VISTO the provisions of Decree No. 739 of 20 April 1990 and
CONSIDERING:
That the hierarchy regime for the personnel of the NATIONAL ADMINISTRATION OF ADUANAS was issued.
It is necessary to repeal the aforementioned decree in order to reduce the cost of the fees to be paid by the users who are treated during the days and hours of inability and to adapt the retribution of the staff to the posts and functions of the Organizational Structure approved by Decree No. 2259 of 29 October 1991.
That the SECTOR ' s TECHNICAL ADVISORY COMMITTEE PUBLICO has taken the intervention that belongs to him.
That the present is given in the use of the powers conferred in article 78 of Law 23.760.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 . They are understood in the hierarchy regime instituted by the present, the superior authorities, permanent and transitory personnel of the NATIONAL ADMINISTRATION OF ADUANAS. Art. 2° El The hierarchy regime provided for by this decree shall be established on the basis of the effective function of the agent, its suitability, efficiency, contraction to work, behaviour and assistance. Art. 3rd La The monthly retribution to each agent for hierarchization will be determined as follows:(a) For the higher authorities, the officers in categories 1 to 6 of all categories and those acting as a 3rd grade Customs Assistant, Chief of Customs Section of 2nd grade, and Chief of Customs Section of 3rd grade, applying to their regular, normal and permanent remuneration the coefficient resulting from dividing the VEINTICINCO by CIENTO (25 %) of the collection to which the staff of 78,760 is compensated.
(b) For the other agents, applying to their regular, normal and permanent remuneration the coefficient resulting from dividing the SETENTA and CINCO FOR SCIENT (75 per cent) of the collection referred to in article 78, for the computable remuneration of the staff covered in the subparagraph.
The computable remuneration of the agents, for the purposes set out in subparagraphs (a) and (b) above, is those resulting from considering the deductions provided for in article 6 of the present decree.
Art. 4° . For the purposes set out in the previous article, consider as a regular, normal and permanent remuneration of each agent to the monthly allowances, excluding family allowances, extraordinary habilitation services, compensation established by Law 23.860, overtime, mobility and others of similar nature, existing or believed in the future. Art. 5° La Remuneration of hierarchy cannot be considered as a basis of calculation to establish other, additional, special remuneration, compensation and compensation. Art. 6° 6 Please refer to the National Customs Administrator to issue the necessary supplementary regulations and liquidation procedures, in order to comply with the provisions of articles 2 and 3 of the present decree and to regulate the relevant deductions to be made to agents, motivated by disciplinary sanctions, absences or licences. Art. 7° . When, as a result of the investigation of an administrative case, the agent is suspended from pre-trial detention, he shall not receive the retribution for hierarchy, a measure which shall be maintained until the resolution providing for reinstatement to the service is issued. Art. 8° The NATIONAL ADMINISTRATION OF ADUANAS shall be the authority to implement the provisions contained in the present decree, and may provide for the relevant measures for its implementation.
