OF HEALTH AND SOCIAL ACTION

Decree No. 775/1993

Approve the organizational structure of the National Council for Children and the Family for the year 1993.

VISTO Law 23,696 on State Reform, the Administrative Reform Programme implemented by Decree No. 2476 of 28 November 1990, and Decree No. 1606/90, and

CONSIDERING:

That Decree 1606/90 established the NATIONAL COUNCIL of the LESSOR and the FAMILY, which is responsible for the functions of the National State in the area of promotion and comprehensive protection of the minority and the family, with technical autonomy and the degree of administrative deconcentration provided by the decree.

That by Decree No. 1811 of 1 September 1980, the structure of the areas was approved, which by Decree No. 1606 of 22 August 1990 constitute the NATIONAL COUNCIL of the LESSOR AND FAMILY, in replacement of the former SECRETARIAT for HUMAN DEVELOPMENT and FAMILY, deleted by Decree No. 435/90.

That by Decree No. 667 of 15 April 1991, as amended by Decree No. 1667 of 23 August 1991, the National Directorates and other directorates that are part of the NATIONAL COUNCIL of the LESSOR AND FAMILY and the payroll of establishments and Directions of an assistance nature were determined in Annex Id.

That by article 13 of Decree No. 1606/90, the NATIONAL COUNCIL OF THE LESSOR AND FAMILY must adapt its structure on the basis of transformations of existing charges, in periods that must be considered extended by the dictation of successive decrees.

That Decree No. 2053/92 creates the SECRETARIAT OF THE THIRD EDAD, so it is appropriate to adapt the structure of the NATIONAL COUNCIL of the LESSOR AND FAMILY to the existence of the new organism.

That Decrees No. 667/91 and No. 1667/91, issued in respect of the central areas -UNITY COUNCIL AND SPECIALIZED FORMATION - did not set the structures of care areas, with adaptation to the new technical programmes and modalities of action in the field of minors and persons with disabilities, which is carried out in an integral way by the present.

That the proposed structure, following modern criteria, increases the level of professional and technical intervention, anticipating the increase of programs in the final decade of the century.

Given the technical autonomy of the agency, which is reflected in the specificity of the tasks of each of the departments of the dependent National Directorates, it is necessary to exempt the NATIONAL COUNCIL from the LESSOR and the FAMILY from the provisions of Decree 1482/90.

That in order to provide the NATIONAL COUNCIL with the sufficient dynamics, training and organization of human resources, for the tasks of a supportive nature that they carry out, it is advisable to approve the endowment for the 1993 Exercise of the Institutes and Programs dependent on National Directions; at the same time authorizing the competent authority to carry out the relevant redeployments according to the needs of repartition.

That the EXECUTIVE COMMITTEE FOR AGAINST THE ADMINISTRATIVE REFORM has taken the intervention that is within its purview.

That this act is given in the exercise of the powers conferred by article 86 (1) of the National Constitution.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - Appropriate for the year 1993 the organizational structure of the NATIONAL MINISTERY OF HEALTH AND SOCIAL ACTION, through the SECRETARIAT OF SOCIAL ACTION, in accordance with the organigrams, objectives, primary responsibilities and actions, permanent plant, permanent plant and cabinet and comparative plan of categories funded, that as Annexes, part IV, part III

Art. 2o - The NATIONAL COUNCIL of the MENOR and FAMILY will act as the Decentralized Agency of the National Civil Service, with a regime of economic and financial autarchy, counting with Administrative Service 318 - National Council of the MENOR and FAMILY - for the administration of its resources.

Art. 3o - Transfer to the SECRETARIAT OF THE THIRD EDAD the position of National Director of old age, Level A, executive function Level III, occupied by its holder, without prejudice to the denomination, primary responsibility and actions that are ultimately imposed on it in the structure of the new Secretariat.

Art. 4o - Please refer to Decrees No. 1811 of 1 September 1980 and No. 667 of 15 April 1991 and No. 1667 of 23 August 1991, with regard to the NATIONAL COUNCIL of the LESSOR and FAMILY, and replace Annex IV to Decree 1870/91 with Annex IV to the Special Security and Safety Body of that agency.

Art. 5o - Approve the Transitory Personnel Plan for the Street Boys Program and the Corps of Capellan of the National Council of the LESSOR and the FAMILY, which, as Annex IVc, is an integral part of this decree.

Art. 6o - Modify the administrative distribution of the NATIONAL ADMINISTRATION budget - HUMAN RESOURCES of the 80.00 MINISTERY OF HEALTH and SOCIAL ACTION, in the part corresponding to the NATIONAL COUNCIL OF THE LESSOR AND THE FAMILY, according to the detail of the table that, as an annex Va, is part of this Decree.

Art. 7o - Except the NATIONAL COUNCIL OF THE LESSOR AND THE FAMILY as set out in article 27 of Decree 435 of 4 March 1990 and its amendments, in order to carry out the promotions, designations and relocations necessary for the coverage of the charges approved by the present, beginning on 31 July 1992.

Art. 8o - Please inform the President of the National Council of the LESSOR AND FAMILY to redeploy, according to the emerging needs of the actions of the National Directorates, the posts of the institutes and departments that depend on each one of them and are contained in the staffing table that is approved by this act in a global manner.

Annex II

NATIONAL COUNCIL OF THE LESSOR AND FAMILY

OBJECTIVES:

To carry out the functions of the National State in the area of the promotion and comprehensive protection of minority and family, with technical autonomy and administrative deconcentration, without prejudice to the powers of the judiciary and the Public Ministry of Minors.

Coordinate and implement the policy of comprehensive promotion of minority and family within the framework of Decree No. 1606/90, the legislation in force, the general principles of children ' s rights and the social policies established by the Ministry of Health and Social Action.

Coordinate the participation of public institutions, non-governmental organizations, neighbourhood and public good entities in general, in the programming, implementation and dissemination of local and regional actions to guide and promote the family and all its members.

Annex III

NATIONAL COUNCIL OF THE LESSOR AND FAMILY

DIRECTION OF SPECIALIZED CHANGE

PRIMARY RESPONSIBILITY

Coordinate research programmes on the issues addressed by the NATIONAL MENOR AND FAMILY Council, in response to its systematization in a data centre and its dissemination through periodicals or editions of specialized materials, and organize the specialized training school in minority and family, coordinating its action with other national and international, public or private entities.

ACTION

1. Organize and direct the Specialized Training School for Minority and Family, coordinating its action with other national and international, public or private entities.

2. - To promote the development of research on the issues addressed by the NATIONAL MENOR AND FAMILY Council.

3. - Organize courses, seminars and seminars on the subject, for the permanent training of the professional, technical and administrative staff of the institution and others that by agreement access the system.

4. - Systematize in a single data centre, all kinds of information on the subject of minors and family and persons with disabilities.

5. - To disseminate, through periodicals and/or editions of specialized materials, research programmes and their products.

NATIONAL COUNCIL OF THE LESSOR AND FAMILY

DEPARTMENT OF HEALTH

PRIMARY RESPONSIBILITY

Coordinate and monitor preventive and treatment actions related to the comprehensive health of persons assisted by the NATIONAL MENOR AND FAMILY COUNCIL.

ACTION

1. - Run the HIV virus infection control and prevention program and sexually transmitted diseases.

2. Determine the nutritional guidelines that should govern the care of the assisted population and monitor and control their compliance with all the programmes of the NATIONAL LESSOR AND FAMILY.

3. Attend the dental health of the population assisted in the various programmes of the NATIONAL COUNCIL of the LESSOR and FAMILY.

4. - Control the prenatal and perinatal care of assisted newborns and their mothers.

5. - Supervising strict compliance with technical guidelines for psychiatric care in public and non-governmental systems with respect to assisted persons requiring it.

6. - Monitor the health aspects of persons with disabilities in the programmes of the National Directorate for the Promotion of Persons with Disabilities.

DEPARTMENT OF RECREATION

PRIMARY RESPONSIBILITY

Implement the cultural recreation programme in all areas of the NATIONAL MENOR AND FAMILY COUNCIL.

ACTION

1. - Coordinate the activities of the recreation centres of the NATIONAL MENOR AND FAMILY.

2. - To project and supervise the holiday plans of persons assisted by the NATIONAL COUNCIL of the LESSOR and FAMILY.

3. - Organize and supervise the recreational, cultural and sporting activities of persons assisted in the various programmes of the NATIONAL LESSOR AND FAMILY.

DEPARTMENT OF TECHNICAL SUPPORT

PRIMARY RESPONSIBILITY

Execute the maintenance, transport and communications actions entrusted by the NATIONAL MENOR AND FAMILY Council in support of the general services of each assistance unit.

ACTION

1. - Reinforcing maintenance tasks in each care unit when its size or urgency exceeds the specific possibilities of staff assigned to the unit ' s general services.

2. - To rely on general transportation of persons or cargo when the service needs so require.

3. - Supervising the communications systems of the NATIONAL MENOR AND FAMILY Council with the assistance areas, other administrative agencies or the judiciary.

4. - Supervising the computer network system of the NATIONAL MENOR AND FAMILY COUNCIL.

5. - Support the maintenance and repair of the machinery and equipment of production workshops and those implemented in the permanent education and training programme.

DEPARTMENT OF PERMANENT EDUCATION AND LABAL CAPACITATION

PRIMARY RESPONSIBILITY

Implement the permanent education and labour training programme in all areas under the NATIONAL LESS AND FAMILY COUNCIL.

ACTION

1. - Coordinate the participation of persons assisted in community educational services.

2. - Coordinate the implementation of special education for assisted persons who so require.

3. Projecting, monitoring and evaluating the forms of education in atypical situations provided for in the ongoing education and labour training programme.

4. - To project and propose to the competent authority the agreements with agencies providing educational and vocational training services.

5. - Organize the data bank of job offers and guide assisted persons to it.

NATIONAL DIRECTION OF PROTECTION OF THE LESSOR AND FAMILY

PRIMARY RESPONSIBILITY

Develop, direct and monitor the programmes of assistance, promotion and comprehensive protection of the child and the family already approved or approved by the NATIONAL COUNCIL OF THE LEAST AND FAMILY, within the framework of the functions assigned by the specific legislation of minors to the technical administrative protection agency and according to the objectives set out in the current regulations.

ACTION

1. - To fully address the personal, family and social problems of the unborn mother and child, at birth and the first period of life, and in particular the protection of the single mother, the minor mothers and the families deprived.

2. - Address through public or private services and programmes the problem of establishing and strengthening the mother-to-father-child bond, to consolidate the family nucleus and prevent abandonment.

3. - To execute all programmes that provide the child with a substitute family environment, in the event that abandonment cannot be avoided.

4. - Coordinate care systems for the problem of the minor at risk, on the street, exploited at work or in all other ways that deter their dignity.

5. - Coordinate public or private services and programmes that avoid, and if any, overcome the causes of physical and psychological abuse and all other forms of anomalous family relationship.

6. Organize and implement programmes and services that provide for the comprehensive assistance and promotion of families that require guidance and support, in order to provide family groups with the framework of dignity and respect for their fundamental rights.

NATIONAL DIRECTION OF PROTECTION OF THE LESSOR AND FAMILY

DIRECTION OF PREVENTION OF THE ABANDON AND MALTRATE

PRIMARY RESPONSIBILITY

Understanding through public or private services and programs the problem of establishing and strengthening the mother-to-father-child relationship, to consolidate the family nucleus, avoiding and preventing any form of anomalous family relationship and preventing abandonment.

ACTION

1. - To fully address the personal, family and social problems of the unborn mother and child, the birth and the first period of life.

2. - To promote actions aimed at the protection of single mothers and families.

3. - Coordinate care systems for the problem of the minor at risk, on the street, exploited at work or in all other ways that deter their dignity.

4. - Organize and implement programmes and services for the comprehensive assistance and promotion of families requiring guidance or support.

5. Coordinate activities between public and non-governmental agencies with the aim of providing at-risk family groups with the framework of dignity and respect for their fundamental rights.

6. Establishing and directing family promotion centres on the basis of existing institutions or those that in the future are created, with an eminently family and community character, by developing interdisciplinary and programmatic actions.

NATIONAL DIRECTION OF PROTECTION OF THE LESSOR AND FAMILY

DIRECTION OF FAMILY WORK

PRIMARY RESPONSIBILITY

To provide the child with a substitute family environment, in the event that the abandonment cannot be avoided, and to provide an alternative to institutionalization, including with regard to the treatment of juvenile offenders in acts that the law qualifies as offences.

ACTION

1. Coordinate and implement preventive and alternative programmes to placement to provide protection to abandoned or at risk or moral or material danger to children and adolescents.

2. - Coordinate and execute programs that mean the entry of minors at risk to a substitute family nucleus.

3. - Assist the NATIONAL DIRECTION OF THE LESSOR AND FAMILY in proposing rules in coordination with other specialized agencies and in particular with the Judiciary regarding the conditions of assistance of minors in alternative family systems.

4. - Run the foster care program.

5. - To make available to national judicial bodies and the Public Prosecutor ' s Office and the provinces or other states, if required, the background and assessments of persons willing to adopt children.

6. - To execute actions aimed at providing free treatment, insofar as possible in their social and family environment of origin, to minors in conflict with criminal law.

NATIONAL DIRECTION OF PROTECTION OF THE LESSOR AND FAMILY

DIRECTION OF INSTITUTIONAL WORK

PRIMARY RESPONSIBILITY

Coordinate all public or private services and programmes to prevent and, where appropriate, to deal institutionally with the problem of the minor at risk or in the event that the law qualifies as crimes, misdemeanours or contraventions, organizing for this purpose the immediate evaluation systems, referral options and graduate programs with job and educational training.

ACTION

1. - Promote the comprehensive protection of minors who are in a state of abandonment or material or moral danger through the most appropriate institutional treatment.

2. - To exercise the superintendence of their institutes, homes and services and to propose to the NATIONAL COUNCIL of the LESSOR and the FAMILY rules regarding the statutes, operation and registration of Cooperative Associations of such establishments.

3. - To exercise the control and registration of non-governmental agencies for the assistance and protection of minors who coordinate and integrate their actions with those of the NATIONAL MENOR AND FAMILY Council.

4. - To monitor and propose the dictation of norms regarding the educational regime provided to assisted minors in accordance with their personal characteristics, with the aim of highlighting the dignity of the person and the best aptitude for social coexistence.

5. Implementing programmes to support the graduates of their institutes by assisting them directly or through associations of former students or other non-governmental organizations.

6. Organizing, directing and supervising immediate evaluation systems, referral options, safety institutes, psychological and psychiatric treatment and egress programmes with job and educational training.

NATIONAL DIRECTION OF PROMOTION OF PERSON WITH DISCAPACITY

PRIMARY RESPONSIBILITY

Develop, direct and implement programmes for the protection and social treatment of persons with disabilities, approved or approved by the NATIONAL COUNCIL OF THE LESSOR AND FAMILY, within the framework of the existing legislation on the integration of persons with disabilities and the objectives set out in the current legislation.

DIRECTION OF ADVISORY SERVICES TO DISCAPACTED

PRIMARY RESPONSIBILITY

Assist the National Directorate in the development of plans, programmes and assistance projects for persons with disabilities. Coordinate and control the technical units.

ACTION

1. Propose and develop based on objectives and policies, plans, programmes and projects.

2. Coordinate with State and private agencies the actions aimed at the development of assistance programmes for the disabled.

3. Intervene in the implementation of activities aimed at the social rehabilitation of the disabled.

4. Direct the implementation of comprehensive protection programmes for the disabled in a situation of lack or abandonment, ensuring their psychophysical and social care, coordinating and controlling the activities of the dependent institutes.

5. Assist the National Directorate in proposing rules, in coordination with other official agencies, concerning the conditions of assistance to the disabled in private services, implementing the corresponding monitoring actions.

6. Direct the execution of actions in coordination with concurrent official and private agencies to maximize coverage and provision of protection and assistance to the disabled.

NATIONAL DIRECTION OF PROMOTION OF PERSON WITH DISCAPACITY

DIRECTION OF PROMOTION OF PERSON WITH DISCAPACITY

PRIMARY RESPONSIBILITY

To direct, coordinate, implement and monitor programmes for the protection of the disabled, with comprehensive attention to those exposed in situations of deprivation or abandonment, in order to enable their rehabilitation and social integration.

ACTION

1. To direct the planning, implementation and control of actions aimed at the implementation of the national policies of the disabled.

2. To direct the implementation of the corresponding actions to evaluate the technical and/or financial assistance requirements formulated by public or private institutions, to participate in the formulation of proposals and control of the approved.

3. Participate in the implementation of actions to promote and disseminate the problem of the disabled in order to improve integration and achieve greater levels of social development.

Implement the programming and evaluation of activities aimed at developing the psychophysical capacity and aptitude of persons with visual disabilities in order to ensure their rehabilitation and social integration.

To provide comprehensive care to persons with visual disabilities under the permanent or transitional residence regime in order to ensure their rehabilitation and social integration.

Provide comprehensive assistance to blind, young and/or adult women or visually impaired women, with socio-economic and/or family problems that determine their transient internshipment until rehabilitating and achieving conditions for their integration into the social environment.
