VISTO draft Act No. 24.175, adopted on 30 September 1992, and communicated by the HONORABLE CONGRESS OF NATION for the purposes provided for in article 69 of the National Constitution, and

CONSIDERING:

That article 1 of the above-mentioned draft extends by the time limit of UN (1) year, beginning on 1 January 1993, the validity of the differential retirement regimes, provided for in article 1 of Act No. 24.017 and Decree No. 1044/83.

That Decree No. 1044/83 does not constitute a differential retirement regime, in the terms of articles 62 of Act No. 18.037 (t. 1976) and Act No. 24,017, 1 and 2 of Act No. 24.017, but a special retirement regime for certain political officials in the City of Buenos Aires.

That the decree was repealed from 31 December 1991 by article 11 of Act No. 23.966, without any further legal provision extending or re-establishing its validity.

That article 19 of Act No. 24,018 established a special retirement regime for the mayor and other political officials of the Municipality of Buenos Aires on 1 January 1992.

That in the light of what was stated, the application of article 1 of the bill under review would imply that, from 1 January 1992 to 31 December of the same year, Decree No. 1044/83 would continue to be repealed, but would regain its validity, although only for one (1) year, from 1 January 1993, the latter would fail during which the political officials of the Municipality of the City of Buenos Aires would be subject to D.

It is appropriate to note the re-establishment of Decree No. 1044/83, as provided for in article 1 of the draft law under review.

That the measure currently available falls within the terms of reference provided for in article 72 of the National Constitution to the NATIONAL EXECUTIVE PODER.
