VISTO Issue No. 752.059/93 of the SECRETARIAT of ENERGY of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, by which it processes the process of privatization of the hydroelectric generation activity by WATER AND ENERGIA SOCIEDAD OF THE STATE, in the course of implementation pursuant to Decree No. 10
CONSIDERING:
That by Resolution of the MINISTERY OF ECONOMY AND PUBLIC SERVICES No. 385 of 17 March 1994 approved the International Public Competition Bases and Conditions for the sale of the CINCUENTA and NEW FOR SCIENT (59 %) of the HIDROELECTRICA AMEGHINO SOCIEDAD ANONIMA (HIDROELECTRICA AMEGHINO S.A.) and proceeded to the respective call.
PUBLIC OF ADVISORY AND VENTATIVE MATTERS, which, in such a way, pre-adjudiced the offer presented by HIDROELECTRIC OF THE SURE OF ANONIMA, composed of TRANSOMETRI GAZI, LIMITED, COOPERATIVA DE AGUA POTABLE AND OTHER PUBLIC SERVICES RADA TILLY LIMITED, COOPERATIVA DE PROVISION DE ENERGIA ELECTRICA AND OTHER PUBLIC SERVICES AND LIMITTED VIENDA DE GAIMAN, by CINCUENTID AND NEW FOR SCIENTIUM (59 %)
That the SECRETARIAT DE ENERGIA through Resolution No. 184 of 1 July 1994, in use of the powers delegated to it by Article 8 of the Decree No. 369/94, transferred to HIDROELECTRICA AMEGHINO SOCIEDAD ANONIMA (HIDROELECTRICA AMEGHINO S.A.), the assets and liabilities that were determined in the aforementioned Pliego, resulting from its sodium value.
That, as a result, the relevant Transfer Agreement was signed on 30 June 1994.
That, therefore, it is necessary to dictate the relevant act for the purposes of enabling the taking of possession, by the private operator, of the HIDROELECTRICO COMPLEJO FLORENTINO AMEGHINO on the CHUBUT RIO, in the terms of the Agreement granted to HIDROELECTRICA AMEGHINO SOCIEDAD ANONIMA (HIDROELECTRICA AMEGHINO S).
That the present act is determined by virtue of the powers conferred by Chapter II of Act No. 23,696 and article 99 (1) of the NATIONAL CONSTITUTION.
Therefore,

Article 1 _ LIMITED, COOPERATIVA DE AGUA POTABLE AND OTHER PUBLIC SERVICES RADA TILLY LIMITED, COOPERATIVA DE PROVISION DE ENERGIA ELECTRICA AND OTHER PUBLIC SERVICES AND LIMITTED BY GAIMAN. Art. 2o . Approved the Agreement on Transfer of Actions Class "A" representative of the CINCUENTA AND NEW BY SCIENTO (59 %) of the HIDROELECTRICA AMEGHINO SOCIEDAD ANONIMA (HIDROELECTRICA AMEGHINO S.A.) shareholder, celebrated as a result of the act approved in the preceding Article, which as an integral part of the present act Art. 3o todos All the documentary, legal and accounting requirements established in the Resolution of the General INSPECTION OF JUSTICE No. 6 of 24 December 1980, regarding the registration of the increase in capital carried out by HIDROELECTRICA AMEGHINO SOCIEDAD ANONIMA (HIDROELECTRICA AMEGHINO S.A.), in the terms of the Resolution of the SECRETARIAT OF ENERGIA No. 184 of 1 July 1994. Art. 4o . Send to the General INSPECTION OF JUSTICE the immediate registration of the increase of share capital referred to in the preceding Article. Art. 5o . Instruct all the agencies that are part of the National Public Sector, in the terms defined in Article 1 of Law No. 23.696, to implement the measures necessary, within the scope of their respective competence, to give immediate application to the provisions of this decree. Art. 6th al Facultase the MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICS to determine the interpretation and scope of the acts approved by this decree. Art. 7o PURSUANT TO SELF-SELF-SELF-SELF-SECOND, LIMITED, COOPERATIVA DE AGUA POTABLE AND OTHER PUBLIC SERVICES RADA TILLY LIMITED, COOPERATIVA DE PROVISION DE ENERGIA ELECTRICA AND OTHER PUBLIC SERVICES AND LIMITTED BY GAIMAN.
