VISTO file No. 040-011119/93 of the Registry of the Ministry of Economy and Public Works and Services and the need to update the amounts of article 56, paragraph 1 and 3 (a), and article 62 of the Accounting Act, as well as those set by the regulation of the said legal order in article 52, paragraph 4 (g), paragraph 37 (a), subparagraph 73 and paragraph 148 (h),

CONSIDERING:

That it is necessary to contemplate a measure that will enable an adequate agile and operational flexibility in the management of the purchases and contractings to be carried out by the National State to meet its needs.

To achieve this purpose, it is essential to complement the provisions of Decree No. 2662 of 29 December 1992, amending the limits set out in article 56, paragraph 1 and 3 (a), of the Accounting Act.

This measure also seeks to bring together the various acts of the administration with the plans and achievements of the State.

It is appropriate to adjust the ceiling delegated by the Ministers in favour of the owners of the administration agencies of their respective dependence to accept donations of unpaid movable property.

It is also appropriate to update the maximum amount that the proponents may guarantee by paying them in order to strengthen the fulfilment of their obligations.

It is also appropriate to determine limits to which the guarantee of the QUINCE (15) per cent of the total value of the award will not be necessary.

It is also necessary to update the amount to which no price improvement will be requested in case of bids.

On the other hand, it is necessary to modify the maximum ceiling to which the fines applied to the permissionaries and State concessionaires may come, for minor infractions that do not give rise to the termination of the contract.

This Decree is issued in the use of the powers conferred by article 86, paragraph 2 of the National Constitution.

Article 1 The limits set out in articles 56 (1) and (3) (a) and 62 second paragraph of the Accounting Act are amended, as follows:

Article 56, paragraph 1:

In private tendering, when the estimated value of the operation does not exceed PESOS A MILLON ($1,000.000) ratio.

Article 56, paragraph 3 (a):

When the operation does not exceed CIEN MIL PESOS ($ 100,000) BE.

Article 62, paragraph 2:

When the alleged amount of recruitment exceeds PESOS CINCO MILLONES ($ 5,000.000) the relevant announcements will be made by OCHO (8) and DOCE (12) in advance of the date of the respective opening. If the amount does not exceed that amount, the days of publication and anticipation will be DOS (2) and CUATRO (4) respectively.

Article 2o.- The jurisdictional authorities under the National Executive, referred to in article 52, paragraph 4, of the Accounting Act, may delegate to the respective owners of the administration agencies of their dependence and/or their natural substitutes, up to a CINCUENTA MIL ($50,000) the powers that said article agree to them to accept donations without charge of movable property.

Article 3.- Modify the limits set out in paragraphs 34 (g), 37 (a), 73 sixth paragraph and 148 (h) of the regulation of article 61 of the Accounting Act as follows:

Article 61, paragraph 34 (g):

(b) When the amount of the guarantee does not exceed the amount of CINCO MIL PESOS ($ 5,000), with you pay in sight subscribed by those who have the use of the social reason or act with sufficient powers. ♫

Article 61, paragraph 37 (a):

(sighs) When the amount of the contract does not exceed the amount of CINCO MIL PESOS ($ 5,000). ♫

Article 61, paragraph 73, sixth paragraph:

The price improvement will not be requested and the procedure indicated in paragraphs 4 and 5 will be followed when the steep line does not exceed CINCO MIL PESOS ($ 5,000). ♫

Article 61, paragraph 148 (h):

(b) Sanctions and penalties for minor infractions that do not give rise to termination, graduated from receipts to fines to PESOS CIEN MIL ($ 100,000).
