DONATION CONVENTIONS Decree 1813/94 Approve a model of the Government of Japan Donation Convention for the financing of the flood rehabilitation programme.

THE SECOND PROGRAMME OF THE JAPON Government, proposed to be signed between the Argentine Republic and the INTERNATIONAL RECONSTRUCTION AND FOLLOW-UP BANCO, as the administrator of the donations funds provided by the Government of the JAPON, for an amount of SESENTA and TRES MILLONES

CONSIDERING:

That the above-mentioned Decree declared the actions of the REHABILITATION PROGRAMME for INCONDATIONS to be of national interest and approved the model of the Loan Convention to be signed with the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO, an agency that partially finances the actions of the Programme.

That the aforementioned Program is in full development within the scope of the SECRETARIAT OF ASSISTANCE FOR THE PROVINCIAL ECONOMIC REFORM of the MINISTERY OF INTERIOR and in the Provinces of BUENOS AIRES, CORRIENTES, CHACO, FORMOSA, ENTRE RIOS, MISSIONS 1992 and SANTA FE, where works are carried out to rehabilitate the damaged facilities in June.

That the Government of JAPON, through the aforementioned Donation Convention, engages with the ARGENTINA REPUBLIC, in the financing of the costs of the implementation of Technical Assistance, provided for in the REHABILITATIONS PROGRAMME for INCONDATIONS, including the development of a comprehensive programme of flood defence.

That the implementation of the Programme will require the recruitment of consultancy services and the realization of administrative expenses, a situation that is specifically determined by the Donation Convention to be signed with the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO.

That given the framework of restrictions on existing public expenditure it is necessary to authorize the SECRETARIAT OF ASSISTANCE FOR THE PROVINCIAL ECONOMIC REFORM of the MINISTERY of the INTERIOR to carry out by itself, or through the Central Emergency Coordination Subunity (U. C. C. E.) of the Central Executing Unit (U.E. C.)

That in accordance with article 99, paragraph 1, of the NATIONAL CONSTITUTION, and article 16 of Law No. 11.672 Permanent Supplementary to the Budget (t. 1994), the NATIONAL EXECUTIVE PODER is empowered to approve operations of this nature and to subject any disputes to the decision of the Arbitrary Tribunals.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 . Please describe in national interest the emerging actions of the Technical Assistance for the REHABILITATION PROGRAMME for the INCONDATIONS, to be financed by the resources of the donation of the Government of JAPON, which is specified by the Donation Convention that will be signed between the ARGENTINA REPUBLIC and the INTERNATIONAL BANCO OF RECONSTCCION and FOMENT.

Art. 2o ). Approve the model of the JAPON Government Grants Convention to be signed between the ARGENTINA REPUBLIC and the INTERNATIONAL RECONSTRUCTION AND FOMENT BANCO, which consists of CINCO (5) articles, DOCE (12) sections and CUATRO (4) annexes, for a sum of SESENTA and TRES MILLONES SEISCIENTOS MIL YEN 000ES (63600). The text of the English-language Donation Convention; its translation into Spanish and the General Conditions Applicable to the Conventions on the Loan and Guarantee of the INTERNATIONAL RECONSTRUCTION BANCO And DOCE (12) articles and SESENTA (60) sections form an integral part of this Decree as Annexes I, II and III.

Art. 3o . Contracts and acquisitions of the REHABILITATION PROGRAMME for INCONDATIONS to be made with funds of the Donation Convention approved by article 2 of this Decree shall be subject exclusively to the rules, conditions and procedures provided for in the Donation Convention and the Loan Convention adopted by the Decree of the NATIONAL EXECUTIVE PODER No. 2121 of 19 November 1992.

Art. 4o . Please refer to the Minister of Economics and Public Works and Services, or to the official or officials designated by him, to subscribe on behalf of and representation of the REPUBLIC ARGENTINA the Convention on Donation and additional documentation concerning the model approved in article 2 of this Decree.

Art. 5o . Please provide Mr. Secretary of Assistance for the Provincial Economic Reform of the MINISTERIO DEL INTERIOR, or to the staff member or officials designated by the latter, to agree to and subscribe to the Donation Convention approved in article 2 of this Decree, provided that they do not constitute substantial changes to the destination of the donation or modify the agreed Arbitration Procedure.

Art. 6th . Authorize the SECRETARIAT OF ASSISTANCE FOR THE PROVINCIAL ECONOMIC REFORM of the INTERIOR MINISTERY to carry out by itself, or through the Central Emergency Coordination Subunity (U. C. C. E.) of the Central Executing Unit (U. E. C.) of the SANEAMIENTO FINANCIAL AND DEVELOPMENT PROVISIONS
