General SINDICATURA OF PUBLIC COMPANIES Decree 2686/90 Except for the above-mentioned Agency of Restrictions imposed by Decree No.435/90.

VISTO what was proposed by the General SINDICATURA of PUBLIC COMPANIES, and

CONSIDERING

That the purpose of the General SINDICATURA of PUBLIC COMPANIES to expedite and facilitate its specific activity of control and evaluation of the commercial, operational, economic and financial situation of the companies and societies of the State in which it has responsibility for the implementation of Law No.21.801 (t.a.), is affected by the decrease of its specialized personnel.

It should also be noted that the above-mentioned agency, through Decree No. 926 of 28 July 1988, which is a pre-cited law, has been provided with an appropriate instrument for the effective and full implementation of the counter-loring functions entrusted to it by the above-mentioned law.

That, on the other hand, the need to issue opinions for international agencies (Inter-Americane Development and Global BANCO) in accordance with the agreements reached, results in an increase in the workload of that Control Agency.

That, in turn, it should be noted that this Entity has extended its work as an external auditor to the Provincial Institutes of Housing, to the MUNICIPAL COMMISSION OF THE VIVIENDA of the Federal Capital and to the CENTRAL BANCO of the ARGENTINA REPUBLIC and the BANCO OF THE PROVINCIA DE SANTA FE, as well as other institutions close to joining the system.

That in the attainment of its object the structural reform process of the State implemented through the sanction of Laws No.23.696 and 23.697, given the intimate relationship between the functions and competences of the General SINDICATURA of PUBLIC COMPANIES and the activity of public enterprises is also compromised.

That, in turn, Decree No. 1757/90 states that SIGEP as an External Control Agency of public enterprises must ensure strict compliance with its standards.

That under the above-mentioned considerations, and bearing in mind that the staffing of the agency has been reduced as a result of the withdrawal and freezing of vacancies provided by various standards, as well as the implementation of Decree No. 435/90, the coverage of vacancies is required through the promotion of agents of its plant and the incorporation of specialized personnel, who are preferably serving in the Public Administration.

That this will allow the agency to have the necessary human resources to enable it to fulfil with speed and efficiency the object for which it was created and to adapt its functioning to the real objectives that the action of government pursues.

That the proposed measure will be financed from the resources of that body.

It is part of the policy of the National Government.

That it is therefore necessary to exempt the General SINDICATURA of PUBLIC COMPANIES from the freezing of vacancies provided for in article 27 of Decree No. 435/90, replaced by article 1, paragraph VIII, of Decree No. 612/90 and amended by article 2 of Decree No. 794/90.

That it is therefore necessary to exempt the General SINDICATURA of PUBLIC COMPANIES, during the current exercise, from the freezing of vacancies provided for in article 27 of Decree No.435/90, replaced by article VIII of Decree No. 612/90 and amended by article 2 of Decree No. 794/90 and the prohibition contained in article 23 of the same decree to carry out promotions in the categories of staff magazine.

That the present is given in the use of the emerging powers of article 86, paragraph 1 of the National Constitution and in accordance with article 27, paragraph 1, final part, of Decree 435/90 and its amendments.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1.. Except for the General SINDICATURA OF PUBLIC COMPANY COMPANIES of the forecasts contained in articles 23 and 27 of Decree No. 435/90, as amended by similar articles No. 612/90 and 794/90, which defrost the vacant positions of the permanent plant approved by Decree No. 2.215/87 -according to detail contained in the table annexed to this article- authorizing it. Art. 2. Vacancy coverage by designation will be carried out on a competitive basis where only staff of the National Civil Service (Central Administration, Special Accounts, Decentralized Agencies, State companies and societies) can participate in the following requirements: a) age: up to TREINTA (30) inclusive years; b) university degree of lawyer, accountant, graduated in administration, engineer or related careers. Art. 3, For the purposes of the contest referred to in the previous article, the General SINDICATURA OF COMPANIES PUBLICAS will open a record for the term of TEN (10) days from the date of publication of this decree in order to enable the registration of applicants who meet the requirements of the previous article.

The applicants will be evaluated by the Permanent Commission of Selection of the areas of legality, audit and management, according to the evidence of competence that determines the rules in force in the said agency, and must communicate the result to the Executive Committee of the General SINDICATURA OF PUBLIC COMPANY COMPANIES.

Art. 4° . For the assumption that no applicants will be presented or that the contest will be deserted in whole or in part, the General SINDICATURA OF PUBLIC COMPANIES will be able to cover up to a TREINTA FOR SCIENTO (30%) of the vacancies defrosted by Article 1 with staff not coming from the National Public Administration.
