VISTO file No. 4272/92 of the SECRETARY for Transport of the MINISTERY OF ECONOMY AND ARTWS AND PUBLIC SERVICES, and

CONSIDERING:

That Decree No. 479/90, in its Article 4, provided that the functions and powers assigned to the abolished Secretariats and Under-Secretaries would be exercised by the Minister in whose jurisdiction they were in, empowering them to assign or transfer such functions and powers to the Under-Secretaries of their respective area.

That the then Minister of Public Works and Services, supported by this rule, by Resolutions N^os 495 and 497 dated 31 July 1990, he delegated to the former Under-Secretary of Transport the powers delegated to him by Decrees 455/84 and 460/84.

That produced the unification of the ex-MINISTERIES OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES, Decrees 2632/91 and 817/92, provided modifications to the SECRETARIA DE TRANSPORTE.

That neither the signatory Minister of Resolutions MOySP N^ros 495/90 and 497/90, and the Assistant Secretary for Transport are not included in the current ministerial structure, and there is a normative vacuum that makes the dictation of a new delegation of authority necessary.

That such a criterion has been maintained by the PROCURATION of the NATIONAL TESORO in its Opinion No. 188 of September 8, 1992, in the record No. 22,411/91 of the registration of the MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES . SECRETARIAT DE TRANSPORTE, where he expressed that it is necessary to dictate a new decree of delegation of authority in the current Minister of Economics and Works and Public Services, to authorize him to delegate them to the Secretary of Transport or to other officials, since he considers that the sole attribute to the new Minister of Economy and Public Works and Services of the competition previously held by the former Minister of Public Works and Services is not sufficient.

That, however, the Minister of Economics and Public Works and Services and the Secretary of Transport have continued to exercise the emerging powers of these standards, attentive to the need to preserve the continuity of the functions of these areas, established in the Ministry Act.

That, therefore, was acted by such officials in accordance with Article 4 of Decree 479/90 and the emerging powers of Resolutions MoySP N^ros 495 and 497 dated 31 July 1990, it is hereby ratified.

That the competence to resolve the matter arises from the provisions of article 13 of the .t.o. 1992 Ley.

Therefore,

Article 1 . Refer to the Minister of Economics and Works and Public Services the authority provided for in Article 6 of Decree-Law 19.492 of 25 July 1944, which is validated by Law No. 12.980, to grant exceptions to the Law of Cabotaje so that foreign vessels may operate in the National Cabotaje. Art. 2o El The Minister of Economy and Public Works and Services shall be the authority of application with the corresponding decision-making powers, within the limits set forth in the following rules: Decree-Law No. 19,492 of 25 July 1944, endorsed by Act No. 12,980; Act No. 19,870 and Decree No. 6823 of 4 October 1972; Act No. 20.094; Act No. 20,447 and Decree No. Art. 3o . Authorize the Minister of Economics and Public Works and Services to delegate the decision-making powers that emanate from the rules set forth in the preceding articles and Decree No. 817 of 26 May 1992, to the Secretary of Transport and subsidiarily to the Assistant Secretaries of Automotive Transport, Air, Fluvial and Maritime Transport, and Ports and Naviable Ways. Art. 6th Ratify the Resolutions of the Minister of Economics and Marcos and Transport Services, issued in accordance with the powers conferred by Decree 479/90 and Resolutions MoySP N^ros 495 and 497 dated 31 July 1990, prior to the entry into force of the present, which will take place on the date of its publication in the Official Gazette.
