CONSIDERING:
That the persistence of violence in sports stadiums, especially in those where football meetings are taking place, makes it essential for a strong and meticulous action by the various agencies of the National State to achieve its ultimate eradication.
That the search for greater effectiveness in the prevention of such acts is necessary, creating the appropriate instruments for this purpose.
The regulation of article 32 of Act No. 23,184 is essential, and it is appropriate for the Argentine National Sport Entity to be the implementing agency of the Act under national jurisdiction.
That this measure is determined in the use of the powers conferred by article 86, paragraph 2, of the National Constitution.
Therefore,
THE PRESIDENT OF THE ARGENTINA NATION
RIGHT:
Article 1 Artículo The Argentine National Entity of Sport, a body dependent on the NATIONAL EXECUTIVE PODER, will be the implementing body of article 32 of Law No. 23,184 in national jurisdiction, being empowered to require the collaboration of other national agencies in carrying out their duties. Art. 2o o The sports entities responsible for the stadiums in which sports shows are held of mass attendance, at a time not less than NOVENTA and SEIS (96) working hours, must communicate in a fruitful way to the Argentine National Sports Ente: place, date and time of the sporting event, characteristics of the sport, estimate of the audience, and any other information that is necessary at the discretion of the Authority of Application. Art. 3o o The Argentine National Sport Entity is empowered to have inspections of the facilities until the VEINTICUATRO (24) hours prior to the event, in order to verify that the facilities offer safety for the life, physical integrity of the public and for the normal development of the show.For the same purposes and even during the events, the Argentine National Sport Ente will be able to arrange inspections to verify the effectiveness of the control and surveillance measures adopted by the organizers of the show.
Art. 4o When the inspections result in the failure of the facilities to provide the necessary guarantees for the realization or continuation of the sporting event, the Argentine National Sport Entity may arrange the temporary closure of the stadium and intimate the responsible entity to correct the deficiencies observed within a maximum period of NOVENTA (90) days, which the final closure of the stadium will be available. Art. 5o o When the deficiencies noted were organizational, not providing sufficient guarantees for the realization or continuation of the show, the Argentine National Sport Ente may, in response to the seriousness of the events and without prejudice to the immediate suspension of the development of the event, arrange the temporary closure of the stadium for a period of up to QUINCE (15) days.In the event of verification of the same organizational deficiencies within a calendar year, the Argentine National Sport Entity may temporarily close the stadium for a period of up to TREINTA (30) days, and in view of the finding of a new organizational deficiency within the same calendar year, the Ente may have another temporary closure of up to TABLE AND CINCO (45) days. If such a situation is reiterated, the final closure of the stadium will be provided.
Art. 6o o Through the Ministry of Foreign Affairs, the Provincial Governments shall be informed of the scope of this measure and the invitations provided for in Chapter III of Law No. 23,184 shall be extended.
