Decree 2635/92

Please inform the Energy Secretariat to regulate the application of subsidies for the sale of natural gas and/or indiluted propane-butane distributed by network, which have been included in the National Public Service Budget Project for 1993.

VISTO Issue No. 752.053/92 of the Register of the SECRETARIAT of ENERGY of the MINISTERY of ECONOMY AND PUBLIC SERVICES, and

CONSIDERING:

That the third paragraph of Article 2 of Act No. 23,697 of Economic Emergency provided that subsidies are reflected in the General Budget of the NATION.

That in this sense the NATIONAL EXECUTIVE PODER has raised in time and forms the 1993 BUDGET, specifying the subsidies to gas sales for the period.

Furthermore, Article 48 of Act No. 24,076 provides that the NATIONAL EXECUTIVE POWER may propose to the NATIONAL CONGRESS subsidies to compensate for values with the gas rates, which shall be explicit and contemplated in the National Budget.

It is appropriate to regulate the application of the same, with regard to the types and modalities of consumption that will receive those benefits.

That also the MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICOS will reimburse such subsidies to private service providers.

That in this regard it is important to proceed quickly, in order to allow necessary adjustments to the billing processes of the licensee companies.

That this measure is given in the use of the powers conferred upon it by Article 86(2) of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:

Article 1 - Faccinate SECRETARIAT OF ENERGIA to regulate the application of subsidies for the sale of natural gas and/or indiluted propane-butane distributed by networks, which have been expressly included in the PUBLIC ADMINISTRATION BUDGET NATIONAL, 1993.

Art. 2° - The regulation referred to in article 1 of this Decree includes the determination of the scope of such subsidies, specifying the consumption patterns that will receive these benefits, observing as a limit the amounts budgeted for them.

Art. 3rd - MINISTERY OF ECONOMY AND ARTWORKS AND SERVICES PUBLICS shall reimburse, on a monthly basis, the total amounts to the companies providing the service affected by the grant, and shall notify the SECRETARIAT of ENERGIA, through which it shall notify the licensee of: (a) Date of submission of the Jury Declaration of the amount of the grant requested and (b) Date of reimbursement of the subsidy referred to in (a).

Art. 4° - The invoices, referred to in the previous article, shall be provided with the prior conformation of the NATIONAL REGULAR ENTER OF THE GAS.
