Amendment of Decree No. 509/88.

VISTO Law No. 23.109 (as amended by Laws No. 23.240 and 23.701) and Rule Decree No. 509 of 26 April 1988; and

CONSIDERING:

Article 12 of Act No. 23.109 (as amended by Act No. 23.701) provides that former soldiers, officers, officers and civilians, who have participated in the war actions carried out in the South Atlantic between 2 April and 14 June 1982, shall have the right to a study grant equivalent to a minimum living and monthly mobile wage, plus the schooling allowance of 18.0.

That article 12, paragraph (b) of Decree No. 509 of 26 April 1988 provides that the benefits shall be paid on the basis of the application of the scholarship and from the date of its formalization.

That it is necessary to amend article 12 (b), paragraph 2 of Decree No. 509 of 26 April 1988, so that the beneficiaries covered by article 1 of Act No. 23.109 (as amended by Act No. 23.701) may enjoy the benefit from the date of their respective application and from the time they have initiated their studies, as provided for by the legal rules of reference.

It should also be considered that, on the date of the regulation of Act No. 23.109 (as amended by Act No. 23.701), persons who benefited from the above-mentioned scholarship have completed their studies.

That such modifications have legal sustenance in the opinion of the PROCURATION OF THE THIRD OF NATION, dated 18 December 1989, in file C.E. 13-616/88 CIJ 3472/88.

That the NATIONAL EXECUTIVE POWER is entitled to issue this measure in the use of the powers conferred by article 86 (2) of the NATIONAL CONSTITUTION.

Therefore,

THE PRESIDENT
OF ARGENTINA NATION
RIGHT:

Article 1 - Replace article 12, paragraph 2 (b) of Decree No. 509, of 26 April 1988, with the following "such benefits shall be paid from the date on which the relevant request is made and shall be accrued from the time the applicants have initiated their studies, if it were subsequent to the date of its promulgation of the Act and from the latter, if they had been initiated earlier."

Art. 2°- In the event that the subjects covered by article 12 of Act No. 23.109 (as amended by Act No. 23.701) have completed their studies after the date of promulgation of the Act and have not made the application for the grant, they shall have the right to be recognized for the perception of the benefits accrued during the period between the enactment of the Act and the completion of the studies, if applicable, of the legal provisions. The persons concerned shall, on a date-to-date basis, credits required by Act No. 23.109 (modified by Act No. 23.701) to become creditors to the benefit.
