Decree 392/90

Amend Decree No. 327/89, assigning authority to the National Defence Council and the Internal Security Committee.

VISTO informed by the Minister of Defence, and

CONSIDERING:

By Decree No. 1573 of 27 December 1989, the NATIONAL SECURITY COUNCIL was dissolved by Decree No. 83 of 23 January 1989.

It is necessary to determine the authority to be responsible for the advisory functions established for the Agency in Decree No. 327 of 10 March 1989.

It is considered appropriate to attribute such powers to the NATIONAL DEFENSA COUNCIL established by the National Defence Act No. 23,554, and the SECURITY COMMITTEE INTERIOR created by the decree quoted in the previous consideration.

It is the power of the NATIONAL EXECUTIVE POWER, pursuant to article 86, paragraph 1, paragraph 2 of the Constitution, to issue the present decree.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 - Replace Articles 1, 2 and 4 of Decree No. 327 of 10 March 1989 with the following:

"Article 1 - The organizational and functional bases for the preparation, execution and control of measures to prevent and conjure up the formation or activity of armed groups that have the ability to endanger the validity of the National Constitution, or to infringe on the life, liberty, property or security of the inhabitants of the Nation, as well as on the assumption of facts that constitute such a state of concussion in such a seriousness".

"Article 2 - The NATIONAL DEFENSA COUNCIL created by Law No. 23.554, will advise the President of the Nation in the formulation of the measures outlined in the preceding article."

Article 4 In order to be assisted in the handling of the crises that arise, related to the activities described in article 1, the President of the Nation will have an INTERIOR SECURITY COMMITTEE that will be composed of the Minister of the Interior, the Minister of Defence, the Chief of the Joint Staff and the Secretary of State Intelligence. The President of the Nation may decide on the assistance of any other authority which he considers to be involved in the meetings of the Committee. For the purpose of foreseeing the production of the facts provided for in article 1 , the SECURITY COMMITTEE INTERIOR will be able to develop plans that will support the possible joint actions of the Armed Forces. For the same purpose, the INTERIOR SECURITY COMMITTEE may require the collaboration of the agencies of the National Intelligence System."

Art. 2o - Article 8 of Decree No. 327 dated 10 March 1989.

Art. 3o - This decree shall enter into force from the day of the date.
