VISTO was informed by the Joint Chiefs of the Armed Forces on their own motion No. 10,300 and proposed by the Ministry of Defence; and
CONSIDERING:
That the military strategic approach, through DEMILE 1/84 and DEMIL 1/89, foresees the existence of a Joint Territorial Command of the Interior Zone.
That the strategic operational approach derived from the above-mentioned Directives has shown that the development of the planning of actions for the protection of vital objectives, especially ports, airports and communications channels and the coordination of the relevant to Territorial Affairs is of decisive impact on the effectiveness of the entire strategic system.
That such incidence is independent of the eventual scenario of conflict or war considered by joint military planning.
That the Joint Territorial Command of the Interior Zone is currently unfolding, for the purposes of planning, with staff who perform permanent functions in various agencies of the Armed Forces whose overall mission is compatible.
It is essential to centralize tasks of a territorial nature in the same body that, given the existing structures, are currently carried out unilaterally in each Armed Forces.
That the adjustment in the constitution and dependence of the Joint Territorial Command of the Interior Zone does not cause special erogations, but instead tends to streamline functions to optimize the cost-efficiency ratio.
That the continuing nature of its task and the need for recurrence to the National Power require the knowledge and continuous updating of means and resources.
Taking into account the tasks of the Joint Command in peacetime and not by means of operational leadership of forces, the position of Joint Territorial Commander may be performed without prejudice to other military functions.
That if it is essential to provide the necessary minimum human resources, with permanent stability, for the proper functioning of the General Staff.
That this measure is in use of the emerging powers of article 86, paragraph 17 of the National Constitution and article 18 of the National Defence Act (No. 23.554).
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 . The structure and functional unit of the Joint territorial Command of the Interior Zone, which will depend, in time of peace, on the Ministry of Defence through the Joint Chiefs of the Armed Forces and, in case of war, on the President of the Nation, should be established from this Decree. Art. 2° El The Territorial Joint Command of the Interior Zone will have as its mission and territorial jurisdiction the ones established by the Military Strategic Directive in force. Art. 3rd . The title of the Joint Territorial Command of the Interior Area will be performed by a senior officer of the Armed Forces in activity, the hierarchy of Brigade General or equivalent, appointed by the National Executive Branch on the proposal of the Minister of Defence and following the criteria that, as for the Force of origin, establishes the joint military doctrine for the appointment of strategic operational commanders. Art. 4° . The time of peace the position of Joint Territorial Commander of the Interior Zone will be performed without prejudice to other military functions and in case of war or when another exceptional situation makes it necessary, the National Executive will have to be exclusively. Art. 5° . The Joint Territorial Command of the Internal Affairs Area shall be composed of senior and junior personnel of the Armed Forces, appointed by the Minister of Defence on the proposal of the General Staff of the Armed Forces, under the coordination of the Joint Staff of the Armed Forces and in accordance with the criteria established by the Joint Military Doctrine, as the nucleus of permanent troops, with full dedication that shall include, in all cases, the Chief of Staff. Art. 6° El The Joint Territorial Command of the Interior Area will be empowered to require to the relevant State agencies, with knowledge and prior consent of the Minister of Defence, the information necessary to keep up-to-date the collection of personnel, materials, resources and capacities of each of them, essential to contribute to national defence. Art. 7° . In the maximum period of six (6) months, from the date of entry into force of this Decree, the Joint Territorial Command of the Interior Area shall submit to the Joint Staff of the Armed Forces a draft Organic Regulations, which shall be approved by the Minister of Defence. Art. 8° . The expenses that demand compliance with this Decree shall be charged to the specific provisions of the Ministry of Defence - Joint Chiefs of the Armed Forces. Art. 9° .
