VISTO, the need to seek immediate solutions to the financial difficulties faced by the Provincial Jurisdictions, and

CONSIDERING:

As a result, the Provinces are unable to meet the commitments arising from the implementation of their budgets.

In accordance with article 5 of Act No. 23,548, the NATIONAL EXECUTIVE POWER may not rotate any amount exceeding the amount resulting from the application of article 3 (d) in additional form to the distributions of funds governed by that Act, except those provided for in other special regimes.

That in the face of this situation and the requirements made by the Provincial Jurisdictions, it is imperative to take measures to allow the immediate action of the NATIONAL GOVERNMENT, making it appropriate to have temporary advances of funds to the Jurisdictions, on their participation in the production of national taxes, thus continuing with the measures of financial assistance to the Provinces adopted through the Decree No. 1775 of 5 September 1990.

That the critical fiscal situation in the NATIONAL GOVERNMENT advised advances through public debt securities.

That such advances may be granted, as permitted under article 15 of Act No. 20.659, which is regulated by Decree No. 1357 of 3 May 1974 and incorporated into Act No. 11.672 (Permanent Budget Complementary) under article 36 of Act No. 20.954.

Therefore,

THE PRESIDENT OF THE ARGENTINA NATION

RIGHT:

Article 1 . Facultase the HACIENDA SUBSECRETARIA to grant financial advances to the Provincial Jurisdictions to address the critical financial situation they are facing.

Art. 2o . Advances will be made through the delivery of titles called "INVERSION AND CHILDING BODIES" for a total equivalent to DOLARES ESTADOUNIDENSES CIEN MILLONES ($ 100,000.000.-) and will be distributed according to the working percentages in annexa table.

To this end, the BANCO CENTRAL OF THE ARGENTINA REPUBLIC, as a financial agent of the NATIONAL GOVERNMENT, will proceed to issue, in addition to the provisions of Decree No. 593 of March 29, 1990, with the same characteristics and conditions, "BONS OF INVERSION AND CHILDANCE" for up to the amount equivalent to DOLARES ESTADOUNIDENSES CIEN 100,000.

Art. 3o Las The Provinces shall, prior to the delivery of the titles provided for in Article 2 of the Convention, have the remission of information referred to:

(a) Cumulative budget performance as at 30 September 1990.

(b) Situation of the Provincial Treasury at the same date.

(c) Busy Personnel Plant as at 30 September 1990.

(d) Staffroll for September 1990.

(e) "Charges of Witnesses" of the Provincial Administration in September 1990.

(f) Information requested through the "Information System - Start in March".

Compliance with the above-mentioned provisions shall be subject to approval. Regulations and monitoring of HACIENDA SUBSECRETARIA.

Art. 4o Los The recipient PROVINCIAL GOVERNMENTS shall, prior to the delivery of public titles:

(a) The affectation of the participation of each Province in the Tax Resources Distribution Regime between the Nation and the Provinces established by Law No. 23.548 or the Regime that replaces it for up to the amounts necessary for the attention of all the payments that the NATIONAL GOVERNMENT should make under or on the basis of the "INVERSION AND GROWING BONS" that it had received.

(b) Authorization of the NATIONAL GOVERNMENT to automatically retain the emerging funds of Law No. 23.548 or the regime that replaces it, for up to the amounts necessary for the attention of the "BONOS DE INVERSION y CRECENCIA" that they would have received.
