions of this article include the occupied positions of the Charges Regime with Executive Functions, as well as those whose units change from denomination.
Art. 6o.- Ratifícase, from 26 November 1993 to date, acts in relation to the units of FINANCING ASSESSMENT, INFORMATION DIRECTION ON FINANCING AND DIRECTION OF CREDITIES NEGOTIATIONS, which carried out their activities in the orbit of the SECRETARIAT OF HACIENDA and whose organizational structure is approved by SECRETARIA DE BANC
Art. 7o.- The SECRETARY of FINANCIAL, BANCOS AND FOLLOW-UP shall be responsible for the tasks set out by Article 69 (a) to (f) of Law No. 24.156.
Art. 8o.- Replace Article 8 of Decree No. 2453/93, which shall read as follows:
"ARTICULO 8o.- Créase en Jurisdicción de la SECRETARIA DE FINANZAS, BANCOS y SEGUROS UNA (1) Unidad de Proyecto Especial (Bancos), la que se conformá con lo establecido para tal fin por el Decreto No 1482/90."
Art. 9o.- Amend the denomination of the Commission established by Article 8 of Decree No. 1594/92 as amended by Article 13 of its similar No. 2453/93 to that of the COORDINATION COMMITTEE FOR FINANCIAL MATTERS.
Art. 10.- Replace Article 9 of Decree No. 1594/92, which shall read as follows:
"ARTICULO 9o.- The Commission established by the preceding article will have the responsibility to coordinate the analysis and make the proposal of alternatives for the design of the financial sector policy, as well as the management, control and monitoring of the privatization of the CASA DE MONEDA S.E., to that end will coordinate its action with the different areas with competence in the matter, as well as to assist the SECRETARY OF FINANZAS, BANCOS and FOLLOWS in the coordination of the financial matters. "
Art. 11.- Default of Article 12 of Decree No. 1594/92.
Art. 12.- The expenditure that demands compliance with this measure will be met with the credits assigned to the 50.00 Jurisdiction - MINISTERY OF ECONOMY AND PUBLIC SERVICES.

SECRETARIAT OF FINANCIAL, BANCOS AND FOLLOW-UP
OBJECTIVES
1. - Preserving public credit.
2. Coordinate the formulation, proposal and implementation of policies relating to domestic and external financing of the National State.
3. - Supervising actions to facilitate the financing of the productive restructuring.
4. - Monitor the development of financial and insurance services based on external opening and deregulation policies.
5. - Coordinate the relations between the Official Bank and the NATIONAL EXECUTIVE POWER.
6. - Coordinate what is linked to the processes of business reversal and the sanitation of its liabilities with respect to the National State, in what is the matter of its competence.
7. - Coordinate the relations between the NATIONAL COMMISSION OF VALORES, the SUPERINTENDANCE OF NATIONAL ASSESSMENT, the CASE OF MONEDA and the NATIONAL INSTITUTE OF REASEGURS with the NATIONAL EXECUTIVE PODER.
8. - Coordinate the sale of shares in the jurisdiction of the National State.
9. Supervising and coordinating the implementation of any act or negotiation of financing to be held by the Nation, the provinces or their agencies or companies, originating, or may eventually originate obligations of payment in foreign currency.
10. Coordinate the exercise of the corporate rights of shareholders or of capital in companies where the State participates as a minority partner.
SUBSECRETARIA DE FINANCING
OBJECTIVES
1. To implement policies and measures relating to the external and internal financing of the NATIONAL STATE, intervening in the negotiations inherent in the subject with national, foreign, public or private financial entities.
SUBSECRETARIA DE SEGUROS y MERCADO de CAPITALES
OBJECTIVES
1. Implement policies on the development of insurance services and stock market.
2. - Run the actions to coordinate the sale of shareholders in the possession of the National State.
3. - Assist the Secretary of Finance, Banks and Insurance in relations with the NATIONAL VALORES COMMISSION, the SUPERINTENDANCE OF NATIONAL NATIONAL INSTITUTE OF REASEGURS.
SUBSECRETARIA DE GESTION EMPRESARIA
OBJECTIVES
1. - Instrumentate the policies and actions that make the exercise of the corporate rights of the shareholders or of the capital of companies where the state is a minority partner, and instruct the representatives of the National State in the aforementioned companies.
2. - Intervene in all draft laws, decrees or resolutions that introduce or modify rules related to business management and in safeguarding the interests of the participation of the National State.
3. - Intervene in business reconversion processes, their development, coordination and implementation.
4. - To coordinate the sanitation of liabilities, in any way, with respect to the national State, of private companies subject to reconversion processes.

SUBSECRETARIA DE FINANCING
ASSESSMENT OF THE FINANCING
PRIMARY RESPONSIBILITY
Evaluate performance and efficiency in the use of financing.
ACTION
1. - Evaluate the financial performance of the ARGENTINA REPUBLIC, its diagnosis and prognosis.
2. - To advise on the feasibility of different public credit operations.
3. - Evaluate efficiency in the use of financing.
SUBSECRETARIA DE FINANCING
NATIONAL DIRECTION OF CREDITIAL INFORMATIONS AND NEGOTIATIONS
PRIMARY RESPONSIBILITY
Develop, evaluate and implement plans and proposals in support of financial policy management to be developed by the NATIONAL EXECUTIVE PODER, maintaining relevant contacts with the entities involved in the country and abroad.
ACTION
1. - Perform the negotiation of public credit contracts, including the placement of loans, both internal and external, within the scope of their competence.
2. - Understand the training and maintenance of the information system on domestic and external capital markets.
3. - Prepare projects for public credit contracts for the Centralized Public Administration and decentralized agencies
4. - Dictamine the projects of public credit contracts of the Companies and Societies of the State.
5. - Participate in the negotiation of internal and external public credit contracts of State Companies and Societies.
6. - Negotiate the issuance of public debt (internal) instruments of the Centralized Public Administration and decentralized agencies.
7. Negotiate the placement of domestic and external public debt instruments in local, foreign and international markets.
8. - Understand the programming of internal and external public debt.
9. Intervene in investments for instruments that guarantee public debt.
10. Design passive management strategies that tend to reduce the vulnerability of public debt services to fluctuations in exchange rates and interest rates and reduce the cost of public debt.
11. - Propose action courses for the management of public sector assets and financial liabilities.
12. - Supervising the evaluation of public funding.
SUBSECRETARIA DE FINANCING
NATIONAL DIRECTION OF CREDITIAL INFORMATIONS AND NEGOTIATIONS
DIRECTION OF INFORMATION ON FINANCING
ACTION
1. - To implement the design and programming of an information system on internal and external capital markets.
2. - Collect baseline information on the operating conditions of such markets, interest rates and exchange rates, in the country and abroad.
3. - Assess the credit policies of domestic and international financial institutions.
4. - Get information on global capital offers and credit lines by sectors of economic activity.
5. - To analyse the terms of recruitment of the different countries of the region and other institutions of the country in terms of domestic and international credit transactions.
6. - Prepare reports on the relative conditions of different capital markets and draw operational conclusions to support negotiators.
7. Suggest policies to channel national savings to public credit operations.
8. - Coordinate the preparation of macroeconomic information included in the prospects for different placements.
9. - Participate in the design of passive management strategies that tend to reduce the vulnerability of public debt services, against fluctuations in exchange rates and interest rates and reduce the cost of public debt
10. - Analyze the different types of financial operations, including derivatives, and their application to public credit operations.
SUBSECRETARIA DE FINANCING
NATIONAL DIRECTION OF CREDITIAL INFORMATIONS AND NEGOTIATIONS
DIRECTION OF CREDITIAL NEGOTIATIONS
ACTION
1. - Understand the public credit negotiations.
2. - Propose, for each public credit operation, the conditions of negotiation, interest rate, grace period, minimum and maximum payment, usable currencies and other conditions inherent in the negotiation.
3. - Understand the preparation and drafting of contracts and other documents required in the negotiations.
4. - Coordinate with the country ' s representatives in the international financial institutions of credit, any necessary steps to achieve the most favourable treatment for the country.
5. - Supervise that the conditions that may be stipulated in the loan contracts are consistent with the medium- and long-term national economic and social programme.
6. - Develop similar actions to those described in the previous point for loans and other forms of use of public credit.
7. - Propose alternatives for improvement of return on own placements.
8. - Report on objectives in specific management, compliance and relationship with different stakeholders.
9. - Participate in the analysis of the financial conditions of the placement of transitional surpluses of the National Treasure and Social Security institutions.
10. - Participate in the design of passive management strategies to reduce the vulnerability of public debt services from fluctuations in exchange rates and interest rates and the cost of public debt.
11. - Propose policies to manage public sector liabilities and assets.
12. - To deal with national and international risk rating agencies with the analysis of public debt instruments.
SUBSECRETARIA DE FINANCING
NATIONAL DIRECTION OF COORDINATION AND FINANCIAL PROGRAMME
PRIMARY RESPONSIBILITY
Coordinate the indebtedness and sale of assets program based on the budget forecasts in the financing of the Centralized Public Administration.
ACTION
1. - To analyze that the financial operations of the various sectors of the public sector, in their financial aspects, are consistent with each other.
2. - Requiring from agencies that manage public credit operations, complete information on the objectives pursued, specific destination of resources, feasibility of the operation and mechanisms that ensure the repayment.
3. - Coordinate criteria and strategies to achieve unity of action in the negotiations and recruitments of public credit operations carried out by decentralized agencies, state enterprises and provincial and municipal governments.
SUBSECRETARIA DE SEGUROS y MERCADO de CAPITALES
DIRECTION OF SALE OF ACTIONAL PAQUES
PRIMARY RESPONSIBILITY
Develop, evaluate and implement plans and programmes related to the sale of shareholders within the jurisdiction of the National State.
ACTION
1. - To carry out the evaluation and proposal of plans and programmes for the sale of shares and the implementation of the processes necessary to achieve them within the objectives set by the National Executive.
2. - Technically advise on courses of action and convenience of operations subject to their competence.
3. - To keep the Assistant Secretary informed, on an ongoing basis, of the operations carried out, as well as of the different stages in which the different actions are to be negotiated.
4. - Perform any other action entrusted to it, linked to the topics of its specific competence.
