Approve the Internship System

VISTO the EDUCATION TRANSFORMATION PLAN promoted by the NATIONAL EXECUTIVE POWER and,
CONSIDERING:
That for the purpose of achieving the objectives proposed by the EDUCATIONAL TRANSFORMATION PLAN, it is inescapable of convening and having the participation of the various institutions acting within the social structure of the Nation.
That educational establishments at all levels, both public and private, do not constitute the exclusive scope of educational activity according to the current conceptions of the school curriculum.
That it is necessary, therefore, to provide the possibility of the educational system coming out of the classroom and being projected into other sections of society.
To this end and in response to developments in other nations, it is necessary to establish and regulate a system that allows for training that covers both the educational and the work environment.
It is therefore necessary to create the institutional conditions that facilitate and promote the adoption of a system of internships within an appropriate regulatory framework.
That the present measure is determined by virtue of the power conferred by article 86, paragraph 1, of the NATIONAL CONSTITUTION.
Therefore,
THE PRESIDENT
OF ARGENTINA NATION
RIGHT:
Article 1 Approve the system of internships, which will govern the whole area of the National Education System, which will operate in accordance with the Regulation that, as Annex I, is an integral part of this Decree.
Art. 2o - Denominese Internship with the organic extension of the Education System to institutions, of a public or private nature for the realization by the students and teachers, of practices related to their education and training, according to the specialization they receive, under the organization and control of the educational institution to which they belong, during a certain period of time.
Art 3o- The Internships will materialize with the attendance of students and/or teachers to public or private entities and companies of the productive or service sector, in the schedule and under the modalities set out in the attached Regulation.
Art 4o- The situation of PasantÃa will not create any other link for the intern, more than the one between the same and the MINISTERY of CULTURA And EDUCATION , not generating any legal relationship with the public or private agency and/or the company where it performs its educational practice, being the same of a voluntary and free character.

Annex I
REGLAMENT
CHAPTER I:
GENERAL CONDITIONS
ARTICLE 1 The Internship System will have the following objectives:
a- To provide students and teachers of educational institutions with the complementation of their theoretical specialty with the practice in public or private companies or institutions, which empowers them in the exercise of the chosen profession or profession.
b- Achieving that students and teachers have contact with the scope in which business organizations or public or private entities are involved in their studies.
c- Integrate young people into working social groups and enable the strengthening of their own personality and the achievement of their identity.
d- Providing students and teachers with the possibility of contacting up-to-date technologies.
e- To contribute to facilitating the transition between educational and labor, thereby inducing a correct professional choice.
ARTICLE 2o- They are parts involved in the System:
a- The relevant educational authority.
b.- The central educational driving agencies, national, provincial or municipal jurisdiction, whether public or private management, which adhere to it.
c-Industrial or service companies and public or private institutions.
d-The Chambers and Business Associations of the different activities.
e-The students and teachers of the educational establishments using the System.
ARTICLE 3o- The facilities of industrial and service companies and public or private institutions are the places where students and teachers can perform the Internships. These premises are regarded as an extension of the scope of learning, which must meet the conditions of hygiene and safety, in accordance with the provisions of Law No. 19.587, in order to safeguard the psychophysical health of them.
ARTICLE 4o- Students and teachers will be able to receive during the course of the Internship a retribution by the companies or institutions where they carry out the same, as a stimulus allocation for schools and school expenses.
ARTICLE 5o- In order to be able to participate in the Internship System, the Chambers and Business Associations, the companies or institutions that are incorporated therein, they will sign a Convention with the central educational driving agencies and/or with the chosen educational unit, subject to this regulation.
ARTICLE 6 The Convention referred to in the preceding article shall contain at least the following clauses:
a.- Denomination, domicile and personage of the parties that subscribe it.
b.- Characteristics and conditions of the Internships.
c.- Place in which they will take place.
d.- Educational objectives to be achieved in the corresponding school year.
e.- Rights and obligations of the parties.
f.- How to pay the stimulus allowance for schools and school expenses.
g.- Disciplinary regime to apply for assistance, timeliness, etc.
ARTICLE 7o- The knowledge, skills and skills to be attained by the pupil or teacher at the end of his/her Internship, as well as the evaluation system of the same, the conditions of admission and the system of assistance and behaviour, will be carried out by each educational institution and will be included in the curricula of the respective modalities.
ARTICLE 8 Companies or institutions where the Internships take place may provide advice in the preparation of the Annual Internship Programme of each educational institution.
ARTICLE 9 The Internships will last a maximum of CUATRO (4) years and will have a minimum daily activity of DOS (2) hours and maximum of OCHO (8) hours, both of clock.
ARTICLE 10- The minimum age for entering any of the system's modalities will be DIECISEIS (16) years completed in the calendar year. Students and/or teachers who seek to enter the system, in safeguard of their psycho-physical health, must submit a medical certificate, issued by official health authorities, which certifies that the persons concerned can perform the activities required in each case.
Students under DIECIOCHO years shall have written authorization from their parents or guardians.
ARTICLE 11- The activity of the intern will take place only in the period between the OCHO (8) and the DIECIOCHO (18) hours, with at least a pause of QUINCE (15) minutes when the day is from DOS (2) to CUATRO (4) hours and from CUARENTA (40) minutes, distributed in DOS periods of VEINTE (20 ) minutes, when it was more than daily from CUATRO (4) hours and until SEIS.
ARTICLE 12- Businesses or entities and central educational conduction agencies and/or educational units may suspend or terminate the Convention signed in accordance with Article 5 of this regulation, only in cases of closure or bankruptcy of the first or for breach of any of the clauses of the signed Convention.
ARTICLE 13- The protection enjoyed by students and teachers through the various insurances that safeguard their safety in educational establishments extends to the activities carried out by them as interns in the workplace.
ARTICLE 14- At the request of each central educational driving agency, Centres for Coordination and Monitoring of the activities of the Internships will be established, in which all those involved will be represented and will be responsible for carrying the Register of Conventions signed.
CHAPTER II:
RIGHTS AND OBLIGATIONS OF THE PARTIES
A. of the United Nations
ARTICLE 15- Companies or institutions voluntarily entering the Internship System shall have the following obligations:
a.- To subscribe with the central educational driving agencies and/or the chosen educational units, the Conventions provided for in Article 5 of the present Regulations.
b.- To comply with the curricula of the educational units participating in the system, according to the modalities of each of them.
c.- Facilitate the educational units to monitor the activities of the interns and to endorse the professional training certificates achieved during the Internship .
ARTICLE 16. The Chambers and Business Associations, the companies and/or the institutions may suspend or denounce the subscribed Conventions by having to make the corresponding notice in a not lesser advance of SESENTA (60) days.
B. OF CENTRAL EDUCATIONAL CONDUCTION ORGANIZATIONS.
ARTICLE 17- Each central educational driving agency will be responsible for:
a.- Planning, organizing, developing and coordinating the Internships of their jurisdiction in conjunction with the Chambers or Business Associations, public and private companies or institutions within the framework of the Coordination and Monitoring Centres.
b.- Support the teaching-learning process through the development of teaching materials, the conduct of workshops, seminars and/or courses for the instructors of the companies or entities and the teachers of the educational units of their jurisdiction.
c.- To carry out actions to promote the system, where necessary, in order to guide students, parents and managers of companies or institutions.
d.- Subscribe the respective Conventions of Internships.
e.- Supervising the teaching-learning process.
f.- Grant when appropriate the respective certificates of studies.
g.- Monitor compliance with the Conventions concluded by the educational units of their jurisdiction.
ARTICLE 18. The central educational driving agencies may suspend or denounce the Conventions signed, when they are breached, within the TREINTA (30) days of the fact that such a situation may cause.
ARTICLE 19. Determine the number of students and/or teachers who will perform the Internships according to the provisions of the respective curriculum.
C. FROM THE PASANTS
ARTICLE 20. The rights of interns shall be to receive practical training provided for in the curricula of the respective trade, profession, or occupation.
ARTICLE 21. They will receive all the benefits that are agreed upon to the staff of the companies or entities in which they carry out the Internship in the field of dining, transport, roads, etc.
ARTICLE 22. They shall comply with the internal regulations of companies or entities where they perform the Internship and with those established for their career by the respective central educational driving agency.
CHAPTER III:
TRANSITORY RULES
ARTICLE 23. The central educational units, the educational units and the companies or entities that, at the time of the decree of this Decree, have in force the Conventions of Internships, shall adapt the same to the requirements of this regulation.
