PRESTAM CONTRATES Decree 1697/94 Approved Loan Contracts to be subscribed by the National Atomic Energy Commission for the financing of supplies of materials, equipment and services for the construction of the Atucha II Nuclear Power Plant.

VISTO Expediente No 001-000825/94 del Registro del MINISTERIO de ECONOMIA Y ARTWS AND PUBLIC SERVICES, related to the approval of the Contract of Loan No. F 2291 and the Supplement No. 3 to the Contract of Loan No. F 418 with the KREDITANSTALT FÜR WIEDERAUFBAU, of the German Union No.

CONSIDERING:

That by these contracts, approved by Articles 1 and 2 of Decree No. 1574/80, the above-mentioned financial entities granted to the NATIONAL COMMISSION of ENERGIA ATOMICA with loans in the amount of OCHOCIENTS CINCUENTA MILLONES DE MARCOS ALEMANES (DM 850.000.000).

That, with the delays in the execution of the works of the Central Delegate, the project calendar was changed and, consequently, the date of its entry into service was postponed.

That, attentive to the existing difficulties regarding the financing of supplies and services of national origin necessary for the Nuclear Power Plant Atucha II, the KREDITANSTALT FÜR WIEDERAUFBAU agreed by the Supplement No. 2 the sum of the MILLONES OF MARCOS ALEMANES (DM 50,000.000).

That, as a counterpart, the ARGENTINA REPUBLIC had to provide the equivalent of MILLONES OF GERMANS (DM 200,000.-) or CINCUENTA BY CIENTO (50 %) of the national supplies and services required for the Atucha II Project.

That the MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICOS has provided conformity to the terms and conditions of the Contract of Loan No. F 2291 and of the Supplement No. 3 to the Contract of Loan No. F 418 with the KREDITANSTALT FÜR WIEDERAUFBAU, of the Supplement No. 3 to the Contract of Loan with the German Banking Union headed by the WESTDEUTSCHE LANDESBANK GIROZENTRA

That the NATIONAL EXECUTIVE POWER is entitled to the dictation of the present act, pursuant to article 60 in fine of Law No. 24.156, Article 16 of the "Law 11.672, Permanent Supplementary to Budget (T. 1994)", and Article 99, paragraph 1 of the NATIONAL CONSTITUTION.

Therefore,

Art. 2o Suplemento Approve the Supplement No. 3 to the Contract of Loan approved by Article 2 of Decree No. 1574/80, in the amount of DOSCIENTS CUARENTA MILLONES CIENTO VEINTICINCO MIL MARCOS ALEMANES (DM 240.125.000.-) to subscribe between the NACIONAL COMMISSION of ENERGIA ATOMESTICA

Art. 3o . Authorize Mr.Interventor of the NATIONAL COMMISSION OF ATOMICA ENERGIA or to whom he designates, to sign the Contract of Loan No. F 2291 and Supplements No. 3 approved by Articles 1 and 2 of this Decree, as well as all necessary documentation for the entry into force of such contracts.

Art. 4o . Please provide to the Minister of Economics and Public Works and Services, or to the official or officials designated by him, to subscribe on behalf of and representation of the NATION ARGENTINA the guarantee provided for in the Contract of Loan No. F 2291 and to ratify it in the aforementioned Supplements No. 3.

Art. 5o La NATIONAL COMMISSION OF ENERGIA ATOMICA will adopt the relevant seizures in order to incorporate in its respective budgets, the credits necessary to meet the Emerging Erogations of the Loan Contract No. F 2291 and Supplement No. 3 to the Loan Contract No. F 418 with the KREDITANSTALT FÜR WIEDERAUFBAU and of the Supplement No. 3 to the Loan Contract with the German Banking Union headed by

It should also consider the budgetary provisions necessary to meet the payment of the premiums for the credit insurance coverage to the HERMES export, which originate from the amounts disbursed by both banks.
