GREAT NATIONAL BOARD Decree 969/92 Determine the authority to be given by tenders leading to the privatization of terminal elevators not covered by the scope of Decree No. 351/92.

VISTO the provisions of Annex I to Law 2.696 and the provisions of articles 15, 16 and 20 of Decree No. 2074 of 3 October 1990 and article 43 of Decree No. 2284 of 31 October 1991; and

CONSIDERING:

That the regulations mentioned in the VISTO provided for the privatization of elevators belonging to the NATIONAL BOARD OF GREAT, an agency that is in liquidation under article 36 of Decree No. 2284/91.

It is appropriate to determine the authority to be responsible for tenders leading to the privatization of terminal elevators not covered by the scope of Decree No. 351 dated 27 February 1992.

It is also necessary to set the general guidelines to which the respective procedures should be adjusted.

That the attribution of the subscriber to dictate this Decree stems from the provisions of article 86, paragraph 1 of the National Constitution.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 . The terminal elevators belonging to the NATIONAL BOARD OF GREAT-EN LIQUIDATION, located in the localities of BARRANQUERAS Province of CHACO, SANTA FE, ROSARIO (Units III and IV) and VILLA CONSTITUCION of the Province of SANTA FE, DIAMANTE and CONCEPCION DEL URUGUAY de la Provincia de ENTRE RIOS y SAN PEDRO Art. 2° ENTE LICITANT. Faccinate the MINISTERY OF ECONOMY AND PUBLIC ARTWS AND SERVICES, in its capacity as the Authority of Application of Law 23.696, or ,in its case al the SECRETARY OF AGRICULTURA, GANADERIA And PESCA, if the Minister delegated his competence, to approve the general and particular terms and conditions of each tender, to make the corresponding calls and to sign the respective contracts. Art. 3rd . PRIVATIZATION MODALITY AND SELECTION PROCEDURES. The mode of privatization of the exploitation of the harbour elevators mentioned in Article 1 will preferably be the sale of assets. The selection of the purchasers shall be carried out through the national and international public tendering procedure, on the basis or if it, as determined by the Implementation Authority. Art. 4° . Be made known to the Bicameral Commission established in the area of the HONORABLE CONGRESS of NATION by article 14 of Law 23.696. Art. 5° .
