EXPORTS Decree 235/93 Amendment of Decree No. 1011/91.

VISTO Decree No. 1011/91, and

CONSIDERING:

That it is necessary to adapt the operator in the field of export taking into account the objectives of deregulation and opening of the Argentine economy in the international economic context.

That in this regard the implementation of mechanisms for the promotion of agile and flexible exports is required.

That they must be related to the needs of an adequate control of the tax revenue that the Argentine economy requires.

That the reinstatement regime is a valid instrument for export stimulus.

That it has been estimated necessary to provide the system of returns of a more agile operating regime, according to which the NATIONAL ADMINISTRATION OF ADUANAS will make the payment to the exporters of the respective profit.

That the proposed regime is determined according to the provisions of Act No. 22.415 and article 86 (2) of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 Replace the text of Article 6 of Decree No. 1011/91, which reads as follows:

"NATIONAL ADMINISTRATION DE ADUANAS shall proceed to pay to the exporters, subject to the control of the liquidations, the amounts that result using the exchange rate, for the conversion of the foreign currency in national currency of legal course, the buyer closure of the ARGENTINA NATION BANCO of the day prior to the of its effective payment. If appropriate, the payment of the taxes that tax the operation object of profit will be certified in advance."

Art. 2o Replace the text of article 7 of Decree No. 1011/91, which reads as follows:

"NATIONAL ADMINISTRATION DE ADUANAS will give effect to the refund to the exporter with debit to the special account that for that purpose is open the BANCO OF THE ARGENTINA NATION, being authorized this institution to cover the debt balance that I throw that account at the end of the operations of each day from the account "I.V.A. Added Value Tax (I.V.A.)" or "Dirección General Impositiva (D.G).

Art. 3o The modification provided by the present, shall begin to govern from the CINCO (5) days of its publication in the Official Gazette and shall be applicable to all requests for export destinations, to which they are entitled and which are unpaid at the date of the present.

NATIONAL ADMINISTRATION DE ADUANAS will arbitrate the respective regulations and means necessary to achieve their compliance in time and form, establishing an agile system that minimizes the times of collection of refunds in favor of the exporting trade.
