CONSIDERING
That Law No. 5142 has been regulated by Decree No. 1668 of 26 August 1991, through which the activity of the Zona Franca de La Plata, Province of Buenos Aires, was limited to the commercial aspect until the National Government established a general policy in this regard.
That in this regard the Technical Commission established by Article 34 of the said Decree has drawn up the corresponding draft law on Free Zones, in due course referred to the HONORABLE CONGRESS OF NATION, through Message No. 291 of 23 February 1993.
That the report prepared by the Technical Commission concluded that it would be useful to facilitate industrial activity for export.
At the same time, the privatization of NAVAL ASTILLEROS and FABRICAS OF THE SOCIEDITY STATE ANONIMA, established by Law 24.045, requires the dictation of supplementary rules that facilitate its implementation.
That the Franca Zone of La Plata, Province of Buenos Aires, will aim to boost trade and exporting industrial activity, facilitating that, the increase in efficiency and the decrease in costs associated with the activities that develop in it, are extended to investment and employment.
That the operation of the Zona Franca de La Plata, Province of Buenos Aires, will be convergent with the foreign trade policy and its measures, having to contribute to the liberalization and growth of the economy, fully incorporating into the process of regional integration.
That the present decree is issued in exercise of the powers granted to the NATIONAL EXECUTIVE PODER by Article 86 (2) of the NATIONAL CONSTITUTION and by Law 5142, and in accordance with the provisions of Articles 3 (b), 590 to 599 and 765 of the Customs Code (Act 22.415).
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 - For the purposes of this regulatory decree, the following shall be:(a) Free Zone: This is the scope defined in Article 590 of the Customs Code.
(b) General Customs Territory: This is the scope defined in article 2, paragraph 2, of the Code.
(c) Special Customs Territory: This is the scope defined in article 2, paragraph 3, of the same Code.
(d) Third countries or other countries: It is the geographical area under the sovereignty of other countries, including enclaves in favour of other States.
Art. 2nd . The Free Zone created by law 5142, henceforth called Zona Franca de La Plata, Buenos Aires province, is the one that determines the present decree in accordance with the provisions of Annex I, which is part of the present. Article 3. Authorize the authority for the application of this regime to incorporate gradually and in stages, according to what is proposed by the Organ of Administration and Exploitation of the Franca Zone of La Plata, province of Buenos Aires, the successive habilitations of the same within the expansion area that will be proposed in the province of Buenos Aires. This expansion area should be located within the ejido of Puerto de La Plata, Buenos Aires province. The application authority shall have sixty (60) days to be issued in this respect; after that period the requested authorization shall be established. Article 4. The National State, through the MINISTERIO DEFENSA, is intended for its exclusive involvement in the Franca Zone of La Plata, province of Buenos Aires, the land of its property that includes the entire area demarcated in Annex I, which constitutes the initial area in which it will operate. The land subject to the successive qualifications referred to in article 3, which will be proposed by the province of Buenos Aires, shall be prosecutors, having the province the use and enjoyment of the same, suitable, free of third party rights, out of litigation and unoccupied by the uses permitted in the law, whose demarcation shall be consigned by law similar to the present. Art. 5o It is established that within the Franca Zone of La Plata, province of Buenos Aires, will develop its activity, with the benefits of the present, the ASTILLERO RIO SANTIAGO of the company ASTILLEROS y FÁBRICA NAVALES del EstaADO SOCIEDAD ANONIMA (A.F.N.E.S.A.). This benefit will be extended, on an optional basis, to those who continue the industrial activity of it, even in the case of its privatization. Art. 6°... In the Zona Franca de La Plata, province of Buenos Aires, commercial, service and industrial activities may be carried out, the latter, with the sole purpose of exporting the resulting goods to third countries. Notwithstanding the above, in the Franca Zone of La Plata, province of Buenos Aires, capital assets that do not record production history in the General Customs Territory may be manufactured in order to admit their importation into the Territory. The capital assets referred to in the preceding paragraph, in order to nationalize it, will follow the treatment established in the general import regime of the Nomenclature of Foreign Trade (N.C.E.) and the other relevant tax rules.For the purposes of compliance with the provisions of the preceding paragraph, the Authority of Implementation shall make a list of the goods liable for such treatment and establish the import and control authorization mechanisms it deems appropriate.
Art. 7°... In the Franca Zone, the goods may be the subject of the operations necessary to ensure their conservation and ordinary handling, aimed at improving their presentation or commercial quality or conditioning them for transport, such as division or assembly of packages, formation of lots, classification and change of packaging. The merchandise can also be transferred. It may also be the subject of production activities exclusively for third countries, such as transformation, processing, combination, mixing or any other improvement. The maximum time for the permanence of the goods in stock will be CINCO (5) years. Art. 8°... The area declared Zona Franca de La Plata, province of Buenos Aires, is defined in its limits according to Article 2° and will be fenced in the form of guaranteeing its isolation from the General Customs Territory. Art. 9th... The hours and places of entry and departure of the Zona Franca de La Plata, province of Buenos Aires, will be determined by the Organ of Administration and Exploitation of the Zona Franca de La Plata, province of Buenos Aires, in accordance with the regulations that it dictates. Art. 10. ! It is forbidden to inhabit temporarily or permanently within the Franca Zone of La Plata, province of Buenos Aires. Art. 11. ! The entry of persons and/or goods by places other than those authorized is prohibited. Art. 12. ! The application authority will be the MINISTERY OF ECONOMY AND ARTWORKS AND PUBLIC SERVICES, through the SECRETARIAT OF INDUSTRIA AND TRADE, which it will understand regarding the Franca Zone of La Plata, province of Buenos Aires, without prejudice to the functions assigned to the Governing and Exploitation Body. Art. 13. ! The other agencies involved with competence in the area Franca de La Plata, Buenos Aires province, will issue the complementary provisions. Art. 14. ! The NATIONAL ADMINISTRATION OF ADUANAS shall issue the relevant regulations, in order to facilitate and simplify customs procedures linked to this regime. Art. 15. ! The exploitation of the Zona Franca de La Plata, Buenos Aires province, will be private or mixed. The necessary infrastructure works will be carried out by the concessionaire of the Zona Franca de La Plata, Buenos Aires province. Art. 16. ! The exploitation will be offered in concession and by public tender, which will conform to the conditions established by the Governing and Exploitation Body in the Regulation of Operation of the Free Zone of La Plata, province of Buenos Aires, the tendering and awarding of the concession shall be approved by the application authority, in a term not exceeding the NOVENTA (90) days. Art. 17. ! Invite the province of Buenos Aires to form a public body in the orbit of the Provincial Executive Branch, for the administration and exploitation of the Free Zone, contemplating in its integration the participation of representatives of the sectors that are necessary. Art. 18. ! The Governing and Exploitation Body should basically have the following functions:(a) Elaborate the Operating Regulations and elevate it for consideration to the implementing authority. After TREINTA (30) days of its elevation, except resolution on the contrary, the approval of the same will be firm. This Regulation shall contain the period, modality and conditions of the granting of the exploitation of the Free Zone as well as the terms and contractual conditions for the admission of the users, also foreseeing the inclusion of the ASTILLERO RIO SANTIAGO of the company "ASTILLEROS AND NAVALES OF THE ANONIMA SOCIEDAD", as provided for in Article 5 of the present.
(b) Promote the establishment of research and technological innovation activities that lead to greater strengthening of external markets.
(c) Refer to any information required by the implementing authority and serve it as a standing consultative and advisory body on the activities of the Free Zone.
(d) Fiscalize the provision of adequate, timely and sufficient statistical information on the main economic and commercial indicators of the Franca Zone, required to the concessionaire and the user, which will be of free consultation.
(e) Evaluate the regional impact of the Franca Zone and articulate its functioning with provincial and municipal plans, identifying pernicious effects and costs of the Franca Zone that should be supported by the user companies that generate them.
(f) Fiscalize compliance with the obligations of the concessionaire in charge of the exploitation of the Free Zone.
(g) Regularly audit the necessary monitoring and control measures for access and limits of the Free Zone.
(h) Perceive the concessionaire a right for the concession in the form of a single payment or a periodic fee.
(i) Ensuring user participation in the access and installation of the Free Zone in accordance with the Operating Regulations and responding to and responding to their claims.
(j) Enforcing the applicable laws and regulations, the Operating Regulations, the internal rules of the Free Zone of La Plata, province of Buenos Aires and the concession and operation agreements.
(k) Ensure environmental conservation, and in particular the treatment of effluents originated in the Franca Zone.
Art. 19. ! The Governing and Exploitation Body will facilitate free concurrence in the provision of services in the Free Zone, providing it with the Operating Regulations. You must approve fees and charges for all services and concessions within the Franca Zone by ensuring uniform treatment in equivalent conditions for users and goods. Art. 20. ! The concessionaires shall have the following obligations:(a) Execute infrastructure and basic services connections in the Franca Area that are necessary for its normal operation and which are part of the project approved by the Governing and Exploitation Body.
(b) Rent lots for the construction of buildings for the different activities.
The use of the entire area to a single user cannot be transferred.
(c) Celebrate all kinds of contracts related to your activities.
(d) Urbanize, project and build buildings for the various activities permitted in the Franca Zone.
(e) Dictate and modify its own Internal Regulations in accordance with the provisions of the present.
(f) Ensure the provision of water, light, gas, telecommunications, driving force, heat, cooling, or any other kind of services required for the operations of the Franca Zone in accordance with the provisions of art. 19 of the present.
(g) Promote and facilitate the development of the operations, negotiations and activities of the Free Zone.
(h) To comply with and enforce the Operating Regulations and Rules.
(i) Remit the necessary information and periodic operating memories of the Franca Zone, as well as any other statistical data or information required by the Governing and Exploitation Body.
(j) Pay the costs of the area ' s customs control based on the guidelines agreed between the Governing and Exploitation Body and the National Customs Administration.
(k) Others established by the Governing and Exploitation Body.
Art. 21. ! In order to ensure the provisions of articles 19th and 20th, subparagraph (f), the implementing authority, in the term of NOVENTA (90) days of the decree, shall propose to the NATIONAL EXECUTIVE PODER, the measures necessary to establish the deregulation of public and/or private services, provided in the Franca Zone of La Plata, province of Buenos Aires. Art. 22. ! Users shall be natural or legal persons, national or foreign, who acquire the right to engage in activities within the Free Zone by payment of an agreed prior. Art. 23. ! Users of the Franca Zone shall bear separate accounting of other activities or societies, of the same holder, installed in the General or Special Customs Territory. Art. 24. ! With the caveats established by this decree, all tax, customs and financial provisions, including those of a criminal nature governing the General Customs Territory, shall apply to the La Plata Free Zone. Art. 25. ! The provisions of Decree No. 1159 of 10 July 1992 shall apply to the provisions of this Decree. Art. 26. ! The goods entering the Free Zone of La Plata, province of Buenos Aires, shall be exempt from taxes that tax their import for consumption, in force or to be created, except for the retributive rates of services effectively rendered, except as provided for in article 29 of the present decree. Art. 27. ! The introduction to the Free Trade Zone even if it comes from the General or Special Customs Territory, will be considered as an import. Art. 28. ! The extraction of the Free Trade Zone even for the General or Special Customs Territory shall be considered as if it were export. Art. 29. ! Explain the payment of the statistical rate to those goods that enter the Franca Zone of La Plata, province of Buenos Aires from another country. Art. 30. ! Export stimuli corresponding to exports from the General or Special Customs Territory to the Free Zone shall be liquidated once the goods were extracted from that area to another country and within the time limit for this purpose they set out the general rules governing the matter, whether in the state it possessed when it entered the area, or in another. Art. 31. ! Exports from the Free Zone to third countries will benefit from the return of effectively paid taxes, where they correspond to passive tax returns to exporters from the General Customs Territory. Art. 32. ! Exports from the Franca Zone of La Plata, province of Buenos Aires, will not enjoy other incentives that correspond to exports from the rest of the national territory, except those derived from international agreements signed by the ARGENTINA REPUBLIC. Art. 33. ! They can be introduced in the Franca Zone of La Plata, province of Buenos Aires, all kinds of goods and services, whether or not they are included in the allowed import lists, created or created, with the sole exception of species that affect public morals, public health, plant or animal health, public safety, preservation of the environment, flora and fauna and those situations contemplated in specific legislation. Art. 34. ! The entire process, procedures, documentation and other customs administrative operations in the Free Zone will be carried out in the delegation that the NATIONAL ADMINISTRATION OF ADUANAS will enable it and operate within its premises. Art. 35. ! Temporary import regimes in force in the General Customs Territory shall apply to operations under such destination from the territory of the Franca Zone of La Plata, province of Buenos Aires, and vice versa.
